Reviewing the case again today and reminded McLellan was indicted in May 2019, and in early June, the Robeson County District Attorney’s Office announced it would seek the death penalty. They added a second lawyer as DP cases require and I don't think the case has moved since.

*Status Hearing (for kidnapping case) (@ am session ET) – NC – Hania Noelia Aguilar (13) (abducted Nov. 5, 2018, found Nov. 27, 2018, in a shallow pond more than 4 feet deep off Wire Grass Road outside of Lumberton) - *Michael Ray McLellan (34) indicted (12/3/18), arrested (11/13/18), charged (5/14/19) & indicted (additional charges 5/17/19) with 1st degree murder, 1st degree forcible rape & statutory rape of a person under 15, 1st degree sexual offense & statutory sex offense with a person under 15, 1st degree kidnapping, felony larceny, felony restraint, abduction of a child & concealment of a death. Held without bond. DA will seek DP.

7/23/19 Update: Status hearing on kidnapping, Hania & rape case. Hearing on Hania’s case on 9/5. Kidnapping case on 10/8. Rape case on 9/9/19. Defense filed motion for speedy trial in August. 9/5/19: Hania’s case: Next hearing on 12/9. 12/9/19: Next hearing in am session on 1/6/20. No update as of 2/17.
*Charged (12/10/18) & indicted (1/7/19) with 1st degree rape & 1st degree burglary. $5M bond. Revoked (12/10/18).

9/9/19 Update: Hearing on 2016 rape/burglary case. Next hearing on 10/7. 10/7/19: McLellan has been appointed a second attorney. Case will not be heard today. His attorneys have been given cases files to prepare his defense. 10/7/19: Next hearing in am session on 1/6/20. No update as of 2/17.
*Charged (10/15/18) & arrested (11/13/18) with 2nd degree kidnapping, possession of a firearm by felony & attempted robbery with dangerous weapon. (10/15/18 kidnapping case in Fairmont). $2.5M bond.

Okay, next hearing on 6/30/20 -- but no mention of TRIAL, and Courtroom 0002A was not listed for action today, same as last time we checked.
But a DP case does take more hearings, and the suspect must have a DP-qualified attorney, as does the Prosecutor's office.
Grrrrr.
So we wait...
 
@borndem - on 6/30 is that a status hearing or ?? and is it an AM session?

wait... I have hi 2018 kidnapping on 6/30 - is this for Hania & the 2016 rape case also??
 
This is what I found -- no details are given other than what you see here. And please notice that the action is in District Court, so it won't be a trial, since trials are handled in Superior Court. It may just be about Death Penalty and needing more prep time, or a discovery problem, scheduling, or whatever. We're moving at a snail's pace here. SMH. So we wait... :mad:

These things take long enough as it is, nature of the beast if you want a fair system, but still. I can only imagine court proceedings taking even longer now with covid and how frustrating that must be for the families, to have to wait so long to get justice for their children. Hania's murderer will get what's coming, it just sucks that it has to take so long.
