Prosecutors announced Monday they would seek the death penalty for Richard Emery, the St. Charles man charged with committing a quadruple homicide in December of 2018.

"Prosecutors announced Monday they would seek the death penalty for Richard Emery, the St. Charles man charged with committing a quadruple homicide in December of 2018.

Police were called to the scene of a shooting in the 100 block of Whetstone at 11:55 p.m. Friday, December 28. The 911 dispatcher reportedly heard gunshots and sounds of people screaming during the call."

"We intend to seek the death penalty,” he said. “The way it works in Missouri we as prosecutors in first degree-murder cases can ask the jury after hearing evidence to consider whether the death penalty is appropriate,” he said. “There would have to be a finding of guilty before that, but in the penalty phase, the jury will be given the opportunity to consider the death penalty."

1/4/22 Update: The murder trial set to begin next week (1/10/22) in St. Charles County was postponed Tuesday until September because of the recent sudden death of one of the defendant's public defenders. A judge granted Emery's request to delay the trial because of the Dec. 15, 2021 death of Emery's public defender, Charles D. Hoskins. Jury selection in Emery's death penalty trial was scheduled to begin before Circuit Judge Michael Fagras. The trial was continued to 9/6/22. In November, the court sealed Emery's case & docket ahead of the January trial date, making them publicly inaccessible in Case.Net, the state's online courts database. It was not immediately clear if the judge would unseal the case until closer to the new trial date. His lawyers are planning to present a diminished capacity defense that could include testimony that Emery suffers from borderline personality disorder.

ST. CHARLES COUNTY, Mo. – A man is on trial for being accused of killing his girlfriend, her two children, and her mother almost four years ago.

The jury selection began Tuesday in St. Charles County. The St. Charles County Prosecuting Attorney’s Office said they will seek the death penalty for Richard Emery in this trial. He is charged with four counts of first-degree murder and facing charges on other crimes.

3 weeks is a long time for jury selection, but necessary when it is a capital trial, it is so important they evaluate every juror who will have the decision of life or death if he is convicted
I am opposed to DP and am fortunate to live in a country where DP is not an option,
