GUILTY NC - Tim Hennis on trial in the '85 Eastburn murders, Fort Bragg

March 22, 1989, Wilmington Morning Star, section 2C, there is an article covering trial events . Captain Eastburn's testimony is covered. At bottom of article Defense Atty Beaver (out of the presence of jury) made comment about two steak knives found buried next door to Cone's home. Beaver was trying to cast doubt about Cone. Tried to attach article but did not succeed.

Yes a knife was found on the way to cone's house, but the knife was never linked to cone or the murders

Well that takes care of one of my questions.

Tim Hennis had his military appeal hearing this week

Great arguments in Hennis hearing from defense but very difficult to overturn any conviction.

This is an absolutely horrendous case, just dreadful. I think Hennis has been railroaded, and that he knows he never had any consensual sex with Katie Eastburn. There had to have been contamination and fabrication of the DNA sample.

It is simply not possible that he could have engaged in a clean up of such a slaughter, and left no trace of himself there or even the tiniest speck of blood in his car or on his shoes.

He did not burn his clothes, as no zippers or buttons were found in the ashes.

The timing of using the bank card doesn't pan out.

No one would be his accomplice in such a massive crime scene; there would be nothing in it for them. And yet a seasoned investigator said evidence pointed to multiple persons.

It was said that because there was no forced entry, Katie must have known the killer and let him in. I think rather that as she was still folding clothes she had not locked the house up yet: the killer simply walked through the front or back door and surprised her.

The threatening calls in the prior months, the shady babysitter with her dangerous position as drug informant, and her Jeffrey MacDonald obsession, together with the criminally inclined Patrick, hold the key.

Addendum : I also think it's possible that Patrick saw Hennis and his Chevette the night he went to pick up the dog, and decided to frame him.

Also, the lab where th DNA was processed has been cited for falsification .

Sundrop, did anyone test Patrick Cone's DNA or hair? I'm thinking they didn't. It bothers me that the strange calls said, "I live around the corner, and I'm coming to see you". Patrick was walking to his sister's house that evening, which was around the corner. He also used a stolen ATM card at the same machine as the Eastburn card was used. However, I would think the head hair would have been shown to be African American in that case, and he would also have scratches. Or were there 2 people and he was part of it? Why was he so eager to point the finger at someone else??
I have all these same questions. I am very suspicious of Patrick Cone. He is a proven liar and thief. When he told police that when he saw Hennis leaving the driveway, remarking, "I'm getting an early start" - as if to explain why he was leaving a house at that ungodly hour - I believe Cone was putting into the mouth of Hennis his own words, probably used in the past when he had been spotted leaving a break and entry scene.

I do believe Cone saw Hennis and his Chevette the night he picked up the dog, and knowing by word of mouth that the Eastburn home was without a man, decided to do the break in with an accomplice, and frame Hennis for it. I actually read an Ann Rule true crime short story where someone did very similar.

Great question. Cone was drunk that night, it was about 3 am. He saw the 19 year old walker guy not Hennis. DNA analysis didn't exist in 1985.

Do you think the truth will ever come to light in the federal courts for Hennis? I would not have any problem believing the DNA and believing him guilty, if only they had found even a trace of blood in his car or on his shoes. It's this last thing , together with the babysitter drug connections, Cone, threatening calls, etc. , that make it seem impossible that he's guilty. Do you feel there's any chance he could be guilty? Am I missing something? Thanks!

I worked the case for 2 years for the defense. He's innocent. We are waiting on the military appeals court to make their decision

I have, yes. And I own the book as well. I believe none of it has been negated.

My biggest fear is that now theDNA cannot be gotten around, and it is surely false. How long does Hennis have until he can move to the civilian federal courts?

Has he been in army detention for a decade now? Where is his wife? Is she still supportive?

A lot of issues with Tim's 2010 military trial

Glad to see you are still covering this case. I was juror on second trial with not guilty verdict. I was interviewed for Innocent Victims book. I'm always looking for any updates. Thanks for posting.

Fascinating! What is your feeling about him now? I would have no trouble believing he was guilty IF the evidence fit, but it doesn't. They say the DNA does, but is Whisnant's book it said clearly that the semen sample was NOT preserved. Ergo, fabricated or contaminated, and this lab had these issues in the past. It was an horrific crime, but I feel it was more than one person, and likely related to Cone or the babysitter's drug connections. Hennis is being railroaded. Again.
