El Dorado County's top prosecutor said today he expects Jaycee Dugard will testify against her alleged kidnappers, and he pleaded with the media to leave her family alone until the trial begins - which could be anywhere from one to two years from now.

He wouldn't comment on reports that the Oprah Winfrey show is paying $1 million for a televised interview in December with Dugard, who prosecutors say was kept captive in a backyard compound of tents and sheds just outside Antioch.
Angela DePaul, a spokeswoman for Winfrey, said today that reports that the show had booked Dugard were inaccurate. Winfrey is interested in speaking with Dugard, but the show does not pay for interviews, DePaul said.

Judge Douglas Phimster, in a 10-minute hearing in El Dorado County Superior Court that was packed to capacity with 50 reporters, set bail for Phillip Garrido at $30 million and ordered him to undergo a psychiatric evaluation.
The bail figure is all but immaterial, because as a federal parolee Garrido can be held without bail. That provision would probably kick in if Garrido managed to raise the $30 million, Pierson said.
Gilbert Maines, the attorney for Nancy Garrido, was granted permission to seek a psychological evaluation for his client but did not say whether he would exercise that option. She is being held without bail.

The only words they said were "Yes, sir" when asked to waive their right to have a trial within 60 days. Mr Garrido had a bandage on his nose from surgery for a minor skin cancer.

Suspects in Jaycee Dugard kidnapping appear in court

California couple charged with a combined 29 felony counts in connection with the kidnapping and rape of Jaycee Dugard appeared in court for a bond hearing Monday.

Phillip and Nancy Garrido, wearing red jail coveralls, were flanked by their attorneys. They appeared to glance at each other only briefly. Phillip Garrido wore a bandage on the side of his nose.

The Garridos are accused of kidnapping Dugard in 1991, when she was 11, and keeping her in a well-hidden compound behind their home in Antioch, California, for 18 years. Phillip Garrido fathered two children with Dugard during her captivity, authorities have said.

The couple had been held without bail, but Phillip Garrido's defense attorney requested that bail be set for him Monday. El Dorado County Superior Court Judge Douglas Phimister set his bond at $30 million.

However, El Dorado County District Attorney Vern Pierson told reporters after the hearing that Garrido, a registered sex offender, is also on a "parole hold," which carries no bond. A parole hold is placed on people on parole or under supervision when they are taken back into custody.

Nancy Garrido's attorney told Phimister that she was not contesting her no-bond status, although she might ask that bond be set in the future.

Both defense attorneys told the judge they wanted to make clear that their clients are invoking the right to counsel and do not want to be questioned. Phimister noted that "other agencies" are interested in interviewing the couple.

Phillip Garrido will undergo a psychiatric evaluation, a common step for defendants. Nancy Garrido's attorney said he was attempting to schedule one for her as well.

The two defendants spoke only once, answering "Yes," when asked by the judge if they were willing to waive their right to a preliminary hearing within 60 days.

Superior Court Judge Douglas Phimister granted a defense attorney's request that Garrido undergo psychological evaluation. His wife, Nancy, remains in custody without bail, and her attorney plans on making a similar request for an evaluation.

Even if Phillip Garrido makes bail, he would be subject to a parole hold because of his conviction in the 1976 kidnapping and rape of a South Lake Tahoe woman.

The Garridos could each receive multiple life sentences if convicted of abducting Dugard as an 11-year-old and raping her over several years in a hidden backyard warren of tents and sheds, where authorities say she gave birth as a teen to two girls fathered by Phillip Garrido.

The Garridos sat quietly in the courtroom Monday morning, their hands shackled in front of them, neither looking at the other. Nancy Garrido used her hair to shield her face from a battery of cameras. Phillip Garrido, who had appeared earlier with three dark blemishes along the bridge of his nose, this time wore a bandage over the area. When asked if he had surgery, his attorney, Susan Gellman, responded, "I think so," but declined to speak further.

The only words the couple spoke were "Yes, sir" when asked to waive their right to have a trial within 60 days.

Britain's Daily Mirror, a colorful, scandal-stirring tabloid, has reported Dugard will appear on "The Oprah Winfrey Show" in December, and that she will receive $1 million for the appearance. Angela DePaul, a spokeswoman for the show, said Monday that no interview has been confirmed. She also took issue with the claim of the million-dollar payout.

"We don't pay for interviews," DePaul said.

Pierson, the district attorney, pleaded with media members to respect the privacy of Dugard, her two daughters and the rest of the reuniting family.

"I've heard comments referring to this family as a piece of property to be had," Pierson said at a news conference Monday morning. "I think they need to be left alone. If you look at this family ... they have a lot to deal with right now."

Pierson said Dugard would likely have to take the witness stand, but not until a trial. He said he does not think a Dugard interview with Winfrey would impede prosecutors.

Nancy Garrido continues to be held without bail, something her attorney did not object to during Monday's hearing. Phillip Garrido is unlikely to be released because of his parole violations, even if he could raise the money.

Nancy Garrido's attorney Gilbert Maines reserved the right to request one.

Gellman told the judge several law enforcement agencies have sought to interview her client about other cases they are pursuing.

"He does not consent to be questioned for any purposes," Gellman said.

The judge said Gellman would notified of any interview efforts.

Outside court, District Attorney Vern Pierson told a throng of media from around the world that investigators were continuing to pursue other leads in the case.

"As of today there are no additional charges ... that's not to say there won't be," he said.

Both defendants are due back in court for an Oct. 29 hearing.

"The family has been doing exceptionally well under the circumstances ... (but) as Abraham Lincoln said, let us all rise to the better angels of our nature and leave this family alone during the time of their reunification," Pierson said.

Asked if he wanted Dugard to testify in the Garridos' trial, Pierson said, "Yes, I would expect that to be the case."

He added, however, that plans could change as the investigation develops.

"I don't think anyone has ever handled a case quite like this one," Pierson said. "It's a pretty unusual case."

Pierson echoed state officials' defense of Edward Santos, the parole agent who cracked the case during last month's interview, despite "legitimate questions" that have been raised about how the state parole system failed to discover Dugard's alleged captivity in many visits over the years.

"This parole agent successfully broke through an elaborate, well-planned cover story that was 18 years in the making," Pierson said. "We all owe him a debt of gratitude."

Phillip Garrido's $30 million bail amount, set at a Monday hearing by an El Dorado County judge, is not the highest ever.

In 1988, for instance, the late San Francisco Judge J. Dominique Olcomendy -- weary that a 25-year-old alleged prostitute was continually being arrested and released -- briefly set her bail at $5 billion.

"I know the amount of bail is outrageous," Olcomendy admitted.

Leaving aside the oddities of the city by the bay, Garrido's bail is right up there, putting the alleged kidnapper-rapist of Jaycee Dugard in the company of a band of similarly notorious killers, molesters and scam artists.

Many accused killers, particularly in death penalty cases, aren't given the opportunity to bail out at all. But in California, defendants have a basic right to a reasonable bail, the idea being that "you shouldn't be punished until you're convicted," said former San Francisco prosecutor Jim Hammer.

Unsolved Garecht, Misheloff Cases Prompt Searches of Garrido Home

Tuesday morning, Hayward and Dublin police department representatives said they had obtained search warrants to comb the Walnut Avenue home, property and that of a neighboring property. The Hayward Police Department is investigating the unsolved Nov. 19, 1988 kidnapping of 9-year-old Michaela Garecht from in front of a Rainbow Market in south Hayward. Dublin Police Services is looking for evidence in the disappearance of 13-year-old Ilene Misheloff in Dublin on Jan. 30, 1988. She never returned home from school.

Cold Case Investigators Swarm Garrido Property
Investigators may be on scene through the weekend

Investigators from Hayward and Dublin were seen searching the property on Walnut Avenue as well as the next door neighbor's property.

Several agencies from across the Bay Area and around the country have looked into the couple ever since news broke of that Dugard had been found.

There are about 60 investigators searching the property.

The Oakland Tribune reported that Hayward officers were there seeking information related to the case of Michaela Garecht, who was abducted in 1998 at age 9 outside of a Hayward grocery store.

The paper said Dublin investigators were looking for ties to Ilene Misheloff, who was 13 when she disappeared in 1989.

The search could last through the weekend and sources say it could include digging and knocking down buildings on the property.

ANTIOCH, California (CNN) -- Investigators from two police agencies were searching the home of the Jaycee Dugard kidnapping suspects Tuesday in connection with two other unsolved abductions, authorities said. Dublin, California, police obtained the search warrant for Phillip and Nancy Garrido's home, along with a neighboring property, in connection with the 1989 disappearance of 13-year-old Ilene Misheloff, police said in a written statement. "Dublin police have been unable to eliminate Phillip and Nancy Garrido as possible suspects in Ilene's disappearance."
In addition, Hayward, California, police obtained a search warrant for the same locations in the 1988 abduction of 9-year-old Michaela Garecht. Both warrants were being executed simultaneously Tuesday, police said.

Hayward police Lt. Chris Orrey said this afternoon that investigators have finished searching an adjacent property to which Garrido had access and are about halfway through searching the exterior of the Garridos' home.

Investigators "haven't located anything earth-shattering at this point" but have located some items that deserve a closer look, Orrey said.

Dozens of police, sheriff's deputies and federal crime scene investigators spent the day combing the property, especially the yard behind the Garridos' gray cinderblock house. Police have boarded up the home's windows and declared the structure unsafe.

Investigators worked quietly over the hum of the Alameda County Sheriff's mobile response unit, which spokesman J.D. Nelson said was on hand to analyze evidence as soon as it's located.

While Nelson would not comment on what, if anything, has been found, he said the focus so far has not been on digging.

"We go where the evidence takes us," he said. "That's why we've got the crime lab out here."

So far crews have focused on the back yard, he said. Through a temporary fence, a pile of loose branches and discarded blue tarps were visible.

Nelson said investigators have not dismantled the home's interior, but would do so if necessary.

"We're going to be here a while," he said.

Investigators returned Wednesday to the Antioch home of Phillip and Nancy Garrido to look for clues in the cases of two girls who disappeared several years ago.

Police arrived Tuesday to look on the Garrido property and nearby land. Investigators were expected to bring in heavy equipment Wednesday in an effort to find evidence that may have been hidden by Phillip Garrido. Investigators were expected to spend at least a week looking in the area.

Hayward police Lt. Christine Orrey said her department is looking for clues to the kidnapping of Michaela Garecht in 1988, including the clothes she was wearing when the then-9-year-old was snatched outside of a supermarket.

Dublin police are also looking for links to the kidnapping of 13-year-old Ilene Misheloff in 1989.
