I'm absolutely convinced now the treatment of the children was purely practical - five-year-old killed because he could talk and identify, baby just dumped because there was no need to go to the trouble of killing him.

Heaven only knows why mom was killed.

I'm not so sure the reason little Josue was tossed in the river was because he could talk. The murderer turned himself in quickly - it's not like he was hiding his own involvement at all.

I think the reason the 5yo was killed was out of pure rage against the mother or because the girlfriend didn't like the boys and didn't want to end up taking care of them. Sorry - it hurts to write that.

I think he threw Josue in partly out of necessity to eliminate a witness and partly out of pent up anger and jealousy. There were other ways he could have gotten his mom alone if he was going to murder her, but he knew the kids would be with her when he invited her over and he knew Josue was old enough to talk. I am assuming he just didn't care and he had his mind made up she was going to be killed and he would deal with whatever collateral damage he had to. There isn't a hell bad enough for people like this.

I agree with you. I think Martinez threw the 5 year old in the river because he knew he couldn't swim and Martinez is just a cruel SOB. It had nothing to do with him being identified. That's just the excuse he provided when questioned.

If he eventually gets the death penalty, you can bet that throwing that little boy in the water alive is going to be the biggest reason.

Perhaps little Josue was combative and causing a ruckus after his mom was killed,,, hysterical, yelling, etc. ** speculative**
 
Can Martinez enter a guilty plea and go to jail for life, no parole?

I think the community would be better off not having to go through a trial. I just cannot imagine how many more lives a trial will destroy.

I think Angel is old enough that he will remember at least parts of what happened. I'm glad he has a large family that loves him so much.

he can, in theory, but the prosecutor is under obligation to accept his plea and can continue to pursue the death penalty in trial if they wish.....

as a matter of fact james holmes, the theater shooter that killed 12 and injured 70 in colorado during the batman movie did just that.....it was refused and they are in trial right now pursuing the death penalty

eta........in the mean time, he has changed his plea to guilty by reason of insanity since his offer was refused.......
 
I hope the girlfriend's children are too young to remember (if they witnessed any of this). Were they at the apartment when it took place? I hope not :(
 
According to statements by Ismenia's niece made during the Family News Conference, Josue's 5th birthday is later this month. So I guess the murders did not occur on his birthday.
 
My heart aches for that father. Having children of similar ages I cannot imagine what he feels. And while the miracle of Angel being spared is amazing, I would bet that dad feels like he can hardly go on right now. This case has moved me to tears. I hope that family is lifted up by all the light being sent to them. I will be thinking of them for many days to come.

I honestly don't think he was trying to save the little one. Being in a dumpster would be a death sentence for an 11 month old if he was out in the elements or if the dumpster was emptied, as they use compactors in many area's. He's a beast! IMO

And his "discarding" of Angel in the dumpster certainly shows, IMO, his total disregard & prolly loathing and disdain of that little child -- IMO -- he, in the dumping, is declaring his little brother trash, garbage, something of no value to anyone. IMO. SMH. It's very hard to understand -- and I don't understand it, and I think I'm glad I don't. Oh, my.

The family said Roberto wasn't always the man you see now in his mug shot. Before he moved from El Salvador, the family recounts a time when his grandmother would call him her "best grandkid." He was one of more than 25 children in the family, but he stood out. He would cook his mother dinner without being asked, and offer to do things around the family home.

Eight or nine years ago he met his current girlfriend Gabriela Guevara. The family told WOWT 6 News that she spurred something inside of him.

"He was really good, man," said one of his uncles. "When he started a relationship with her everything changed."

Eventually the family plans to tell Angel about his mother and brother, but for now they can only raise him and hope that he can have a good life without his mother.

The idea of raising Angel without a brother is a difficult one for everyone in the family. His cousin said they say Josue's name and Angel turns as if to look for his brother, not knowing he'll never see him the same way again.

The part about Angel looking for Josue really saddened me. Having boys and seeing how a little brother idolizes a big really hit home. I could imagine my own children and it really hurt. What a classy family to say what they did. Angel will be well cared for no doubt but that hole will always remain. This tragedy just weighs on my heart for this family.

Also Gabriela is denying any involvement and yelled that out in court. Not sure if that link was posted. But she disgusts me. She is just like the arrogant piece of work I had assumed. I pray the justice system works.

The family said they were planning to bury Josue and his mother together. Wow, does that bring tears to your eyes or what? This is all such a tragedy. I'm glad there is a loving family who can hold on to each other and share the faith that binds them. Sometimes it's all one has through these ruff times, and without it, there is nothing at all.

Dammit, this stuff makes me so sad and then so angry.
