Good morning trial watchers - I thought they were going to have a hearing on the Morries Hall issue this morning to see if he’s going to invoke a blanket 5th amendment!? Or has that been decided already? I missed most of yesterday.

Yes, it's scheduled for this morning. However, we're not sure if the hearing with MH will be streamed.

Here's a few tweets from the last of yesterday's hearing:

Prosecutor Steve Schleicher is using this 9:29 timeline with Seth Stoughton so Stoughton can basically document all the apparent mistakes made during #DerekChauvin knee restraint. Professor Stoughton basing his analysis on a reasonable officer in similar situation.

DID BYSTANDERS PRESENT A THREAT? National use of force expert concludes there was no threat from bystanders gathered around #GeorgeFloyd deadly arrest scene outside Cup Foods. Defense currently cross examining Univ of South Carolina professor Seth Stoughton.

As we close out another heavy, emotional day, a look ahead to Tuesday: At #ChauvinTrial, expect prosecutors to formally rest case & defense to start calling witnesses. At noon, families of #GeorgeFloyd & #DaunteWright plan 2 rally together outside courthouse as both seek justice.

They are putting him on the stand knowing he will say nothing atall? Can Nelson ask for a mistrial due to this? Seems a waste of time getting him up there just to plead the fifth, Nelson will be talking to himself...

MOO, Nelson wants him up there to plead the fifth minimally, to point to the doubt that he did an overdose in the jury. And if that happens, he can point perhaps to the one charge that the person responsible IN one of the charges (3rd degree) for Chauvin, is that Hall is responsible due to drug overdose. And not Chauvin. iykwim.

MOO

ETA: No, he cannot ask for mistrial due to this MOO

Good morning trial watchers....agree hope MH is streamed...it should be. Based on his hearing yesterday in another county it could be quite interesting...at least he has to talk. Last night here in Minneapolis we had curfew due to the officer shooting on Sunday...National Guard on most street corners etc. I cannot help but wonder about what these jurors are thinking about their potential verdict. Change of venue ...even a short distance up North here in Mn. might have been a good idea.

The prosecution refusing to grant a key witness — Hall — immunity is of no surprise, as there’s a probability he could be culpable of GF’s death under MN law, creating the reasonable doubt for DC. One could call this a suppression of facts, IMO.

As is the same with the other 3 police officers!

Thanks for pointing out that the 3 police officers are in the same boat as Hall as many folks forget such and need to be reminded that they are refusing to testify for the same exact reasons.

Both situations are within US laws - but excellent point you make that LE is doing the same as this witness.

Some may view as suppression... (but within US law) 3 to 1 ratio that Keung, Lane and Thoa are in the same boat as Hall.

MOO

Anyone consider that if he is allowed to testify, Hall will be helping Chauvin and though may feel safe about not incriminating himself legally, may not be so safe on the street...? How do you think GF's family and supporters will react to him if he does testify for the Defense?

#DerekChauvinTrial - Nelson want to show parts of Minneapolis Park police officer Chang's body cam footage. Change responded to the scene and was monitoring Hill and Hall at Floyd's car.

Chang.jpg

Here you see from the Dragon Wok cctv footage, Park police officer Peter Chang arrive, Ofc. Kueng hands him a paper with #GeorgeFloyd's info and Change returns to car to look up the info.

Judge will allow defense to show redacted parts of Officer's Chang's body cam footage, redacting the part that shows #GeorgeFloyd's personal info on his computer inside his squad car. 10 min recess to give defense time to edit.

COURT IN SESSION: Attorneys arguing about expected evidence & upcoming testimony from defense today. Specifically related to Park Police officer Peter Chang, who looked up #GeorgeFloyd info on squad computer during deadly encounter w/ #Mpls police officers.

#DerekChauvin defense attorney Eric Nelson fighting for officer Chang evidence, specifically relating to group of bystanders on sidewalk. Were they a risk/threat to officers dealing w/ #GeorgeFloyd? Seems Nelson is going to stick passionately w/ idea crowd was threatening.

Defense has some editing to do on Police officer Chang's body worn camera video. Specifically cutting out #GeorgeFloyd personal info we are told is clearly visible on in-squad computer screen. Nelson asks for 10 minutes to do that. Judge says jury will come in for 9:30am start.

Other AM developments to look for:
State formally resting case after some book keeping on exhibits, etc.
Defense potentially asking Judge Cahill for a directed verdict, arguing state failed to prove charges.
Morries Hall officially taking the 5th.
Defense start calling witnesses.

I do believe he would only help the defense. I’m undecided on why exactly he doesn’t want to testify. It could be many things and multiple things. I’m sure his safety is up there on the list.

Another possible factor in an appeal. JMO

So Nelson is claiming DC’s actions were lawful and reasonable, but even if they weren’t that doesn’t matter because GF overdosed coincidentally at the very moment his neck was under DC’s knee. But if it wasn’t that then drugs, heart problems, excited delirium. If it was none of those then blame the unruly mob.

Talk about slinging mud until something sticks.

.MOO it will be very interesting today to see how the prosecution does when they are on the opposite side of the cross examination roles. (Not allowed to do leading questions)
(c)Leading questions.
Leading questions should not be used on the direct examination of a witness except as may be necessary to develop the witness' testimony. Ordinarily leading questions should be permitted on cross-examination. When a party calls a hostile witness, an adverse party, or a witness identified with an adverse party, interrogation may be by leading questions.
