9/6/22 Update: Judge Lisa Janzen says so far, Thaler has refused to take part in the competency evaluation. Meantime in the criminal case, no trial dates have been set for Thaler. If the judge eventually rules her incompetent to stand trial at the psychologist's recommendation, that would put the entire case on hold for at least six months while she receives treatment. Thaler is scheduled to be back in court on 9/27/22, with hopes that she will have participated in the mental evaluation. Bail stands as previously ordered. Omnibus hearing on 9/14/22 is cancelled. Omnibus hearing originally scheduled on 9/14/22 is now on 10/7/22 @ 9am. 9/22/22: Rule 20 Evaluation report (#17). Rule 20 report distributed.
9/27/22 Update: Hearing held on record/remote. Bail to stand as previously ordered. Found competent to stand trial. 10/5/22: #19 & 20: Notice of Motion & Motion. Next omnibus hearing on 10/7/22.

Oct. 7, 2022
MINNEAPOLIS (FOX 9) - Prosecutors have offered the mother accused of killing her 6-year-old son and hiding his body in the trunk of a car a deal to plead guilty to second-degree murder.

Julissa Thaler, of Spring Park, is charged with second-degree murder, with intent, in the killing of Eli Hart on May 20. She's accused of shooting Eli up to nine times with a shotgun in her vehicle and then hiding his body in the trunk.

She was found competent to stand trial last month. It was revealed on Friday that the state offered Thaler 40 years in prison to plead guilty to the second-degree murder charge. She has until the end of the month to accept the deal, or it's off the table.

A trial date is set for Jan. 30, 2023. Given the offer, prosecutors may be willing to indict Thaler on first-degree murder charges if she doesn't take this deal, according to FOX 9's Paul Blume.
[.....]
Meanwhile, Thaler's attorney asked for her to be released on $0 bail and electronic home monitoring, writing she "is a person of good character and sound judgment" with no criminal history. The judge rejected that motion.

Thaler's attorney is also seeking for the case to be tossed out completely. Another court filing shows her attorney is seeking to suppress all the evidence in the case.

oops - info already in article. I should read it first, eh? :D

IMO This case is beyond sad. I grew up in Mound so I know the area well even though I don't live there anymore.
It still is confusing to me why Orono LE stopped her in Mound unless the complaint happened in Orono and they followed the tire marks on the road to find the car. Outside their town... strange
Do you know the 5 areas LE searched? Sounds like 3 different towns (Mound, Minnetrista and Spring Park). Orono LE serves Mound, Spring Park, Orono and Minnetonka Beach. Not sure when Mound LE closed. I grew up with the station and Shirley Hills elementary school where he was a kindergartener.

That’s laughable- there’s no way she’s a person of good character and sound judgment.

Dec. 7, 2022
ORONO, Minn. (FOX 9) - The attorney for a mom accused of killing her son, Eli Hart, is seeking to have her statements to investigators suppressed.
[.....]
She's accused of shooting Eli up to nine times with a shotgun in her vehicle and then hiding his body in the trunk. Orono Police pulled Thaler over on May 20 after she was spotted driving on the rim of her car and with a window smashed out. Officers drove Thaler home, and then discovered Eli's body in the trunk. She was then arrested.

In a court filing on Dec. 2, Thaler's attorney filed a motion to suppress "any and all statements obtained in violation of her constitutional and statutory rights." The filing says in two interrogations, Thaler requested a lawyer but the interrogations continued.
[.....]
Thaler's trial is currently scheduled for 9 a.m. on Jan. 30. She was offered a plea deal though it's unclear if she'll accept it.

Meanwhile, Eli Hart's father, Tory Hart, filed a wrongful death lawsuit earlier this year related to his son's killing, seeking more than $75,000 in damages. The lawsuit says Dakota County Social Services provided services to Eli, with Tory Hart claiming the county and its employees were negligent. Dakota County and two Dakota County employees, Sherri Larson and Beth Dehner, were named in the lawsuit.

Jan. 6, 2023
MINNEAPOLIS (FOX 9) - The mother of Eli Hart has now been charged in connection to assault at the Hennepin County Jail.

Julissa Thaler, 28, is charged with fifth-degree assault for "shoving and elbowing" a deputy inside the jail. She is already awaiting a murder trial later this month for allegedly fatally shooting her son on May 20, 2022.
[.....]
According to the criminal complaint, which was filed on Friday, Jan. 6, detention deputies conducted a shakedown at the Hennepin County Jail in Minneapolis on Aug. 1, 2022. After the shakedown, Thaler "became uncooperative," and refused to go back to her cell.

Deputies "decided to guide" Thaler to her cell but while this was happening, she "shoved and also elbowed" one of the deputies in the left arm, charges said. The deputy "felt pain after the altercation."

Thanks for the update @Niner
I wish she could be charged with first degree murder. I find it hard to believe that this crime wasn't premeditated. She (JT) purchased the shotgun 6 day's after TH filed for custody of Eli.
I was just re reading this tragic thread and had the exact same thought. Can't understand why it is second degree. :(

and have yet to find anything on the assault on the deputy.

I believe they re-started her case. See this article. Now charged with 1st degree murder.

Jan. 13, 2023
SPRING PARK, Minn. (FOX 9) - Eli Hart's mother has been indicted on charges of first-degree murder in the killing of her son on May 20, 2022.

Julissa Thaler, 28, of Spring Park, was initially charged with second-degree murder in the killing of Eli Hart, but after turning down a plea deal charges against her were upgraded to first-degree murder.

She appeared in court on Friday on the first-degree murder indictment. Her bail was increased to $2 million earlier this week.
[.....]
Thaler's trial is currently scheduled for 9 a.m. on Jan. 30.

Meanwhile, Thaler was also charged with fifth-degree assault against a deputy while in jail.

I am going to "guess" on Order denying motion is to continue trial. :)
