If anyone in Australia is interested in this case, Death Row Stories on Gem (Channel 90) has just started (20:30 AEST).

Program description: 'Evidence emerges causing many to question the guilt of Army Sergeant Tim Hennis who is sentenced to death for the murder of the wife and two children [Kathryn, Kara and Erin] of an Air Force captain [Gary Eastburn]; a bizarre and unprecedented journey through the American justice system.'

I'll post a link for streaming when it shows up on ninemsn.
I missed this. Is this new evidence since his third trial or a rerun showing why he received a retrial after the very first trial when he was on death row the first time?

Was it mentioned what the new evidence is?

I know because I worked on Hennis defense but can't say, the investigation of this case was completely screwed up

After reading this information I agree, the investigation was totally flawed.

The jury who found Hennis "not guilty" were very frustrated that they did not get to hear the babysitter's testimony. As soon as she was sworn in, objection was made and after a chat with the judge the jury was sent to the jury room for hours. After being summoned to the courtroom, the jury never saw her again.

The size 9 shoe prints were also discussed and no one thought that Hennis could have made them. His shoe size was way larger.

John the walker was at the 2010 trial but never called and babysitter was too but never called

While sitting in the jury room during many times the jury was removed from the courtroom, we noticed, through a window, detectives taking "the walker" out of an obvious LE car, in handcuffs. Most of the jurors gasped in surprise because this man looked like Hennis. At the time the jurors did not know he was involved with the trial. I can tell you that he caused quite the impact when he was brought into the courtroom.

John is who I believe Cone saw that night. Why was he wearing cuffs

hennis court martial lawyer made a massive mistake. the key to this case is supposedly the DNA matches now when the blood type was different 30 years ago. that and throwing out the conesual sex thing was ridiulous imo.

i dont think hennis did it. i think the crime lab botched (either accidentally or intentionally) the new DNA testiing cause the sample they supposedly matched to hennis WAS NOT what they had in 1985.

blood type/DNA does NOT change in 30 years. thats just ridiculous.

I totally agree with you

The jurors weren't suppose to have seen him from the window; that is when he was seen being taken out of back of car with cuffs on. He wasn't in cuffs in the courtroom.

Are you saying John the walker was in cuffs, makes no sense because he was a student at Appalachian State University

I saw him with my own eyes along with the rest of the jurors in the juror room.

I believe you, but why the cuffs?

We wondered the same thing, we were also shocked just how much he resembled Hennis. The detective for defense is the one who let him out of the backseat and escorted him into the building. At that point the jury wasn't allowed to discuss the case yet. Very difficult

This is what I was told by one of Tim's defense lawyers from that trial

He was being watched closely - guarded even - by defense team that feared he would run
