I knew as soon as the issues with the SBI came out that this was bound to happen. And as guilty as I think Peterson is, the judge made the right decision to give him a new trial.

IDK, there was much questionable evidence even without Deaver. It'll be tough, I'm sure, but I'm not quite as pessimistic as you, joe. I'll sit back and watch for awhile.

the owl theory in my opinion is beyond laughable, as was the blowpoke as the state alleged the murder weapon,

and this time round the state will not have very much evidence toi go on as much of the physical evidence collected from the murder scene has been tossed due to an apellate court ruling about one of the search warrants

I expect M Peterson may have served any sentence he will ever serve for the murders of 2 women

quite simple, he beat her to death, with what I don't know, I have thought that he may have bashed her head against the stair or the wall as well as used some thing as a weapon,but that's just a theory

to me it was just another domestic murder where one spouse kills another over money, jealousy, not happy in the marriage or the many other reasons that people murder over,

I just can't square all that blood up the walls with a simple fall down the stairs, or with the idea that an owl attacked her and left one feather as its calling card,

then add in his presence at a similar event where Elizabeth Ratcliff was found also supposedly having fell down the stairs and the common denominator to both events was MP,

but he will now be a free man, and maybe there will be a new trial, the judges comments to me were very telling when he appeared to be asking the DA if she really felt there was a case to now answer

we shall see what happens, but for now MP is soon to be a free man and is innocent in the eyes of the law
 
ITA that the owl theory seems unplausible. I read the book, watched the tv movie and followed the trial on court tv but I do not recall anything regarding a feather. The article below mentions a feather found at the scene. Where was the feather found? An owl attack outside does not explain all the blood on the bottom of the adjacent walls at the staircase. I did not keep up with the apellate court rulings, what evidence was tossed? :seeya:

he was convicted of the murder of his wife, but the states witness Deaver fabricated evidence, lied under oath, did experiments he either wasn't qualified to do or ones without any scientific rigour and then testified about them, he therefore has had his conviction rightly overturned in my opinion

he was never charged with any other crime to be convicted of, it was only as similar fact evidence that the Ratcliff murder was entered into evidence at trial

This is the theory. Explains blood in stairwell as being due to her tripping or fainting and hitting her head after slipping in her own blood. She bled to death but would have lived if she had gotten help in time. The same thing happened to my brother (not due to an owl attack, but a fall and forehead laceration and fainting before he could summon help).

Not only was the feather in black ink on the white sheet of the lab report, but it was actually found by the NC Medical Examiner who performed the autopsy. A feather was clutched inside Kathleen Peterson’s left hand, along with her own hair.
That feather was the last thing that she grasped before dying and that she preserved beyond her death.
Had that feather been a hair, either Michael Peterson’s one or a hair of an unknown person, no doubt it would have been mentioned at the trial, as important evidence.

9) Remaining evidence
The towels that Michael Peterson put under his wife’s head after he found her at the bottom of the staircase were not collected by the police. How many microscopic feathers might they have contained?


I am not a proponent of this theory but believe people should read it.

It will be interesting to see if the Elizabeth Ratliff evidence will be allowed in the second time around. I believe Peterson killed his wife, but in the interests of justice for all of us (especially when one of us may be falsely accused), it's best that he receive a new trial. Hopefully, the state will be able to prevail again. If not, I say we lock Deaver in a room with a crazy owl.
 
Words truly fail me at this time. I remember so clearly watching his trial on CTV and thinking how unlikely it is for 2 partners to die falling down the stairs. IIRC, didn't the daughters he took in from his first partner support him? The only other case I can compare this case to is the D. Peterson case and his ex spouses

I will try to reserve judgement until his new trial...but my hinky meter is way up. BTW , how many owl's have attacked since this incident.?

I do agree with the Judge though that he should get a retrial, but still think him guilty, I expect he will become the new media darling, he did enjoy the attention first time round in my opinion even allowing a camera crew to follow him around as he and his attys prepared for trial

I will never understand how he could live in his house with kathleens blood all over the stairs and walls,

So sorry for Kathleens daughter...have to go through this again. No doubt in my mind that he'll be convicted again. And, the the 2 daughters of the woman he murdered years ago....there to meet him with open arms?? What a slap to the memory of their mom.

Again, feel odd doing this as I am not pushing the theory but the links I provided in previous posts reference info about the suppositions, supporting evidence and an account of other owl attacks on humans. Also I thought the woman in Germany who died in the staircase was his friend and neighbor, not his partner/wife. He and his wives raised her daughters.

I was just watching a crime tv show this past week about the Michael Peterson murder trial. Kathleen's daughter must be outraged at him getting out of jail!! And what happens to the insurance money that must have been paid out to Kathleen's daughter, if (heaven forbid) he is found not guilty at a second trial? I hope they press charges for the first woman. So sad.
 
I believe he is guilty as sin but I also believe that under the circumstances the case should be retried. When someone lies about important issues in court, the verdict should be overturned...IMO even when it is a not guilty verdict.
