Many states, including my state of FL, require a grand jury indictment for 1st degree murder cases.

In NC, indictment may not be waived in a capital case:

Thank you for the information. It is continually surprising to me how various states differ. I know of grand juries and what they do but rarely see one or hear of one in the states I reside in, it is pretty uncommon, to my knowledge anyhow.

So in your state they dont have grand juries? If so, that is unusual. I dont think I've ever known a state who does not have GJs.

GJs have two purposes in most all states. One is to hear evidence that will decide if the cases are true billed for indictment or no billed saying more evidence is warranted for an indictment.

Our grand jurors serve for 6 months at a time. They can be recalled during that time to hear other new cases. My hubby just served on a GJ last year.

The second purpose they can be used for as an investigative tool. GJs can listen to a pending possible case, and can subpoena any other witnesses they feel are necessary to be called.

As has been posted many states require a GJ indictment when seeking the top charge of first degree murder.

The DA can arrest, and charge the murderer with 2nd degree at the time, but in many states it requires a GJ to indict at the top level of severity of first degree murder which this case most certainly is.

I'm so sick of seeing wonderful parents being murdered in cold blood by their own children. The same child or children they sacrificed so much for....

Unfortunately we see so many good caring people being wiped out by pure evil nowadays, whether it was done by someone they loved dearly or others they had tried their very best to help in any way they good. Or total strangers targeting kind, and caring people to murder.

It's all so unbelievably sad for all of us when its the good who is murdered, and the evil ones remain.

I have to say I know what they are, learned about them in school, have heard of an GJ indictment on the news, etc., know it is very common with federal charges, that they can be secret, etc. but in the states I am familiar with rarely do I hear of it done that way, in fact I would almost say never, and know of no one who has served on a GJ nor have I ever been called to serve on one. Things are decided by district attorney offices on whether there is enough to take to trial or not.

I know questions can be asked and information gathered and such. I cannot say they never occur but not in certain parts of the state I can guarantee that. For federal charges I know they are used. I am talking about county/state charges. From what I see they seem to be pretty common in the south.

Adding: Since I was curious I just looked it up and states are not required to use them at all, which perhaps explains it. That is per our fed government justice site. I did just a quick look, the federal government is required to use a GJ.

They are very unusual in the areas I have lived in to my knowledge. As I said, I do not know a person who has been on one and I know a lot of people :)

Interesting that it does vary by state. I will have to look further into it when I have time.

ETA: I just read that about 1/2 of states use them for state charges. I am used to preliminary hearings which is what replaces the GJ. Interesting, I am always learning something :)

Hey! super late reply but Tristan actually went to Watauga High School (at least for his senior year when the crime occurred) also, the autopsy report has been released so I'm going to link our paper's local newspaper article with the details from the autopsy

And there are seven other children....
I know, to my knowledge he had at least one younger brother that lived in the home with him too so I don't know what's happened to him if that's true :( we were all shocked when the news began to break about what happened, We haven't seen anything even remotely close to this up here since the 70s, and even then this still feels like something else altogether... so little motive is clear to me even with the additional things I've heard from living in this town, I wish there were more answers behind what might have caused this

And why would this girl get involved?

I don't believe in that 'just snapped' theory. It minimises the crime and makes it sound like it could happen to anyone.
