The more I think about the Ramos/Barth side show, the less funny it becomes.

It was the States fault for putting him on, but I really don't think they foresaw the judge allowing the questions that he did.

Barth knew what buttons to push, and IMO made a circus out a murder trial for a innocent young girl. Disgusting and outrageous.

I feel for Lizzi's family. Must've been a tough day.

I understand why some of you like Barth. I liked him when he was tearing into Kat and her testilying. BUT now I'm scared that Seth is gonna walk and I hope Barth's defense crashes and burns. Lizzie's parents deserve justice for their baby girl, who's body cannot be laid to rest because of the SM and KM. I am so scared that the prosecution's case isn't gonna put this monster where he belongs... prison for LIFE.

not even close. just looking for the truth between all the lies and inconsistency. I firmly believe both should be put away for life based on what I've heard so far. JMO.

I totally agree.

But hey when youre married to the chief justice, you can probably take liberties that other lawyers couldnt get away with. IMO

I'm not sure about murder1 anymore, but I still think murder 2 is very likely.

There are 2 alternate theories for Murder 1 - premeditated, and felony murder. If he was committing rape and caused her death, then thats still Murder 1

Do you think that KM's story about raping LM AFTER the murder is her twisted way of "protecting" SM by getting his murder charge reduced to M2, even if her body did turn up before the trial and they found his DNA on LM?

Well, I thought it was amusing mostly because he kept mouthing off to Barth and the whole way he described SM made SM sound even more absurd, if that is even possible. I know I'm probably not typical, but if I were on the jury, I'd be all like, "yeah yeah, he's horrible, he's in jail, they all are, fishcakes, move on, like let's hear more about this nutso map." His story was consistent enough with KM's and RG's and PH's, that it wouldn't have introduced any doubt as to SM's guilt in my mind. It was just another twisted version of the same old story that starts and ends with SM.

I'm just not sure the state can prove rape cause the only proof I know of is from an admitted liar, KM. Everyone else has testified that it was BDSM gone wrong IIRC. I hope they can prove it but so far IMO they haven't and that scares the chit outta me. We all know SM admitted what happened but because he wasn't properly Mirandized the jury wont know that. It's scary to think he may walk. :scared: :scared: :scared:

I don't know... you don't think the whole, "here, take my money you drug addict so I can blast my way out of jail with guns and bombs before I even go on trial and captain a boat with my fair lady to the Isle of Australia, just a mere 10,578 miles by boat," doesn't make him seem both nuts enough to have committed the murder just as KM said and certain enough of his guilt to want to flee the country, and be willing to kill people on the way out? I mean, I would be struggling to find reasonable doubt over a death that everyone admits happened one way or another, with a girl who was very unlikely to have consented to the sexual encounter that supposedly "went wrong". If there was no consent, then there was murder. I can't see anyone thinking there was consent.
 
All this cheering for the defense looks to me like hoping for an acquittal.

It is just rare to appreciate a Defense attorneys work (as least here on WS).
I think if you took Kat out of the equation we would not be so keen on Barth.
But listening to her for days on end and KNOWING it was a sack of...*lies* made some want to see Barth bust her out.
It continues on because the more he knocks down other witness', the more Kats story is broken.
There are not going to be any winners here. BOTH should be in jail for life, I am sure that is the majority opinion here. Sadly, that is not going to happen.

ETA- Only one will be going. I think SM will be convicted. I know how a jury SHOULD weigh it all, but I think they already have him going away for a long time... JMO!

I am rewatching Chris Ramos again...this is simply the most unbelievable testimony on cross I have ever seen or probably ever will. First it is so funny...the guy is so funny...but from a serious perspective how did the judge let that go on like that? I don't understand this judge. Jury should never have seen that display. No defendant should have the right to talk to an attorney that way.

(technically, Ramos wasn't on trial and wasn't the defendant... but...). I agree that this judge allows a lot more free-form, almost stream-of-consciousness responses than I think I've ever seen. I haven't watched a huge number of trials from beginning to end, but they usually just seem so much more under control and business-like, and sane. The judge also allows Barth to keep asking the same questions of the witnesses over and over again, and almost lets Barth testify instead of even asking them questions. I mean, I know it's not The Practice or The Good Wife, but I keep expecting the prosecution to say, "objection! asked and answered! counsel is badgering the witness!" and the defense to look imploringly at the judge who will say, "Please limit your responses to answering the question you have been asked."

Agree...and it's striking how many of the witnesses come up with some version of SM saying or recalling that he said, "I went too far," "I lost control," "I just blanked out," not, "I was having a grand ole' time having my BDSM three-some and suddenly she died and isn't it just God-awful and horrifying????"

I really hope you are right. I'm usually pretty tolerant of the "quirkies" as one of my friends calls them, even though I find them sort of tedious and self-indulgent at times. This has made me look at a lot of the eccentrics I know and think, "gee, maybe they aren't as harmless as they seem."
 
If Kat's statement to the defense is actually what did happen, what do you think Seth should be convicted of?

Is there anything other than murder 1? Premeditation doesn't have to mean he knew he was going to kill her all day, even if the murder didn't happen during the commission of a rape (but rather the rape came second). Premeditation means there was some forethought. The gloves and rope were forethought enough, IMO, at least in some states. I hope that's true in NH.
