Well, Mr. McLellan is now cooling his heels in Central Prison in Raleigh, where they keep the worst, and where they keep the men sentenced to death.
He would normally be housed in the Robeson County Jail in Lumberton, NC, until his trial, but not this time.

In viewing the info on the NC Dept. of Public Safety (a part of which is below), it says he is imprisoned due to a parole violation. Hmmmm, how 'bout that?!
Below is some info on him according to NC Dept. of Public Safety. Note the red line I highlighted below.
So he's there with the big guys in The Big House.

If he is convicted and sentenced to Death, he will be there for the rest of his days, clothed in the special DP inmate RED prison jumpsuit until his body is taken out in a box.

Hania’s cousin reportedly witnessed a male wearing a yellow bandana push the 13-year-old inside a Green Ford SUV and speed out of the Rosewood Mobile home park the morning the kidnapping was reported. Lumberton police say the kidnapping occurred around 6:58 a.m. Probable cause affidavits filed by the District Attorney’s Office note Hania’s cousin was not the only person who reported unusual behavior early that morning in the mobile home park.

Investigators also talked to a person who said they walk the entrance to the park each morning to catch a ride. In the documents obtained by News13, the female said a black male wearing a dark hoodie walked into the mobile home park at 6:15a.m. Upon seeing the male, she told officials she became uncomfortable and she pretended to take a phone call on her cell, at which time the man walked away.

The affidavits also say two more witnesses who live in the park say they saw a person on their porch that morning, possibly trying to break in. When they looked out their window, they saw a black male wearing a mask who then jumped off the porch. Twelve minutes after the witnesses reportedly saw the male on their porch, the 911 call about Hania’s abduction was made.

Another group of witnesses who were familiar with McLellan say he showed up to Deerfield Mobile Home Park the day of the kidnapping wearing all black clothing and a yellow bandana. The witnesses also added that McLellan was all wet. The documents state he had a cup of change in what appeared to be a kids “superhero” cup and he was trying to sell two video monitors. The affidavits say that last time the witnesses saw McLellan, he told them he had no money.

The owner of the stolen Ford SUV initially reported she had a bunch of loose change in the car when it was taken, the affidavit from the DA’s office said.
I recall several pages wondering about who the assailant was affiliated with. More details from the article:

Other people detectives interviewed mentioned when McLellan commits crimes, he likes to wear a yellow bandana to cover his face. The witnesses also said McLellan wears the yellow bandana so people “wouldn’t know he was black” and they would think he was a Latin King gang member.

A black hair tie on her left wrist was all 13-year-old Hania Noelia Aguilar had when authorities found her naked body partially submerged in a muddy pit in late November in Robeson County.

An autopsy report released Wednesday from the N.C. Office of the Chief Medical Examiner stated the girl likely died from asphyxia or suffocation, and her cause of death is listed as "homicidal violence of undetermined means."

Because of decomposition, a "specific mechanism of death" could not be determined.


"Numerous twig and leaves are on the body, especially tangled in the hair" the report states.

Michael Ray McLellan, 34, of Robeson County, is charged in Aguilar's death. Charges are first-degree murder, first-degree forcible rape and statutory rape of a person 15 or younger, first-degree sex offense and statutory sex offense with a person 15 or younger, first-degree kidnapping, larceny, restraint, abduction of a child and concealment of a death.
The complete disregard for human life by the defendant against poor Hania is disgusting. Broken and dumped like garbage!! :mad: I hope he suffers every single day of his pathetic life going forward.

The man charged with kidnapping, raping and killing 13-year-old Hania Aguilar was within reach of law enforcement in the days after the kidnapping, but kept slipping away.

That information was included in more than 500 pages of documents filed by investigators for 23 search warrants that covered cell phone records for McLellan and others identified as “material witnesses;” GPS coordinates from Google accounts; a sport utility vehicle; and a residence on Atkinson Road in Orrum.

The Ford Explorer was found Nov. 8, in woods on Quincey Drive, off Alamac Road, about a half-mile from Deerfield Mobile Home Park. Inside, investigators found clothes believed to be Hania’s, the documents show.

Josh Allen lives in the park and told investigators that he and his brother had an encounter with McLellan about two hours after Hania was kidnapped, according to the documents. Allen said McLellan, dressed in black clothing and wearing a yellow bandana, approached them. His clothes were wet, according to the documents. McLellan asked if he could wash his clothes at Allen’s house.

The same day the SUV was found, Allen saw McLellan in the mobile home park. McLellan asked Allen if he could use his phone. As McLellan was wrapping up the call, Allen said four police officers walked in the park. McLellan, whose back was to them, turned around to give Allen the phone “and looked directly at the four officers,” according to the documents.

McLellan ran away before he could be seen.

Quoting myself because I just listened to the first episode and Hania's case gets mentioned so it's not off topic afterall. The podcaster points out that the cases are not thought to be linked but something that was said when Hania's case was getting lots of media coverage upset Rhonda Jones' family member (he did not specify what upset her).

I also thought it is interesting to note that in the podcast they said Rhonda Jones claimed to have been raped "by a Mexican dude" sometime before she was murdered. We know McLellen liked to wear that yellow bandana so people would think he was in a Mexican gang and not black. Perhaps he was the "Mexican dude" who raped Rhonda before her death? I wonder if he is responsible for the 3 murdered women or other missing area women too? Was he in prison in April/June 2017? What about Sept 2017 when Abby Patterson disappeared?

Lord, how could this lowlife have so many 'peeps/gf's' helping him out along the way before his arrest??? They had to have known MM was acting suspicious and was near the scenes! Grrrrr. Lady Justice is coming for this defendant and he's not going to walk the street a free man ever again IMO.

The Fayetteville Observer reviewed hundreds of pages of search warrants and court orders for insight into how McLellan allegedly kidnapped Hania on Nov. 5 and evaded investigators in the hours and days that followed.

McLellan became a suspect within days of the kidnapping, the records show, and was taken into custody by the night of Nov. 12 on unrelated charges. This was kept secret by authorities during their daily news conferences as the search for Hania continued into the following weeks.

A major break in the case happened at 7:57 a.m. the next morning, Nov. 8, three days after Hania was kidnapped. Someone called 911 to report seeing an SUV hidden among some trees about 40 to 50 yards off Quincey Drive. It was the SUV from the kidnapping.

Seventeen clothing items were found in the SUV, including Hania’s shirt, pants and underwear.

By Nov. 13, McLellan was in jail, eight days after Hania’s kidnapping. Yet he wasn’t held on charges related to the abduction. Instead, he was served the outstanding warrant from the attempted robbery in Fairmont on Oct. 16.

On Nov. 27, late in the afternoon, FBI agents found her unclothed body off Wire Grass Road about five miles outside of Lumberton. She lay face down in more than 4 feet of water. A broken plastic folding table was on top of her.

Publicly, authorities continued to solicit any information that could identify the killer and bring him to justice. Privately, they believed they already had found him.

At 3:28 a.m. on Dec. 8, the FBI announced that McLellan was charged with Hania’s kidnapping, rape and murder — 10 charges in all. He later would be taken to Central Prison in Raleigh to await trial.

One of the Robeson County sheriff's deputies who was forced out of his job because of the Hania Aguilar investigation confirmed to WRAL News on Wednesday that he wrote a social media post in which he denied that he knew anything about DNA linked to the teenager's alleged killer.

Maj. Anthony Thompson and Sgt. Darryl McPhatter were placed on suspension in December, pending the outcome of an internal investigation by the Robeson County Sheriff's Office into possible violations of department policy and procedures.

In January, newly elected Sheriff Burnis Wilkins announced in a written statement that his office had terminated McPhatter from his job and that Thompson had resigned his position in order to take retirement.

The disciplinary action stemmed from the sexual assault of a woman two years ago.

Britt says if action would have been taken in 2016 on the DNA, McLellan would have been in jail and Aguilar would be alive today.

In a Facebook post the day after being fired, McPhatter wrote: "I learned about the DNA hit when District Attorney Johnson Britt went public with it, like everyone else. Anyone who knows me would tell you if I had received the DNA hit the suspect would have been processed and charged."

ROBESON CO. DEPUTY SHARES HIS SIDE: Robeson County detective fired after Hania Aguilar case shares his side on social media
A detective who was fired after the Hania Aguilar murder investigation is taking his frustrations to social media.

Former Robeson County Deputy Darryl McPhatter was fired after an internal investigation found overlooked evidence might have put Michael McLellan behind bars for a 2016 rape.

McPhatter posted on Facebook that the DNA hit from the 2016 case was found in someone else's office and never reached him.

"The administration knows the DNA hit from the 2016 case was located in someone else's office along with other DNA hits from other cases and it was never passed over to me," McPhatter posted.

He said the worst part is that Aguilar's mother and family think he could have prevented her murder.

"I wish I would've received that DNA hit in 2017, that maybe Hania Aguilar would still be with her family," McPhatter wrote.

It's a 30-second video; the preliminary hearing was held but there is still no trial date for Hania's murder case. Hania was kidnapped and driven away from her home in early November, McClellan was charged in December and already in custody for attempted robbery.
