What's really stupid is IF Heather was indeed pregnant, I'm sure SM could have talked her into an abortion. He could have used all kinds of reasoning about how this would be for the best, how she was too young, etc, etc. etc. I mean she had feelings for him and probably would have wanted to please him. She had no means to support a baby and she was pretty naive as well. It didn't HAVE to end in a murder. Both of the M's are just sooo stupid.

Then again, when dumb is combined with evil... well this is what happens.

Why do you think TM isn't attending? Possibly being called as a witness to 'save her man'? Too much of a loose cannon to trust during State's testimony? Not wanting the jury to see both in the same room? You have a pretty accurate bead on reading people/reasonings, what's your feeling on it?
 
I think you're right. Her lawyer probably revealed the evidence they have against them while locked up and she learned of the Walmart video then.

Your post reminded me of how ridiculous she was being when she was acting like she wasn't getting the care she needed as a pregnant woman yet she was refusing prenatal care & vitamins. That pregnancy couldn't have looked more like a sham.

So it will be interesting if the defense can actually put somebody on the stand and say that the pregnancy test was for TM. Is Truslow allowed to say that in his closing argument if it wasn't brought up by a witness?

BBM. No idea, but I hope that if he is, the State plans to include the narrative of Tammy's fake pregnancy.
 
I'm curious to see how they throw in the 5000 TM withdrew that night....
 
There's so much left to present, like the threatening texts and calls, the rest of the evidence found at the Moorer's home etc...
 
Because the expert is going to testify that based on all the tests he ran, based on his years of experience....blah, blah, blah, he determined the physical characteristics of the vehicle in the video matched SM's truck in every way he could have determined it to match. Then a cop will probably testify how many black F150 trucks they looked at in the area (maybe even across the state) and the unique characteristics of SM's truck configuration.

I predict this will be a very long (and dull, in my opinion, since I am not a car/truck person) part of the trial.
 
Didn't we read something about a Bi-Lo receipt too? Where does that play in? I remember TM trying to create an alibi for that saying she was couponing that night.

Coupons?! Maybe that is how SM got the PT so cheaply. JK
 
One can only hope the defense calls her, but I think the prosecution cannot due to marital privilege. Someone please correct me if I'm wrong.

I believe marital privilege only protects her/Sid from testifying against anything either told the other (in confidence). But it does not prohibit them from testifying to things the observed/witnessed.

So I could testify that I saw my spouse kill someone but not that he told me that he killed someone. At least that's how it has been explained to me.

Other posts asked how SM would know she might be pregnant... were there calls before that night... maybe that's where the notes on the truck come in.

Wanting Heather to have an abortion? You just opened up another theory in my mind.

BBM -- I'm thinking Sidney would strongly favor an abortion. He wanted it all to go away >Heather included. Heather may have resisted and it made him angry. I do believe they communicated in some way prior to the 18th.
 
Heather may have been quite far along. They were having an affair for some months prior and had already been broken up for 6 weeks. Maybe Heather told SM about the possibility before the break-up and the text messages that CBTM saw included discussion of a possible pregnancy. Heather may have been in denial after the break-up & refusing to take another test. For that weight gain & breast changes, I feel like Heather was over 3 months PG.

Yes - the items introduced were not explained. Will they go into CBTM's stalking album of the Elvis family or save that for her trial?

I agree with the BBM. I think one of the witnesses testified she had gained about 20 lbs. and gone up two bra cup sizes. I feel that she was over 3 months as well.
 
So let's discount TM's faked pregnancy. Since we know that SM bought the test 12-18-13 and they were arrested in February TM would have been preggers when she was incarcerated, she wouldn't wait until March to claim that. Totally bs.

A woman her age would not refuse prenatal care either. JMO

Sounds right to me. So if the defense would call her, would the marital privilege be thrown out the window on the cross examination by the prosecution? Like you said, we can only hope they call her, but Truslow is not that stupid IMO.
