Has any word come out on when they estimate the autopsy will be over or when they expect to have the press conference?

(CNN) -- Authorities in North Carolina said Wednesday that they will need to determine where the killing of a 5-year-old girl occurred before additional charges are filed in the case.

The body of Shaniya Davis, who was reported missing in Fayetteville last week, was found Monday beside a road near Sanford, which is about 30 miles northwest of Fayetteville, police said.

The girl's mother, Antoinette Nicole Davis, has been charged with human trafficking and other offenses, and another suspect, Mario Andrette McNeill, has been charged with kidnapping in the case.

A Tuesday statement from the Fayetteville police says that jurisdiction is "governed by where the criminal conduct occurred. Right now, this is an ongoing investigation and as such we are still determining the details surrounding the death of the child."

If Davis and McNeill sold her to someone who murdered her, they would also be charged with murder, right?
I sure do hope so! I'm wondering if McNeill is the one who actually paid money to AD... he has money from somewhere... he paid for the hotel room and also retained his own private attorney as opposed to having a PD. What a lowlife...

Several of the details regarding the investigation have a direct impact on which county will assume jurisdiction and prosecute this case," Bergamine told reporters at a news conference.

"The district attorneys from the involved jurisdictions are discussing the matter and ultimately will make that decision," he said.

Fayetteville is in Cumberland County, while Sanford is in Lee County. The district attorneys from those counties did not immediately return phone calls seeking comment Wednesday

So Allen feels he has no blame. He should have reported this to DSS himself. Aren't we all responsible for reporting suspected abuse?

We don't know if abuse was reported. Maybe it was.

I figured that was going to happend Nursie! The crime began in one county, the body of Shaniya was found in another and then you have felony kidnapping...not sure what they are going to do with those felonies....I hope the two counties work together and not spat over jurisdiction..KWIM?

I'm off to take one of the kids to doc's, they aren't sick just eczema outbreak...take care all!
 
1) at the time the household was raided for drugs (it was NOT the trailer they currently reside in - it was a previous residence) Shaniya was not present. She was sent there on a VISIT. Custody was not turned over to mom, dad did not agree to let her reside there it was a VISIT. So authorities may not even have known of Shaniya's existence as a minor child of momster at the time of the drug raid, why would they? DCF would have no reason to check on the welfare of little Shaniya as she did not live there.

His family/friends have stated that Brad was going to let Shaniya *live* with AD, not just visit. They tried to stop him, saying Shaniya could live with them. Cigarette burns from visits with AD, etc. He had to have an inkling if everyone else did. JHMO.

Tim Allen has been caring for Lockhart's 17-year-old daughter, Cheyenne. He said Tuesday evening that he told Lockhart not to send Shaniya to live with her mother.

"I feel he is 99 percent the reason why this happened in the first place,” Allen said of Shaniya’s death.

To me, that means it was planned in advance, not just a spur-of-the-moment change of heart.

If monster handed Shaniya over to McNeill then how can they charge him with kidnapping? How do you kidnap child that was willingly handed to you by the bio mother? Not that I think this scum should by any means get off for whatever part he played in WHATEVER wrongs were done Shaniya, but is that really the right charge for this situation? Can't they come up with better, more suitable charges like oh, I dunno, murder?


He probably paid for sofa time....he removed her from the home without permission.
 
mysticrose, I just do not understand this. Actually; we do not know where Caylee was killed and yet Casey was charged even without a body. The SA cannot say with 100% certainty that Caylee was killed in Orange County, Florida.

I think this might be coming down to the SA's (or DA's whichever it is called in N. C.) ego of who wants the case in their respective counties.

You're most welcome. Here's another interesting tidbit discovered by member Everyoneneedsavoice the other night. (I don't remember the thread number, but it was posted rather late Saturday night.) Voting registration records (thru the DMV, I'm pretty sure) show that in April 2008, MAM, AA (MAM's current gf who attended his arraignment), and BD resided at the same address.

I don't think they all lived there at the same time. It's been reported the MAM is the ex-BF of BD. My guess is the BD lived there with MAM then when they broke up she moved out, and AA moved in. :twocents:

There was an amber alert placed regarding SD's disappearance so therefore even though the mother was lying during the 911 call, police still were dispatched to look for the child, and someone had taken the child..... and as time went on, MAM was charged with kidnapping. Also, considering what had happened to Shaniya in the hotel.... it IS kidnapping regardless of whether her mother gave him consent to take her.

I think in some states kidnapping can carry a life time. Not sure about NC. He deserves the death penalty IMO for what he did.
 
i will in no way bash the father or aunt. This needs to be a lesson to all of us, Mothers, fathers, grandparents, aunts, uncles, neighbors, teachers, etc. If we feel something is not right, we need to step up to the plate. As to why the neighbors did not (maybe they did) report the abuse - many are guilty of not reporting because we feel that the children are better off with their parents. We try to deal with the parents to make things better. We think we are doing all we can to change the situation for the children. We need to re-evaluate our own actions, are we doing enough, I know that I have failed because I do not trust the system. If you report unclean living conditions the children may be taken from the home and other family members and end up in a place just as bad. I did not report an unbelievable dirty home, I did take action but the home returned to the same condition, I did not report and if I had they would not have done anything when the Mother brought a man into the home that she only had one date with. This sweet child's death has made a difference to one person-me-- I will make sure things are different in the future for two sweet little girls. This is so sad that Shaniya did not have to die- NO ONE in her life ever dreamed this would happen but many knew the sperm donor was not where Shaniya needed to be but still it happened.

Question....how far from the ..gulp...hotel is the dump site ??? I think it's less than 7 miles...right? IMO she was killed somewhere along the way. What jurisdiction would that be?

Leona Cromartie, Antoinette Davis' aunt, said Sunday she believes the accusations against her niece are false and that McNeill is talking to police in an effort to get a plea bargain in court.

I know this is just someone's guess, regarding a possible plea bargain. If in fact the state accepts a plea bargain, I will personally drive to NC with my kids in tow and protest. That's disgusting. I want to see the death penalty. :furious:
