Homicide detectives took over the investigation and determined that the boy’s mother, identified as Diaja Smith, 23, was the suspect in the boy’s death. She was arrested and booked into Clark County Detention Center. Smith faces a charge of open murder, among other felony charges.

"I saw the lady sitting there with her two other kids, really hysterical and saying 'somebody took my kid, somebody took my kid,'" said Barnett. "She was really, really hysterical. She was clutching another one of her kids.

Barnett said police were also on scene asking him if he saw a missing 2-year-old child.

"As the officer was investigating her, I noticed there were some inconsistencies with her story," Barnett said.

"Around 1:30 a.m., I got a knock on my door they handed me a flyer asking me if I saw this kid," said RJ Robinson.

David Santos also lives nearby and said there were several patrol cars and crime scene investigators on scene.

"It makes me want to move out of here," Santos said.

Glad his mother is in custody. She had other options than the one she chose.

The child was reported missing from the area of Lewis Avenue & 15th Street at 8:25pm on Thursday, 6/6/24 & police said officers immediately began their search. Just before 1am, the 2-year-old was found inside a garbage dumpster a few blocks away, near Lewis Avenue & 13th Street. The toddler was pronounced dead at the scene by medical first responders. Homicide detectives who took over the investigation identified the child's mother, 23-year-old Diaja Smith, as the suspect in the 2-year-old's death. Smith was arrested and, as of this report, was booked into the Clark County Detention Center for open murder & other unspecified felony charges. She is scheduled to appear in court Saturday, 6/8/24 afternoon at 1:30pm.

Another suspect, Jacoby Robinson, also appeared in court Saturday on charges of child abuse and neglect. The prosecutor in court Saturday revealed he will also be facing a murder charge.

During Saturday's hearing, prosecutors said Robinson allegedly admitted to being in the home when the 2-year-old was whipped and beaten and saw the toddler after he was beaten throwing up and helped him get the vomit out of his mouth and nose before he went back to sleep.

Prosecutors also said they were notified of some "very concerning injuries" to the child's body, stating there is a pattern of abrasions in his genital area consisting of banding from rubber bands that officers saw in the home, and said there are injuries to nearly 100% of the toddler's body from being whipped with a cord.

Smith and Robinson are being held without bail. Both are due back in court on Tuesday, June 11.
