In a hearing held today the Judge banned live blogging from court to prevent people who testify from hearing what others have said before them.

The person who found Paul described a bloody scene. Another medical student told about his PS3 that was stolen from that house.

Two other witnesses talked about the defendants and the sale of the stolen game console. Michael Robertson of Ypsilanti said another man brought the defendants to Robertson's house, where they tried to sell the console. Robertson, who said he only recently met the defendants, said he heard them talking about a botched robbery. He heard one of the men say, “This one could come back on us.” The discussion included something about a tussle and a gun going off, Robertson said.

It concerns me that the third one hasn't been charged (yet?).
Also I looked it up and Michigan doesn't have "felony murder."
Under felony murder it wouldn't matter which one pulled the trigger.
But Michagan got rid of "felony murder."
So I am not sure what that means exactly in term of consequences.
 
I don't believe the gun accidently went off either. Plus it pisses me off how they try to blame the victim... "we told him not to move and he reached for something off a dresser"... give me a break. I wish they could get the death penalty but Michigan doesn't have it.

Funny, isn't it. How someone can admit to breaking into victims's room in order to rob the victim, with a loaded gun, and then claim victim was shot by accident. I wish they could get death penalty as well.

This is a standard defense in this type of crime. "He grabbed the gun and it went off by accident. I didn't mean to shoot him."

I've seen this defense many times.
 
Jones and Jordan blame Franklin for the shooting. I wonder how Franklin will plea.
Is there any evidence, other than the testimony of Jones and Jordan, that Franklin was the shooter?

"Franklin is the third and final suspect charged in the case. He is accused of being the man who shot and killed DeWolf on the night of July 23 in DeWolf’s bedroom at the Phi Rho Sigma medical fraternity, 220 N. Ingalls St. in Ann Arbor.

Two other South Carolina men — Joei Jordan, 20, and Shaquille Jones, 21 — have also been charged in DeWolf’s homicide. Jones has already pleaded guilty to second-degree murder, two counts of first-degree home invasion and one count of conspiracy to commit first-degree home invasion. Jordan's case has yet to be resolved.

Franklin has maintained his innocence in the case."

As police investigated the death, Jones and Jordan brazenly returned to the scene of the crime in the 200 block of North Ingalls Street in Ann Arbor, to retrieve a backpack with a stolen laptop and PlayStation – items that would eventually link them to the crime. Jones successfully got the pack despite numerous police officers right next door.
 
Twenty-year-old Joei Jordan, of Sumter, S.C., and 21-year-old Dajeon Franklin, of Pittsfield Township, will have a combined trial with two separate juries.

The jury trial would begin Oct. 6, but both Franklin and Jordan will have time to consider plea deals before then. Jordan seemed poised to take a deal April 6 when he appeared in court, but the case was never called.

The third defendant, 20-year-old Shaquille Jones of North Charleston, S.C., has pleaded guilty to second-degree murder and testified for around an hour at Franklin's preliminary examination April 11.

The law needs to be changed. Anyone who brings a gun into an occupied home with the intent of burglarizing that home, knows that the odds are greater than not that they will run into someone who lives or works in the building. They have brought that gun with them for that very reason. If a murder occurs as a result of them committing a felony (burglary, home invasion burglary), that should be first degree murder.
