#TellesTrial: Day eight.



3rd witness for defense: Robert Aguero, owns company on cell phone forensics.
Discussing cell phone data for Telles in August of 2022.
8/28/22: only two cell phone towers used (none appear to be near Jeff German’s address).



9/2/22: Draskovich: Does it appear the cell phone was near Planet Fitness?
Aguero: Yes. (Note: Draskovich trying to show cell phone data links phone of Telles to his home & the gym, NOT German’s home where he was murdered that day.)


Prosecutor Chris Hamner cross exam: Hamner shows CTF DataPro, Inc. PowerPoint presentation completed by Aguero. Points out it was submitted this morning at 10:21.
Hamner shows this was not 1st report he submitted. 2009-2022 cell phone history: map shows section of Las Vegas.



Hamner shows that the current slide being shown was not in original presentation.
Hamner points out the owner of a phone can turn off location information and/or turn off phone.
Aguero agrees.



Hamner: All user has to do is turn off the phone…
Aguero: Agrees.
Hamner: No tower interaction near Bronze Circle (German’s address).
Aguero: yes.


Hamner: morning of 9/2 (day of murder): last outgoing text on cell phone of Telles at 8:48am.
Tons of outgoing data: can be passive function of phone.
Multiple incoming text messages after 9am.
Phone is not responding and texting back.
Incoming voice calls.
Not picked up.


More incoming calls after 1pm. Not picked up.
More incoming texts.
No outgoing activity on phone.
Hamner: people keep reaching out to phone and we’re not seeing a response from this phone.
Finally at 2:05pm, there’s outgoing text.
From 8:48am-2:05pm, no outgoing calls/texts.


Hamner has demonstrated that the cell phone of Telles appeared to go dark for more than five hours on the day of German’s murder.


Telles is shaking his head.


Draskovich showing there appears to be limited cell phone data (communications) during other months also.


Hamner: Aguero said he didn’t review content of text messages.
Hamner showing document Aguero had that shows content of text messages.
Aguero reiterates he didn’t review the content of text messages because he wasn’t asked to.


Draskovich objects to Hamner’s line of questioning at the moment.
Attorneys now at the bench.


Hamner continues to ask Aguero to review messages from cell phone of Telles.
Draskovich pointed out this witness wasn’t brought here for this.
Judge allows Hamner to continue.


Draskovich asks about 9/2 and how there was no response to people reaching out to Telles. Aguero points out a lot of the messages were junk (like ads).


Aguero points out the gym is a location where the phone could have been (on 9/2/22).


Draskovich says with Hamner’s line of theory about phone being turned off on 9/2/22, it could also mean the phone was shut off during other months also (based on cell phone data).


Hamner points out phone could have been left at home on 9/2/22.
8:48am-2:05pm, the day of German’s murder, nothing outgoing on cell phone of Telles.
Draskovich: majority of messages were automated.


Juror question: any method of taking pics with cell phone that wouldn’t show up on media location map?
Aguero: Yes.
Media locations only active when location services are turned on.


Draskovich: No indication of any intent based on user?
Aguero: No.

Witness done.

4th witness for defense is in witness protection, according to court spokesperson.
Known Telles since 2021.
Worked in Clark County Public Administrator’s office.
Says Telles hired her. “Rob was very inviting.”


Media has been told to not show her face, but told we CAN use her name. I am not going to for now.
At this point, I do not know why she is in witness protection.
Mentions German’s articles. Says she did not see Telles express anger. Felt a lot of tension in office.


Says she felt like co-workers were taken back by Telles hiring her.
Says she felt like she had to take a side (Telles or group of co-workers).
Says she felt uncomfortable choosing staff members over supervisor.
She refused to choose and just wanted to do the work,
 
Courtroom observations:

Additional media here as Robert Telles is expected to take the stand later today (depends how long this goes with witness right now). Additional members of the public here. Clark Co. District Attorney Steve Wolfson is also here.

Witness:

Discusses visiting homes with Telles (for public administrator purposes).
Recalls smell of decay since at times, the resident passed away in the homes they visited.
Public Administrator’s office deals with estate issues.

Draskovich plays video of suspect walking and asks if she recognizes this as Telles.
Witness says no.
Says she expressed concern about a realtor the office did business with.
That realtor testified for the state, said he called police when he saw suspect video released by police.


Witness starts to tear up.
Says she was asking people how to handle bullying at county, felt she was being bullied, wasn’t getting answers about how to handle it.
Telles lost primary in June of 2022.
Says she didn’t see him angry or hostile.


Prosecutor Pam Weckerly cross examination:
Confirming witness knew Telles about a year & a half before he was arrested.
Says she worked with Roberta Lee-Kennett. This is the employee who Telles was accused of having inappropriate relationship with, per Jeff German’s reporting.


Says Telles asked her to participate in 1st story (re: Jeff German’s reporting). Says she did.
Says she wasn’t aware of Telles posting about German.
Didn’t follow Telles on social media.
Telles leans over to briefly speak to attorney as Weckerly questions witness.


Says she is only familiar with brown BMW Telles drove.

5th witness for defense:
Terrence Jamison, Planet Fitness general manager, West Charleston & Fort Apache location next to Whole Foods.
Reviews data track report showing remote check-ins (sign-ins to club).
Draskovich: names on paper checked in between 9/1/22 to 9/3/22.



Draskovich: 12:09pm, 9/2/22: info shows Robert Telles checked in.
Weckerly cross examination: witness says person can check-in through app & then show barcode to person at front desk.
Draskovich: based on documents, you can’t tell how Telles checked in…?
Witness: correct.


Juror question: Does your location have camera that cover check-in area and was it requested by authorities?
Witness: yes, there are cameras, footage wouldn’t still be available from 2022.
Draskovich requested footage which wasn’t available.
Witness unsure when request made.

Defense attorney Robert Draskovich: Begin with your story.
Telles directly to jury: I am innocent.



Telles: I had to see pictures (of German’s body), it was ugly.
Says medical examiner testimony is first he learned how German died.
Says injuries show killer knew what they were doing.
Giving background from high school. Worked in IT, property mgmt., maintenance, HVAC.



“Analytical mind…” then became attorney.
Refers to strange things about case.
Now goes back to background.
Apologizes, says he’s nervous.
Worked during day, law school at night.
Met wife online before law school, got married.
Refers to children.


Was probate attorney before becoming Public Administrator. Telles wants to show his first exhibit during his testimony.“Somebody framed me for this.”Document shows the start of the work he “began against them.”Says spreadsheet shows the beginning.


Says: spreadsheet shows someone bought property & sold it same day for $50K more.
“It floored me to see that this was going on.”
Public Administrator’s office had duty to protect the estates.
Says he went to legislature, laws were changed, gave him greater watchdog ability.



March 2022: approached Clark County District Attorney Steve Wolfson with concerns about “Compass Realty.”
Says he previously expressed concerns with attorney general’s office which took less a month to investigate & nothing came of it.
Wolfson referred him to Detective Jappe.


Discusses four-page letter to Det. Jappe about his concerns.
Thought @LVMPD was going to observe homes that still had property in them (to see what would happen with stuff inside that Telles is claiming people were removing).
Says he was not “buddies” w/ Jappe.


Says a Compass Realty realtor filed for his position (in addition to Rita Reid who worked in the Public Administrator’s office).
Says Reid received $5K from Compass Realty (campaign donation).
Says he has the wrong Secretary of State report to show the donation, apologizes.


Says German published story.
Says Reid ran text message campaigns sending articles to voters.
He lost primary. “It was a bummer.”
“It was unfortunate.”
“I continued to fight against Compass Realty & it’s something they didn’t expect.”
Says he had nothing to gain from it.
 

NARRATIVE TESTIMONY​


Narrative testimony attempts to tell a story about an incident or transaction without prompting by an attorney with specific questions. Whether or not to allow narrative testimony is left to the broad discretion of the trial court.{footnote}United States v. Young, 745 F.2d 733 (2d Cir. 1984).{/footnote} Most courts do not allow a witness to testify in narrative form, since opposing counsel is often denied an adequate opportunity to object before the witness says something which is inadmissable. Where narrative testimony is allowed, a prompt motion to strike is required to preserve an objection to anything inadmissable.{footnote}Silva v. Dias, 46 Cal. App. 2d 662 (1941).{/footnote}

 
Why is he speaking about mortgages, foreclosure, and that the extra $50K (as far as he is concerned) is due to the family? Did he forget he's the defendant in a murder trial? moo

Telles refers to a specific estate & wants to show a document.
Says appraiser said it would take $20K in repair costs.
3 mos later, buyer resold home & made $. Says money should have gone to family.
One juror yawns.
Some jurors take notes.
Some look directly at Telles & listen.



Telles apologized again and said he’s nervous.


Refers to email to Det. Jappe:
Says appraisal happened w/ kitchen ripped out to reduce value.
Tells jury he previously represented himself & requested info about Jappe’s investigations.
Suggests jurors go to notes with Jappe’s testimony (after two objections by prosecutor).

This is rather bizarre.

I don't know how he expects to convince the jury his DNA was planted under German's fingernails.

Attorneys at bench now at request of prosecutor Chris Hamner.
Judge reminds Telles his opinions are not relevant & to stick to his personal knowledge.


Refers to German’s murder…“I believe this was quite a coincidence, the fact that Mr.German was killed…”
And then explains how his concerns about Compass Realty were no longer being looked into.

He won’t be able to explain away his DNA found on JG’s hands and fingernails. moo
I'm quite curious about how he'll attempt to do that.

He seems to be defending how he ran his office, maybe tomorrow he'll finally get around to how he got 'set up' for the murder.
