#TellesTrial: Day eight.
3rd witness for defense: Robert Aguero, owns company on cell phone forensics.
Discussing cell phone data for Telles in August of 2022.
8/28/22: only two cell phone towers used (none appear to be near Jeff German’s address).
9/2/22: Draskovich: Does it appear the cell phone was near Planet Fitness?
Aguero: Yes. (Note: Draskovich trying to show cell phone data links phone of Telles to his home & the gym, NOT German’s home where he was murdered that day.)
Prosecutor Chris Hamner cross exam: Hamner shows CTF DataPro, Inc. PowerPoint presentation completed by Aguero. Points out it was submitted this morning at 10:21.
Hamner shows this was not 1st report he submitted. 2009-2022 cell phone history: map shows section of Las Vegas.
Hamner shows that the current slide being shown was not in original presentation.
Hamner points out the owner of a phone can turn off location information and/or turn off phone.
Aguero agrees.
Hamner: All user has to do is turn off the phone…
Aguero: Agrees.
Hamner: No tower interaction near Bronze Circle (German’s address).
Aguero: yes.
Hamner: morning of 9/2 (day of murder): last outgoing text on cell phone of Telles at 8:48am.
Tons of outgoing data: can be passive function of phone.
Multiple incoming text messages after 9am.
Phone is not responding and texting back.
Incoming voice calls.
Not picked up.
More incoming calls after 1pm. Not picked up.
More incoming texts.
No outgoing activity on phone.
Hamner: people keep reaching out to phone and we’re not seeing a response from this phone.
Finally at 2:05pm, there’s outgoing text.
From 8:48am-2:05pm, no outgoing calls/texts.
Hamner has demonstrated that the cell phone of Telles appeared to go dark for more than five hours on the day of German’s murder.
Telles is shaking his head.
Draskovich showing there appears to be limited cell phone data (communications) during other months also.
Hamner: Aguero said he didn’t review content of text messages.
Hamner showing document Aguero had that shows content of text messages.
Aguero reiterates he didn’t review the content of text messages because he wasn’t asked to.
Draskovich objects to Hamner’s line of questioning at the moment.
Attorneys now at the bench.
Hamner continues to ask Aguero to review messages from cell phone of Telles.
Draskovich pointed out this witness wasn’t brought here for this.
Judge allows Hamner to continue.
Draskovich asks about 9/2 and how there was no response to people reaching out to Telles. Aguero points out a lot of the messages were junk (like ads).
Aguero points out the gym is a location where the phone could have been (on 9/2/22).
Draskovich says with Hamner’s line of theory about phone being turned off on 9/2/22, it could also mean the phone was shut off during other months also (based on cell phone data).

Additional media here as Robert Telles is expected to take the stand later today (depends how long this goes with witness right now). Additional members of the public here. Clark Co. District Attorney Steve Wolfson is also here.
Witness:
Discusses visiting homes with Telles (for public administrator purposes).
Recalls smell of decay since at times, the resident passed away in the homes they visited.
Public Administrator’s office deals with estate issues.
Draskovich plays video of suspect walking and asks if she recognizes this as Telles.
Witness says no.
Says she expressed concern about a realtor the office did business with.
That realtor testified for the state, said he called police when he saw suspect video released by police.
Witness starts to tear up.
Says she was asking people how to handle bullying at county, felt she was being bullied, wasn’t getting answers about how to handle it.
Telles lost primary in June of 2022.
Says she didn’t see him angry or hostile.
Prosecutor Pam Weckerly cross examination:
Confirming witness knew Telles about a year & a half before he was arrested.
Says she worked with Roberta Lee-Kennett. This is the employee who Telles was accused of having inappropriate relationship with, per Jeff German’s reporting.
Says Telles asked her to participate in 1st story (re: Jeff German’s reporting). Says she did.
Says she wasn’t aware of Telles posting about German.
Didn’t follow Telles on social media.
Telles leans over to briefly speak to attorney as Weckerly questions witness.
Says she is only familiar with brown BMW Telles drove.

Says medical examiner testimony is first he learned how German died.
Says injuries show killer knew what they were doing.
Giving background from high school. Worked in IT, property mgmt., maintenance, HVAC.
“Analytical mind…” then became attorney.
Refers to strange things about case.
Now goes back to background.
Apologizes, says he’s nervous.
Worked during day, law school at night.
Met wife online before law school, got married.
Refers to children.
Was probate attorney before becoming Public Administrator. Telles wants to show his first exhibit during his testimony.“Somebody framed me for this.”Document shows the start of the work he “began against them.”Says spreadsheet shows the beginning.

Narrative testimony attempts to tell a story about an incident or transaction without prompting by an attorney with specific questions. Whether or not to allow narrative testimony is left to the broad discretion of the trial court.{footnote}United States v. I don't know how he expects to convince the jury his DNA was planted under German's fingernails.

I'm quite curious about how he'll attempt to do that.
He seems to be defending how he ran his office, maybe tomorrow he'll finally get around to how he got 'set up' for the murder.
