Good question! I think this is unprecedented! I really doubt they will come back all as not guilty, though.

When being polled by the Judge, one juror stated: Not innocent.

Pass the Grigio.
 
I feel bad the state blew all that money on sequestering a jury that is ill-suited to ever be on a jury.

QT is entitled to ‘a jury of his peers’. And here they are. :doh:

(But to the person who asked whether we’re rethinking the concept of professional juries, my answer is still no.)

So are they back to deliberating?

IMO the judge does not have to declare a mistrial if they come back with a unanimous verdict of guilty or not guilty.

Well, unless they come back as not guilty, there WILL be another trial, either because it will be a mistrial, or they will surely win an appeal. They definitely should after this **** show.
 
As long as he's not acquitted... I certainly hope those 6 or 7 guilties don't change their minds.

RBBM. Only if the State decided to retry. Not all do. There are reasons both sides are not asking for a Mistrial yet.

True. They might not want to spend the money again unless new information/witnesses come forward. Someone would need to talk, and that probably won't happen

I don’t think so. As I understand the defense did not request a mistrial before they were sent back to deliberate. So it’s essentially waived.

What would be the grounds for mistrial if they came back with a unanimous guilty verdict?
 
Both sides helped select this jury. I think the defense knew exactly what they were aiming for and got it.

Not a mistrial, but an appeal would be easily granted, I would think. This jury is not competent.
 
I am truly shocked they didn’t immediately notify the court they were deadlocked when they last returned to the jury room. I think they are still confused.
I wonder if we will hear from any of the jurors post trial. Oh to be a fly on the wall....

Thank you for answering a question I had been mulling over. I was under the impression that most defense attorneys will request a mistrial just to have it on record so there is no question of ineffectual council.
 
What could the jury even be discussing at this point? It is clear they are hung ...they just need to say so!

Every minute longer they're in there, the more concerned I become. Is it possible that in the beginning they thought each had to reach their own verdict/decision, notify the judge, then go home? Could they just now be realizing that they need to try to come to an agreement?

A lot of times it depends on the split... if they have a majority guilty I think they'll finesse their strategy and retry... What he did to her is too horrific.

All jmo.
