9/5/19 Update: Boswell, which was set to begin next month in Wilber, Nebraska, has been moved 173 miles west to Lexington and now will start on March 16. The argument for the trial move, which District Judge Vicky Johnson approved on Friday, was that the publicity of the case would prevent potential jurors to “fairly serve.” Next hearing on 10/28.
10/28/19 Update: No hearing was scheduled. Next motions hearing on 1/16/20. 1/3/20: Boswell faces 3 charges including first-degree murder in the 2017 death of Sydney. A charge of "criminal conspiracy to commit first-degree murder" was dismissed after a judge determined prosecutors were not specific on certain acts on that count. The charge can be re-instated with the additions by January 10th. Her trial is set to begin March 16th in Douglas County.
1/16/20 Update: Motions hearing moved to 1/17/20 @ 9am.
*Aubrey C. Trail (51) – Found guilty of all charges 7/8/19. A 3-judge panel will hear penalty phase. Motions hearing for new trial on 9/11, but was cancelled. 11/15/19: Judge denies Trail’s death penalty challenge. Judge has yet to rule on new trial motion. Can someone give a 10% synopsis on this following article?

If you have business at the courthouse in March, consider getting it done early

and if there is the next court date in there? On the court site it shows no results.

Basically they are stating that due to the trial, there will be extra security and parking around the courthouse will be hard to find so if possible people should try to get things done before the trial starts. It also states the clerk of district court office will be open and people will be able to access it but there will be additional scrutiny when the trial is happening.

Here is all it says about the trial...

"In 2019 the decision was made to move the trial of Boswell from Wilber to Lexington. Boswell, 25, is charged with the first degree slaying and dismemberment of Sydney Loofe.

...

The trial will begin in March 16.

...

The trial is expected to last around a month."

Trial started 6/17/19 with jury selection. Trial started on 6/18/19 & runs thru 7/8/19. Jurors: 7 women & 5 men, with 3 women alternates. One juror was excused for family emergency on 6/28/19 (no gender available). Jurors could be 8 women & 4 men. Now 2 women alternates. Jurors deliberating for about 2 ½ hours & found Trail GUILTY of all charges.

11/1/19 Update: A District Court Judge on Friday denied a motion filed by Aubrey Trail’s attorney to find Nebraska’s death penalty unconstitutional. The court has yet to make a ruling on another motion filed by Trail in September to grant him a new trial. Next motions hearing on 12/4.
12/4/19 Update: Saline County District Judge Vicky Johnson granted the State’s motion to submit depositions from the county sheriff & jailers under seal rather than through live testimony due to Guinan’s concerns about making the method public. Johnson must rule on the defense motion for a new trial before Trail’s case would move on to the three-judge panel that would weigh evidence about aggravating & mitigating circumstances to determine if Trail should get a death sentence. The judge has taken the matter under advisement, and a hearing to go over evidence and depositions is tentatively set for Dec. 31. According to Trail’s defense team, it is unlikely any death penalty hearings move forward until the request for a new trial has been resolved. 12/31/19: Saline County District Judge Vicky Johnson denied Trail’s motion for a new trial.
1/3/20 Update: A three-judge sentencing panel has been assigned to hear the death penalty case for convicted murderer Trail. The Nebraska Judicial Branch announced Friday Judge Vicky Johnson, the same judge that heard Trail's murder trial, will be the presiding judge on the panel. Judges Julie D. Smith & Michael A. Smith, who were randomly selected, will also serve on the panel to determine if Trail gets the death penalty.

WILBER, Neb. — Discussions about killing someone to join a coven of witches, or producing a “snuff film” of torture and murder to make money, returned to a courtroom in Saline County on Thursday.

Judge appointed to Aubrey Trail's three-judge death sentence panel hears arguments on her recusal

WILBER — A day after Sen. Ernie Chambers claimed the “fix is in” for Aubrey Trail to get a death sentence for killing a 24-year-old Lincoln woman, the judge at the heart of the criticism took up a defense motion asking her to recuse herself from the panel that will decide if he gets life or death.

Trail’s attorney, Joe Murray, made a subtle reference to the criticism made on the floor of the Legislature during arguments, telling Johnson County District Judge Julie Smith, “the appearance of impropriety is all over your appointment.”

He said he understood that all judges had prior work histories, but given that hers was so recent and so specific to the death penalty, he was asking her to step down.

Smith had started the hearing by saying that one of her job duties at the Nebraska Department of Correctional Services was to work on the protocol, then added, “I’ve never politically advocated for or against the death penalty.”



Can't really tell if she will recuse herself or not. Maybe someone can go to the link - as I put this into Outline - and sometimes they leave stuff out of the original article - at least that's what it appears to me.

LINCOLN, Neb. (AP) — A district judge who helped draft Nebraska’s controversial lethal injection protocol when she worked as a prison system lawyer has agreed to recuse herself from the state’s most recent death penalty case.

Johnson County District Judge Julie Smith was one of three judges appointed to serve on a panel that will decide in June whether Aubrey Trail should be put to death by lethal injection or sentenced to life in prison. She announced her decision to remove herself from the panel in a six-page order filed last week, citing a possible “appearance of impropriety.”

Lancaster County District Judge Susan Strong has been appointed to replace Smith on the panel, the Lincoln Journal Star reported.

OMAHA, Neb. (KTIV) -- A judge has ruled some evidence-- specifically Bailey Boswell's relationships with other women, and grooming them to engage in a conspiracy to commit murder-- will be relevant in her trial for killing a northeast Nebraska woman.

LINCOLN — A medical emergency in a judge’s family has led to a postponement of the trial of Bailey Boswell, who is charged in the slaying and dismemberment of Lincoln store clerk Sydney Loofe.

Boswell’s trial had been set to begin on March 16 in Lexington, where the proceeding was moved because of pretrial publicity related to the trial last summer of Boswell’s boyfriend and co-defendant, Aubrey Trail.

But Saline County District Judge Vicky Johnson issued an order Tuesday postponing the trial until further notice because of a serious medical emergency in her family.
