Testimony: Jeffrey Malmberg bought candy, cocaine after suffocating 2-year-old Jozlynn Martinez


After suffocating his girlfriend's 2-year-old daughter in what he claims was an accident born of frustration, Jeffrey Malmberg put her body in a blue garbage bag and tossed it in a Dumpster -- then stopped at a nearby convenience store for some Gummi Worms.

The detailed evidence, showing Malmberg used cocaine and marijuana and was "having a good time" in the hours after allegedly killing Jozlynn Martinez, seemed troubling for even Grand Rapids District Judge Donald Passenger at a Tuesday hearing.

Update: Connie Martinez's son to remain in foster care

We continue to follow the latest developments related to the death of 2-year old Jozlynn Martinez.

Today the girl's mother Connie Martinez was back in court for a child custody hearing. Her 7-month old son, fathered by Malmberg, was placed in foster care during the investigation. The court ruled today that he must stay in foster care for now.

Mother of girl allegedly killed by boyfriend agrees to treatment plan, waiting months for decision on custody of other child

Consuela Martinez, the 21-year-old mother whose boyfriend allegedly killed her 2-year-old daughter in February, must wait at least 90 days to see if the state will reunite her with her surviving 8-month-old son.

Martinez agreed Friday to participate in a treatment plan to better her parenting skills, prevent substance abuse in her life, make a safe home and develop a supportive network of family and friends.

But Jessica Conway, a foster care caseworker with Bethany Christian Services, said Martinez has made efforts to improve her life in recent weeks.

She tested clean on three drug tests and attended supervised weekly parenting sessions with Bryan without fail.

I hope she's able to stay sober, drug-free & clean if she gets the baby back & that she stays away from people who could harm either of them....it must be even harder now to cope sober, still grieving for Jozlynn.

Kudos to Connie for making it this far.

There will be no plea deal for the man accused of killing and disposing of 2-year-old Jozlynn Martinez's body in February.

Jeffrey Malmberg, 30, was in Kent County Circuit Court on Wednesday, where he was told if he pleaded guilty to the second-degree murder charges he faces, the sentence is often less than if he is convicted in trial. But Malmberg declined.

The prosecutor in the Jeffrey Malmberg murder trial tried to show Wednesday why the body of the alleged victim -- 2-year-old Jozlynn Martinez -- was never found.

Kent County's waste-to-energy division director testified to tracking the dumpster where Malmberg said he left the girl. The jury saw video and photographs of the disposal truck arrive at the waste-to-energy facility. The director led the jury through the different stops the load of trash made at the facility. Ultimately, director William Allen said it appeared the trash in question was headed for the incinerator.

After he was alerted to the possibility of the girl's body being in the facility, Allen said the facility was closed and other portions of the facility were searched.

IONO, some things aren't adding up....Supposedly, she was deceased at the house for awhile before he disposed of her. Wouldn't a cadaver dog be able to smell decomposition in the house, car, and trash bin? I feel he is doing this to get off saying he did not mean to.

I still feel he sold her and have emailed the police with that.

A jury in Grand Rapids has convicted 40-year-old Jeffrey Malmberg of killing two-year-old Jozlynn Martinez.

He was convicted of second-degree murder, larceny and tampering with evidence. Malmberg faces a maximum penalty of life in prison, but could be eligible for parole. He will be sentenced in November.

The family of 2-year-old Jozlynn Martinez is glad the jury found Jeffrey Malmberg guilty, but they still have unanswered questions.

"Connie wants Jozlynn so she can lay her to rest," said Cheryl Paulsen, the child's godmother. "That's all Connie wants. She said it is a little bit of closure, but it won't be until she can get her little baby home."

It took the jury less than three hours of deliberating before they found Malmberg, 40, guilty on the three charges he faced: second-degree murder, larceny and tampering with evidence.

A Kent County Jury needed only 3 hours Monday to reach a verdict in the killing of 2-year-old Jozlynn Martinez.

The guilty verdict on a second degree murder charge was what the prosecutor had been seeking. It could mean up to life with a chance of parole.
