Attorney asks for mistrial in Venus Stewart case during opening statements

An attorney for Doug Stewart, who is on trial on charges of murdering his estranged wife Venus Stewart, made a motion for a mistrial Wednesday following the opening statement of St. Joseph County Prosecutor John McDonough.

Jeffrey Schroder told St. Joseph County Circuit Judge Paul Stutesman he was filing the motion because McDonough did not give an appropriate opening statement that complied with Michigan court rules.

“I don't believe the prosecutor talked about one fact to support his theories,” Schroder said. “He talked about all of these police officers the jury is going to hear from … He hasn't given a full and fair presentation to this jury about what he thinks the facts of this case are going to prove.
“The defendant is entitled to hear a full and fair opening statement … so that the defendant can prepare.”

Among other things, Schroder also contended that McDonough read jury instructions during his opening statement that had been objected to by Stewart's attorneys.

After hearing arguments from McDonough on Schroder's motion, Stutesman denied Schroder's motion and ruled that McDonough's opening statement complied with court rules.
