Casey Anthony: WESH to look at seven key points in case

WESH-Channel 2 is calling attention to a Casey Anthony report at 11 tonight. In an e-mail, the station says that veteran reporter Bob Kealing &#8220;breaks down this week&#8217;s courtroom motions and arguments &#8230; and reveals seven key points exposed in &#8216;The Case Against Casey&#8217;.&#8221;

The station led its 4 p.m. newscast with the prosecution&#8217;s release today of five reasons it&#8217;s seeking the death penalty. The defense&#8217;s &#8220;winning the right to get this list this week was one of seven major developments in the case,&#8221; Kealing said. Kealing said he would list six other key developments at 11.

NBC&#8217;s &#8220;Today&#8221; turned to the Casey Anthony case this morning. The top-rated morning show repeated familiar points in analyzing events that unfolded earlier this week. Anthony is charged with first-degree murder in the death of her daughter, Caylee.

Dan Abrams, the network&#8217;s chief legal analyst, described the addition of the new judge, Belvin Perry, who replaced Stan Strickland.

&#8220;Be careful what you ask for,&#8221; Abrams said. &#8221;They [the defense] had asked to disqualify the previous judge, saying that he had some sort of connection to a blogger who had strong feelings about the case. They got that judge removed. And now they&#8217;ve got a judge who may be even tougher.&#8221;

And Abrams added: &#8220;You always have to be careful when you&#8217;re seeking to dismiss a judge in a case, because you never know what you&#8217;re going to get.&#8221;

State: 5 Reasons Casey Should Die
Defense Will Not Release Mitigating Factors

One of the factors is that the slaying was committed in the commission of another crime, which, in this case, would be aggravated child abuse. Anthony faces that charge as well. If she is convicted of that and murder, the aggravator will be proved.

The next two factors will be more difficult for the state to prove. First, the state must prove that the killing was especially heinous, atrocious or cruel. Next, they must prove that the crime was cold, calculated and premeditated. The duct tape found on Caylee's skull, the high levels of chloroform found in the trunk of Anthony's car and the fact that Anthony was seen with her boyfriend, arm-in-arm renting a movie at the same time the state argues that Caylee was dead or dying, could all help the state, but there is a lot of speculation and aggravating factors must be proved beyond a reasonable doubt.

The last two factors would be easier to prove, that the victim was under 12 and that she was in familial custody, or, with her mother when she was killed. There would be no doubt that Caylee was in Anthony's custody if Anthony is convicted of first-degree murder. The defense's mitigating factors, or reasons why Anthony should not be put to death if convicted, have not been disclosed. The judge said the defense will not have to release those in advance.

Florida law requires that at least one aggravating factor must be proved to pursue capital punishment. Prosecutors in the Anthony case listed five of them.

Legal citations within the document provided by the prosecution showed they believe Caylee was killed as a result of aggravated child abuse.

Prosecutors also contend it was a particularly heinous, atrocious or cruel crime, and they said they contend Caylee's death was the result of a cold, calculated and premeditated crime.

Another listed factor was that Caylee was under the age of 12 when she died, and prosecutors said she was in familial custody, her mother's care, when she was killed.

What does the prosecution&#8217;s death penalty list mean in the Casey Anthony case? TV analysts weighed in last night.

The list was a setback to the defense, WFTV-Channel 9 legal analyst Bill Sheaffer said. &#8220;It gives the state more ammunition during the penalty phase to argue for the death penalty and certainly the facts as we know it support each and every one of these aggravating factors,&#8221; he said.

WESH-Channel 2&#8217;s Bob Kealing said the defense and prosecution were disagreeing over the death-penalty list. Prosecutor Jeff Ashton said he just needs to list the reasons, but defense attorney Jose Baez wants more detail, Kealing reported.

At 11 last night, Kealing looked at seven key points in the case. He said he had polled several sources about &#8220;the biggest developments in a very eventful week.&#8221;

Prosecutors are required by Florida law to explain their reasoning, and in a document released Thursday, they quote five statutes they said will allow them to argue there were aggravating circumstances regarding the death of Caylee Anthony, 2.

By Monday afternoon, Anthony's attorneys must provide to the judge in her murder case a detailed schedule on when they will depose the prosecution's witnesses.

Anthony's defense team is expected to question more than 50 people under oath, in addition to the 36 people that have already been deposed.

Chief Judge Belvin Perry set the deadline in an attempt to speed up the case. Perry said previously that he would not hesitate to find witnesses in contempt of court if they do not cooperate.

Chief Judge Belvin Perry required both the defense and prosecution to turn in a detailed list of their remaining interviews to the court by Monday. The defense list has more than 40 witnesses, including FBI agents, Casey's friends and family members and members of the Orange County Sheriff's Office.

Also, the prosecution filed a motion Monday to say they could not meet the deadline, because the defense had not given them the list in time. They are requesting a 10-day extension.

Judge Perry also filed an order Monday regarding 10 pending death penalty motions. He is requiring the state to file a written response to those motions by June 16 and the defense must submit their replies by June 28.

Baez has asked Perry to order the state's Justice Administrative Commission to produce and pay for eight witness transcripts from recent depositions.

"Usually the judge will OK one or two, but once you start getting into the 10s or 20s, the judge is going to ask a lot of questions," defense attorney Richard Hornsby said. Hornsby has gone through the same process with the JAC. He said a 90-page transcript can cost around $500 to produce. "These are definitely big-ticket items in any criminal case, and in this one, with the amount of witnesses, the costs could become astronomical," Hornsby said.

Also on Monday, Perry ordered both sides to file written arguments on seven of 10 pending death penalty challenges filed by Anthony's defense.

Hornsby said Perry wants both sides to state their positions in writing if this critical part of the case is ever considered by the high courts on appeal. "I think it's important that both sides are able to give their accounts, so that there can be no issue on appeal about whether or not this was waived or this wasn't waived," Hornsby said.

Prosecutors say they&#8217;re having difficulties because the defense hasn't provided a list, defense attorneys will not cooperate or they're still working on the case and can't be questioned.

Meanwhile, Judge Perry continues to place deadlines when it comes to any motions concerning the death penalty.

The state will have until June 16 to file a response to the motions. Then the defense will have until the end of June to reply.

On the 4 p.m. news, WESH anchor Martha Sugalski read Baez&#8217;s critique: &#8220;Your story really showed your bias. There are thousands of transcripts ordered every day across the state and to do a story on it is pretty transparent.&#8221;

Sugalski added that the station&#8217;s report focused on the Anthony team&#8217;s first request for services at taxpayer expense and that transcripts can cost hundreds of dollars apiece.

The foreclosure case involving Casey Anthony's parents is headed toward mediation.

Orange Circuit Judge Julie O'Kane signed paperwork this morning, ordering George and Cindy Anthony into mediation with Bank of America. Both sides agreed to the mediation.

The State Attorney's Office is expected to release more than 500 pages of documents, including law enforcement reports and inventory logs, on Friday. The information is being released in response to public records requests.
