Alleged Bashara mistress obtains protection order against him

By K. Michelle Moran
C & G Staff Writer

Robert Bashara’s alleged mistress, Rachel Gillett, now says she’s afraid for her life of the man she once loved.

On April 26, Gillett was granted a personal protection order ex parte in Wayne County’s Third Circuit Court against Bashara. The order forbids Bashara from contacting, following or visiting Gillett, and prevents him from legally purchasing or owning a gun.

In documents filed by her attorney, Doraid Elder, Gillett says that she had a three-year relationship with Bashara, during which time she “tried several times to break up with him.” Bashara has stalked her “at home and at work,” she charges in the PPO. Elder said Gillett met Bashara online.

When she learned that Bashara’s wife, Jane Bashara, had been discovered strangled in her vehicle Jan. 25, Gillett’s concerns about her former lover skyrocketed...

-------------

...“Rachel is a victim of Bob Bashara’s lies and deceit. … She is a very sincere person and would never have been involved with him if she knew he was in a solid marriage,” Elder said.

The attorney said Bashara told Gillett his relationship with his wife was “on the rocks” and he was getting a divorce. At one point, Elder said Bashara even told Gillett the divorce had been finalized. But things changed when Gillett asked to see the divorce papers. Not wanting to interfere with the ongoing investigation, Elder declined to say when his client first asked Bashara about seeing proof of his alleged divorce...

--------------

...Now living in an undisclosed location, Elder said Gillett is taking extra precautions for her safety.

“There’s anxiety every time she hears a knock at the door, every time she goes out, every time she leaves the house,” he said.

Bashara’s attorney, David Griem, could not be reached before press time for comment.

Well, not to be mean but then why don't we SEE those divorce papers ladies BEFORE we start relationships with MARRIED MEN!

I AM NOT sympathetic. I DO NOT wish her any harm, but she doesn't get any leeway from me.

Sorry, Lanie's filter is OFF today! :what:

GrossePointeToday.com / News / Public Safety

05.01.2012

Welcome back to the GrossePointeToday.com public-safety roundup. We've been gone a while, and we hope we can lure at least some of our loyal readers back. As some of you know, your public-safety correspondent -- that would be me -- got a new job in January, which combined with the other jobs I was doing, meant something had to give. This was one of them. Things are easier now, and I hope to have more time to devote to making the cop-shop rounds and seeing what's up.

But first, a few words about what I missed. About a month into the hiatus, I got an email from a reader saying, "Wouldn't you know it? You take time off and something actually happens." She was referring to the Jane Bashara homicide, of course, which landed like a bomb just in time for February sweeps.

The whole place went a little crazy, didn't it?
The leaking police departments, the inane TV-dolt standups outside the Park municipal building, the constant gossip -- it didn't let up for a month. But what really bugged me is how quickly the whole story became a joke.

You couldn't help but laugh
at the macabre sideshow of Nancy Grace, Master Bob, the Hinky Meter, the whole nine. I was watching attorney David Griem's press conference on a web stream. He stepped to the microphone and made a joke about there being no truth to the rumor that his nickname among "the S&M ladies" was "Shorty." (I half expected to be reminded to tip my waitress.)

In the midst of it all, it was easy to forget that at the center of the story was a hole, a hole shaped like Jane Bashara. "She was the class of that outfit," someone told me, and I believe it. Once she was gone, it was all a joke. It's not a joke. Let's hope this case gets wrapped soon.

That was at the beginning of our break. At the end? A naked guy running down Mack Avenue in the Woods, freaking on meth.

Now that's a joke.

As for this week? Not so much. The usual drunks, the usual thieves, the usual life of crime here in Grosse Pointe. But starting this week, we're back covering it again.

GROSSE POINTE, Mich. (WXYZ) - Rachel Gillett wasn’t talking when 7 Action News caught up with her Wednesday night...

-----------

For the first time Rachel’s neighbors are speaking out about the PPO and the case. One neighbor, who did not want to be identified, said she saw what looked like Bashara trying to break into Rachel’s flat back in March after Jane Bashara’s murder.

The neighbor tells Action News that she heard him trying to unlock the door and watched as he pushed hard to open it.

Gillett is not accused of any wrongdoing in the Bashara murder. Bob Bashara remains a person of interest in his wife’s murder. Jane Bashara was found dead in her SUV back in March in Detroit.

Bashara murder defendant's competency hearing delayed

By Christine Ferretti
The Detroit News

Detroit — A mental evaluation hearing will be delayed for a St. Clair Shores handyman accused in the death of Jane Bashara, prosecutors said Thursday.

Joseph Gentz was due in 36th District Court on Friday for a competency hearing to determine if he's mentally fit to stand trial on first-degree murder and conspiracy charges in Bashara's Jan. 24 strangulation death.

But Wayne County prosecutors said the hearing will be postponed as a forensic center works to complete reports required for the proceeding. A new date has not yet been set...

----

Gentz's attorney Susan Reed requested the competency evaluation at his March arraignment. Court records say the St. Clair Shores man has the IQ of a third-grader and was previously diagnosed with bipolar and organic mood disorder.

Although Gentz has undergone competency testing, Reed said this week that results weren't in.

"We haven't gotten the results back yet, and I have no idea when they'll come back," she said.

Court Hearing for Gentz in Bashara Homicide Rescheduled

The handyman charged in the strangulation death of Jane E. Bashara was to appear in 36th District Court Friday but the hearing has been adjourned and a new date is to be determined as his competency evaluation continues.

By Sara Eaton Martin, 11:39 am

...

This is the second time the preliminary exam for Joe Gentz has been continued. He was arraigned on charges in early March. Normally a preliminary exam—the hearing during which a judge rules whether the prosecution has sufficient evidence to continue pursuing the case in court—happens within 14 days of the arraignment.

Defendants can waive their right to the 14-day time frame, which is the case with Gentz. His attorney, Susan Reed, requested the competency evaluation during his arraignment, during which he waived the 14 days.

He had been scheduled to appear Friday afternoon in 36th District Court but a new date is to be determined, Wayne County Prosecutor's Office spokeswoman Maria Miller announced Thursday.

A new date has not yet been set but will be announced when one is determined, Miller said.

Officials from the Forensic Center are still working to complete reports related to the competency evaluation, Miller said. The results of the evaluation are necessary to begin the preliminary exam, which will not happen if he is determined as incompetent to stand trial.

According to the Michigan law outlining the procedure for competency evaluations, the center performing the evaluation must include the following:

  • Clinical findings
  • The facts upon which the clinical findings are based upon
  • The opinion about whether the defendant is competent to stand trial or about the likelihood of the defendant becoming competent through a treatment regimen within a certain timeframe
  • The competency evaluation and any of the information gathered for it are not pieces of information that can be used in the criminal proceedings, other than for determining competency to stand trial

DETROIT, Mich. (WJBK) - A hearing to determine the mental status of the man charged in the murder of Grosse Pointe Park businesswoman Jane Bashara has been delayed...

...

Speaking to FOX 2's Amy Lange on Thursday, Bashara attorney David Griem speculates the delay in the competency hearing was because prosecutors are still trying to work out a plea deal with Joe Gentz.

During the interview Griem also addressed the Personal Protection Order requested by Bob Bashara's former girlfriend that was filed on April 26. In a letter to the court, Rachel Gillette said Bashara stalked her during the three years they dated when she tried to break things off with him.

After Jane's death realizing he is "much more of a danger to me than I ever imagined before. And I am terrified that he will hurt me" she said. Gillette says she always thought he was a divorced man and did not know the truth until after his wife was murdered.

Griem said he plans to respond to the PPO in writing to clarify the facts in the case. Griem said Bashara is not stalking his former lover and recently left a Palm Sunday Cross in her mailbox as a sign of friendship.

He admits Bashara probably should not have phoned her after Gillette's attorney had written asking that Bob not contact her anymore, but said the pair spoke for at least twenty minutes which indicated the conversation was mutual.

The competency hearing scheduled to be held Friday for a man charged in the murder of Grosse Pointe Park mother Jane Bashara is expected to be adjourned, according to the Wayne County Prosecutor’s Office.

Joseph Gentz, who was undergoing a psychiatric evaluation, was scheduled to be in Detroit’s 36th District Court Friday. The prosecutor’s office said today that the parties in the case will appear in court Friday to address the adjournment to allow the Forensic Center to complete reports.

Attorney for Bob Bashara's former mistress says client was deceived into thinking Bashara was single

---- VIDEO & TEXT ----

DETROIT (WXYZ) - As Bob Bashara's attorney prepares to file a response to the personal protection order against his client, the woman who sought that PPO is avoiding reporters for fear that talking publicly will hurt the investigation into the murder of Jane Bashara.

7 Action News spoke to attorney Doraid Elder who represents Rachel Gillett.

"The picture that's been painted of Rachel is that she is a willing mistress. She's not. She is someone that was duped, lied to, fell in love and this has been devastating for her," said Elder.

Elder says Gillett went house hunting with Bob Bashara because she believed that Bob and Jane Bashara were already divorced. And it was only several days after Jane Bashara was found dead that Gillett learned that the two were still married...

...

Bashara's attorney David Griem says he will file a response to the PPO against his client by next Thursday but he has no plans to fight it because he thinks it's best that the two have no contact.

Prior to the PPO, Griem acknowledges that his client placed a palm frond cross in Rachel Gillett's mailbox on Palm Sunday.

"He wove it himself and did place it in her mailbox. His thought being that this is a very difficult time for both of them and maybe that would give her some spiritual help," said Griem.

Bob Bashara's attorney has own theory

...

"I believe there are negotiations going on right now between the prosecutor's office and Joe Gentz's to try to reach plea resolution ... and probably sentence resolution for Mr. Gentz. And Mr. Gentz then would be used against Robert Bashara."

Bob Bashara's reputed mistress, Rachel Gillett, retained a personal protection order against Bob. Griem doesn't think that's not such a bad thing.

"Rachel and Mr. Bashara should be prohibited from having contact with each other," Griem said...

So what did we learn from WXYZ’s latest report? For one thing, Gillett's neighbors are pretty much annoyed with the controversy. One neighbor might have one time heard Bashara trying to break into Gillett's home...with a key!

We also learned that Gillett has an attached garage with an electric door. She wouldn’t talk to the camera crew, but they filmed her exiting her vehicle and closing the garage door.

Competency hearing delayed for handyman in Bashara killing

By Christine Ferretti
The Detroit News

Detroit — A mental evaluation hearing was pushed back Friday for the handyman accused in the killing of Jane Bashara as doctors work to gather hospital records.

Joseph Gentz, 48, is charged with first-degree murder and conspiracy in the Jan. 24 slaying of the Grosse Pointe Park marketing executive. The mental evaluation was ordered in March when Gentz was arraigned on the charges.

Gentz is expected to return to 36th District Court in Detroit on June 11 to determine if he's been deemed mentally fit for trial.
