Jury selection still underway in ‘Baby Kate’ murder trial

LUDINGTON, Mich. (WOOD) — Baby Kate disappeared June 28, 2011. The 4-month-old’s body has never been found and there is virtually no physical evidence in the case.

[Baby Kate] was last seen with her father, Sean Phillips. He has consistently denied that he had anything to do with her death, despite a letter he allegedly wrote to her mother in which he said he threw the car seat she was riding in and she stopped breathing.

Also Monday, the prosecution learned that one of their experts would not be allowed to testify.

Additionally, the defense reportedly tried to get a deal for manslaughter, which the prosecution rejected.

The hope is that jury selection will wrap up early Tuesday so open statements and witness testimony can begin. The trial is expected to last three weeks.

More than 60 people have been excused so far as the court looks to fill 14 seats, two of which will be alternates.

Wednesday morning, another group of potential jurors will be brought in for the time-consuming selection exercise. The court administrator told 24 Hour News 8 the pool includes 250 people, so she believes they will be able to seat a jury.

Mason County Judge Peter Wadel has instated an unprecedented scheme that has each potential juror leave the courtroom and go to the judge’s chambers, along with the attorneys and defendant Sean Phillips, to be questioned . . .

Wadel said he is confident his actions are constitutional.

Just one seat remains open on the jury.

Wednesday morning the prosecution said they were satisfied with the jury, but the defense used one of their challenges to dismiss a juror, reopening that one last seat.

Once that seat is filled, opening statements will begin.
