Adam Montgomery appeals convictions in stolen weapons trial, asks for sentence review.​

The appeal was filed under Rule 7, which means it's mandatory for the New Hampshire Supreme Court to take up, according to legal experts. Bigger states have intermediary appellate courts, but because New Hampshire is small, this is the only option for appeal.

The appeal is asking the New Hampshire Supreme Court to take four specific questions under consideration:
  • Should Kayla Montgomery be allowed to testify at all in the case?
  • Should rumors about stolen guns be permitted as evidence?
  • Should portions of video of Adam Montgomery at an ATM be admissible as character evidence?
  • Was Adam's affiliation with a known guns dealer proven by his phone number being included in the man's contact list?

Adam Montgomery asks for murder trial to be delayed

... defense attorney Caroline L. Smith is hoping for a continuance to allow for time to obtain a new co-counsel and for that person to have sufficient time to prepare for the trial.

... Smith said her co-counsel accepted a non-lawyer job within the state’s public defender system. The job switch prevents her from being able to continue as co-counsel, Smith wrote.

Smith said Montgomery agreed to delay the start of jury selection and to waive his right to a speedy trial.

The attorney requested an immediate hearing about the matter.

Massachusetts lawmakers discuss forming commission in wake of Harmony Montgomery case

Typically, the state of Massachusetts will prioritize placing a child who is in foster care with a blood relative over a family who is interested in adopting, similar to what happened with Harmony and her father.

The commission would be tasked with digging deeper into a blood relative to see if the placement is in the best interest of the child, something experts who testified said should have happened in Harmony's case.

"I'm hoping that the legislation as it stands now is allowed to be amended to let the committee focus on those issues," said Carol Erskine, a retired Massachusetts juvenile court judge. "Otherwise, we should just accept that there will be more child fatalities in Massachusetts."

Blair Miller, one of the adoptive fathers of Harmony Montgomery’s biological brother, Jamison, brought an Elmo doll Jamison had been given by Harmony to the hearing. Miller described trying to adopt Harmony as well and being rebuffed. He said he attempted to connect the siblings before Harmony’s disappearance, but it never happened.

“Jamison wanted to know how she was doing,” said Miller. “He wanted to hear her voice. Never did anyone here in Massachusetts ever help Jamison deal with this relationship. Never did anyone ever give us the tools to help connect us, or provide a sibling visitation between Jamison and Harmony."

Miller added, that there could have been communication between Harmony and her brother, if there had been supports in place.

“There could have been FaceTime calls, maybe. There could have been in person visits. There could have been opportunities to see how Harmony was doing … We could have seen that Harmony was surrounded by trouble.”

Harmony Montgomery: Trial for father of missing girl set for next year

Adam Montgomery, who is charged in the murder of his 5-year-old daughter Harmony, had his trial delayed until next year at a court hearing Thursday in New Hampshire.

Now, the next pre-trial hearing in the case is set for 9 a.m. on Jan. 16, 2024, with the trial to begin on Feb. 6, 2024 upon jury selection.

The trial was initially supposed to start on Nov. 21. However, WMUR reports Montgomery’s attorneys asked the judge to postpone the trial because the defense team is in need of a new co-counsel who will require time to prepare.

Judge agrees to delay start of Adam Montgomery's murder trial

Montgomery's public defender Caroline L. Smith had filed a motion last week saying the defense team needs a new co-counsel who will need time to prepare. In a court filing obtained earlier this month by News 9 Investigates, Smith said her co-counsel accepted a non-lawyer job within the state’s public defender system. The job switch prevents her from being able to continue as co-counsel, Smith wrote.

After a lengthy conference with the judge and defense team in chambers, state prosecutors said they understood the reasons for the request and did not object to the motion to delay.

The judge asked Smith to file a waiver of speedy trial signed by Adam Montgomery within 10 days.

Trial preparations are underway for Adam Montgomery, the Manchester man accused of murdering his daughter, Harmony, in 2019.

Jury selection is set for February in the case that started two years ago Wednesday with a call from the Division of Children, Youth and Families to the Manchester Police Department saying Harmony could not be located.

Prosecutors file list of nearly 200 witnesses they might call in Adam Montgomery murder case

The witness list for the state includes Adam Montgomery's father, uncle, grandmother and the person who is expected to be the prosecution's star witness: his estranged wife, Kayla Montgomery.

In all, the state's witness list has 79 civilians, along with 73 members of law enforcement, six expert witnesses and 31 recordkeepers.

The state has also responded to several defense motions. The defense has asked the court to not allow evidence that Adam Montgomery allegedly used an ATM across from a Home Depot and then bought lime and other items to help dispose of Harmony's body.

The state agreed that the defense should be able to question Kayla Montgomery about her perjury convictions but also said she should be able to testify that Adam Montgomery beat her regularly, saying that goes directly to the charge of witness tampering.

"The state anticipates that Kayla will testify that she provided false statements due to the abuse, threats and conditioning she suffered at the hands of the defendant," the state wrote in its filing.

Harmony's remains have never been located. The Manchester Police Department has established a new tip line at 603-932-8997 for information that could help investigators find her.

Adam Montgomery is now seeking two trials, one for an assault charge and one for a charge of second-degree murder in connection with the death of his 5-year-old daughter, Harmony.

"If you choose to sever this, then we would argue that the first thing to go forward is the assault charge, because it's the first one chronologically, the first one that he's been held longer on 11 months longer of incarceration, as compared to the homicide charge," Agati said.

If Adam Montgomery is found guilty of assaulting his daughter, the state told the court it plans to use that information in the murder trial.

The judge said she will issue a ruling soon. Jury selection is still scheduled for Feb. 6. Lawyers said that if they have to, they can squeeze two trials into four weeks in February.

Defense attorneys said they realized it was late in the process to make such a request, but, without going into detail, they said it was necessary.

"There has been a substantial change, or at least we have become aware of a strategy by the state that I believe would be unfair to Mr. Montgomery," defense attorney Caroline Smith said.

Prosecutors denied there was any new information that Montgomery and the defense team didn't have before.

The trial is expected to last for four weeks but should be done before Feb. 29, both sides said in court.

Prosecutors said they will call about 50-55 witnesses, down from the initial witness list that had nearly 200 names. There were two people named on the defense witness list.
