3rd witness for defense: Robert Aguero, owns company on cell phone forensics.
Discussing cell phone data for Telles in August of 2022.
8/28/22: only two cell phone towers used (none appear to be near Jeff German’s address).
9/2/22: Draskovich: Does it appear the cell phone was near Planet Fitness?
Aguero: Yes. (Note: Draskovich trying to show cell phone data links phone of Telles to his home & the gym, NOT German’s home where he was murdered that day.)
Prosecutor Chris Hamner cross exam: Hamner shows CTF DataPro, Inc. PowerPoint presentation completed by Aguero. Points out it was submitted this morning at 10:21.
Hamner shows this was not 1st report he submitted. 2009-2022 cell phone history: map shows section of Las Vegas.
Hamner shows that the current slide being shown was not in original presentation.
Hamner points out the owner of a phone can turn off location information and/or turn off phone.
Aguero agrees.
Hamner: All user has to do is turn off the phone…
Aguero: Agrees.
Hamner: No tower interaction near Bronze Circle (German’s address).
Aguero: yes.
Hamner: morning of 9/2 (day of murder): last outgoing text on cell phone of Telles at 8:48am.
Tons of outgoing data: can be passive function of phone.
Multiple incoming text messages after 9am.
Phone is not responding and texting back.
Incoming voice calls.
Not picked up.
More incoming calls after 1pm. Not picked up.
More incoming texts.
No outgoing activity on phone.
Hamner: people keep reaching out to phone and we’re not seeing a response from this phone.
Finally at 2:05pm, there’s outgoing text.
From 8:48am-2:05pm, no outgoing calls/texts.
Hamner has demonstrated that the cell phone of Telles appeared to go dark for more than five hours on the day of German’s murder.
Telles is shaking his head.
Draskovich showing there appears to be limited cell phone data (communications) during other months also.
Hamner: Aguero said he didn’t review content of text messages.

Aguero reiterates he didn’t review the content of text messages because he wasn’t asked to.
Draskovich objects to Hamner’s line of questioning at the moment.

Hamner continues to ask Aguero to review messages from cell phone of Telles.
Draskovich pointed out this witness wasn’t brought here for this.
Judge allows Hamner to continue.
Draskovich asks about 9/2 and how there was no response to people reaching out to Telles. Aguero points out a lot of the messages were junk (like ads).
Aguero points out the gym is a location where the phone could have been (on 9/2/22).
Draskovich says with Hamner’s line of theory about phone being turned off on 9/2/22, it could also mean the phone was shut off during other months also (based on cell phone data).
Hamner points out phone could have been left at home on 9/2/22.
8:48am-2:05pm, the day of German’s murder, nothing outgoing on cell phone of Telles.
Draskovich: majority of messages were automated.
Juror question: any method of taking pics with cell phone that wouldn’t show up on media location map?
Aguero: Yes.
Media locations only active when location services are turned on.
Draskovich: No indication of any intent based on user?
Aguero: No.
