The father of a 6-year-old boy who was shot to death and discovered in a car trunk last week in Mound can make funeral arrangements without involvement by the child's mother, the accused killer, a judge ruled Thursday.

Hart's attorney, Michael Sharkey, wrote in a petition to the court, "The father of a little boy who was murdered should not have to share decision-making with the person who allegedly murdered his son.

During a brief teleconference hearing before Judge Patrick Robben, Thaler agreed to waive her right under state law to have an equal role with Hart in planning Eli's funeral. Hart also agreed that her father can assist in making arrangements.

Thaler sat in a jail holding room and said through her attorney in the criminal case, Shauna Kieffer, that "she is heartbroken and that she is wanting her father to participate, and it sounds like he is."

It has been brought to our attention that Robert Paul Pikkarainen is not known to be the POI / second person arrested in relation to Eli's case.

Chances are however that it will be him, and even if it's not I don't think we have an issue with discussing someone who is in custody, facing 2nd degree murder charges, and is obviously a POI in relation to a murder, whether related to Eli or not. Discussion of him is allowed.

Some update info: According to the criminal complaint, Eli was shot up to nine times in the body & head. Authorities found a shotgun in the trunk of Thaler's car, near the boy's body. Police said Thaler bought the shotgun on March 17, six days after Eli's biological father, Tory Hart, filed a petition seeking custody of his son. That case still was pending, with a hearing set for June 21 at the time of Eli's death, court records show.

I wish she could be charged with first degree murder. I find it hard to believe that this crime wasn't premeditated. She (JT) purchased the shotgun 6 day's after TH filed for custody of Eli.

MOUND, Minn. -- The Mound City Council unanimously passed a resolution to rename a portion of a bridge to memorialize 6-year-old Eli Hart, who was found dead in the trunk of a car his mother was driving in May.

The city council will work with Hennepin County to rename a portion of Shoreline Drive that goes over Seton Channel the "Eli Hart Memorial Bridge."

The decision came after an online petition received over 2,000 signatures and the blessing of Tory Hart, Eli Hart's father.

Mother charged with son's murder won't cooperate with competency exam

A judge who was expected to rule on whether Julissa Thaler, Eli Hart's mom, is competent to stand trial delayed the hearing and urged Thaler to cooperate.

SBM: Judge Lisa Janzen says so far, Thaler has refused to take part in the competency evaluation.

Meantime in the criminal case, no trial dates have been set for Thaler. If the judge eventually rules her incompetent to stand trial at the psychologist's recommendation, that would put the entire case on hold for at least six months while she receives treatment.

Thaler is scheduled to be back in court on Sept. 27, with hopes that she will have participated in the mental evaluation.

MINNEAPOLIS (FOX 9) - The Twin Cities mom accused of killing her 6-year-old son and hiding him in the trunk of her car has been found competent to stand trial.

Julissa Thaler, of Spring Park, is charged with second-degree murder, with intent, in the killing of Eli Hart on May 20. She's accused of shooting Eli up to nine times with a shotgun in her vehicle, and then hiding his body in the trunk.

Thaler was found competent to stand trial during a brief court hearing on Tuesday afternoon. She appeared via Zoom in an orange jumpsuit from Hennepin County Jail.

Thaler, who initially did not fully cooperate with a psychiatrist evaluation, did so this time, and the judge ruled Thaler has the ability to rationalize and understand the criminal proceedings as well as consult with her defense attorney.

Now that Thaler has been found competent to proceed, the criminal case can now proceed toward trial. Thaler's next hearing is scheduled for 9 a.m. on Oct. 7.
