Missouri is a constitutional carry state:
"Jan. 1, 2017 lawful owners of firearms will be able to conceal and carry them anywhere in Missouri, subject to the limitations that already exist — not in the likes of courthouses, jails, polling places or businesses, such as grocery stores, that post “no guns” at their doors"

Walmart has not banned guns.
Instead, they banned Andreychenko.
That sounds really appropriate.

He hated Walmart and went to their store specifically intending to be disruptive. MOO Any manager interacting with him might easily have been shot.

Andreychenko said he was surprised by disruption he caused, MOO I would say that is a lie and he had a good idea there would be a big reaction.
But, I do think it all happened differently than he anticipated it would.
MOO he thought first a manager would approach him and ask him to put his AR in his car, thus "denying his rights" and triggering whatever he planned if he was impeded.

MOO the court will decide. Arraignment likely Monday.
Arraignment likely Monday?
Do you have the link for that?
Normally, Arraignment takes place the day after charges are filed. Bail has already been set at $10,000 bond. The judge sets bail at arraignment.
My guess if he was arrested on Thurs, Charged on Friday, then he was already arraigned either on Friday, or Saturday.

Bail was set 3 days ago at $10,000 bond.
It was not immediately clear if Mr. Andreychenko, who was being held at the Greene County Jail with bail set at $10,000, had a lawyer.

Your article states bail was set at $10,000 It also states he appeared today in front of a judge. Bail must have been set before today if I read it on Sat.
I'm wondering if today was a preliminary hearing .
Do you have the link from the other day where you stated he was going to be "arraigned" today?
Thanks.

Preliminary hearing is set for 9/16.
That will be the next news.

I did't have a link.
Police can only hold an arrested person without charges for for 3 court business days. He was arrested on Thursday 8/8, booked just after 9pm. It is a pretty simple charge so my guess was he would arraigned on Monday.

Bond is set at $10,000. Everything is hunky dory, Mr. Andreychenko is free and headed back to work. We shouldn't assume that he'll have his guns returned to him at some future date.

With any luck, he'll be on the radar of the FBI.

Based on the law why is he being charged? Is open carry legal?

Thank you for bringing this story to light.

While many heroic legally armed citizens are saving lives it rarely makes MSM national news.

I see this same type of heroism done often by other legally armed citizens because I search for local news articles across the country in all states instead of seeking out MSM national news sites where they are rarely ever mentioned.

I cant recall the state at the moment, but just in the last few days I read about another armed citizen who stopped three armed robbers in a convenient store. All three criminals were heavily armed, but it did not stop the good citizen from doing what he knew was right, and what had to be done to protect everyone inside.

Thank goodness this armed citizen stopped this horrid individual in his tracks too, and saved many lives.

I feel much more protected no matter where I go out publically if I see armed police officers there or an armed citizen carrying their weapon on their side. I try to stay away from any business that advertises they are a gun free zone.

Again thank you for linking this heroic story. All legally armed citizens who have stepped up to the plate, and saved lives deserves full recognition.

These are the individuals who did not have to become involved putting their own lives in jeopardy.

They all do it because they know it is the right thing to do in order to protect others.

Jmho

Armed cops, yes. Armed citizens making me feel safer? Hell no. They could be insane. They could be evil. They could be there to erupt in a mass shooting or a robbery. They could be prone to panic and randomly shoot unintended targets. They could be bad shots and accidentally shoot me or my family when trying to shoot a perceived threat.

It's baffling to me that civilians would ever feel comforted at the thought of non-LE civilians carrying guns in a public place, knowing zero about their temperament, history, mental health, criminal history, motives for being armed and/or training.

Absolutely baffling.

He's got those "crazy" eyes. Some of his FB photos hint at drug use (pockmarked face, manic behavior). Unable to hold down a job very long, nor complete schooling.

JMO this is a publicity stunt by his attorney and I don't think it's going to have the desired effect. The public is no longer in the mood for "legalized" domestic terrorism.

Imagine how popular it will be to have every meth head in every US city and village legally running around brandishing assault rifles and body armour and high capacity magazines.

Law abiding citizens will feel like they're playing "Russian Roulette" every time they go out in public, wondering whether each loony running around the store with his loaded AR15 is just "exercising his rights" or is ready to start shooting. How is the general public supposed to know the difference? The domestic terrorists and gun freaks look the same.

LE will probably jump off this bandwagon as well as major retailers. But how many more innocent people will die?

He looks totally normal to me. Acne as a kid doesn't mean drug use.

I think he's a gun advocate angry about gun laws that wouldn't sell to him and was pushing the law.

I also don't understand the charges unless they feel his full tactial gear coupled with being armed constituted a terroristic threat.

But the judge seemed to not think this was very serious.

I think he's going to get off.

According to this article, he was carrying multiple weapons 100 rounds of ammo, filming himself on his cell phone and making comments to other customers. IOW, he was behaving in a way that made other customers fearful, other than having his weapon. I hope they check him for drug use, too. That can result in him permanently losing his "right to bear arms". He may have the right to openly carry a military style weapon in Walmart, but it doesn't give him the right to say and do other things to instill fear in customers. It's a fine line and the public's rights and safety should come first, JMO.

Knowing his attorney, Dee Wampler, he probably will. Wampler is notorious for bullying and intimidating prosecutors and judges. He's helped many killers remain free. But only the ones who are "good Christians" like himself.

Here's a case where Wampler was co-c0unsel and won acquittal of a man who was believed to have killed his wife and kids for insurance money so he could marry his girlfriend. I read about this case in a book about 10 yrs ago and it was very disturbing.

I'm just not sure there's a real case.

Yes, they did. The judge scolded him like a little kid, claimed he was going to hold him on house arrest, then changed his mind so he can go to work.

A judges admonishment is a strong warning with a statement of consequences if warning not heeded It can be delivered at the judges discretion with strident language. It is literally a "scolding." Is Andreychenko a citizen, because admonishments are also delivered to forewarn a defendant that deportation is one outcome of failing to heed court direction.

"In legal cases, an admonition from a judge is a warning to a defendant that something is not to take place, or that it should take place. If the defendant fails to obey what the judge has warned them of, then a more severe punishment will be handed down."

Agree.
There is no case here about carrying the gun because Walmart does not have "no guns" sign up.
On the other hand he went into Walmart intentionally to make a disturbance and provoke conflict. So a court will have to sort that out. His youth will work to his advantage.

We'll see. The public (and apparently WalMart) are getting fed up with this behavior. How does a security guard or innocent shopper know the difference between this idiot and the one who actually shot up the WalMart in El Paso? They don't.
