Federal judge denies Trump’s attorney’s request to delay next week’s civil trial for a week while Trump attends the funeral of Melania’s mother. Trump is free to attend the funeral during trial, Judge Kaplan says. Trump did not attend any of the previous Carroll trial.

Judge Kaplan issues a brief opinion, noting that if Trump is done with his defense on Thursday, subject only to his testimony, and truly intends to testify, the court would allow him to do so on Monday, 1/22.

The court, for its part, saw through that, in no small part because it later learned Trump scheduled a NH rally for the evening of 1/17, when his counsel represented he needed to travel or simply be with his family.

The trial is expected to last between 2-5 trial days. And Judge Kaplan is now saying that if — and only if — Carroll has rested her case and Trump’s case is done, but for his testimony, sometime on 1/18, he’ll end the trial day early and reconvene Monday for Trump’s testimony.

That’s all it is: a minor accommodation so that Trump need not choose between the funeral and testifying. But otherwise, the relief Trump requested was denied.

Trump called a judge a 'bad person' for not allowing him to travel for a funeral. His calendar says he's got a campaign event that day.​

it’s complicated. The first trial was actually the second lawsuit Carroll filed as a sexual abuse survivor during the one year “window” in 2022/23. She was awarded $5 million for defamation even though the jury did not agree with her charge of rape. She had first sued him for what he said about her when she had accused him in writing in 2019. When the DOJ removed its protection of what Trump said about Carroll while in office, her first lawsuit was allowed to go forward. She also added more to the lawsuit because of what he said about her after the first court case In 2023. I’m sure this is clear as mud!

Tacopina, a key lawyer who was representing Trump in his New York hush money case and the appeal of last year's ruling in the E. Jean Carroll defamation trial, withdrew his firm's services Monday, just two months before the criminal case was set to begin.

Withdrawing his firm's services would include fellow lawyers Chad Seigel and Matthew DeOreo.

These defamation charges were postponed by Judge Lewis Kaplan on 3/30/23. Carroll's first defamation lawsuit against Trump was filed in November 2019. But that case has been put on hold while Trump argues that a federal law protects him from being sued for defamation for comments he made while president. And was amended to Trump’s comments made on 5/10/23.
Trial set to begin on 1/16/24.

9/13/23 Update: Motions hearing before Second Circuit began today, 9/13/23 at 10am. Trump is trying to delay the Carroll I trial (based on his defamation of her from 2019. Judge Lewis Kaplan heard arguments from Trump’s defense attorney Alina Habba & Carroll’s attorney Joshua Matz. A federal appeals court will quickly consider Trump’s claim that presidential immunity protects him from being held liable for statements he made in 2019 when he denied that he sexually attacked a New York writer in the 1990s, the court said Wednesday. The 2nd U.S. Circuit Court of Appeals in Manhattan issued an order to say it will expedite the appeal a day after Trump attorney Alina Habba told a three-judge panel of the court that the appeal raised “an important question that will affect the delicate balance between the judiciary & the executive branch for many years to come.” The 2nd Circuit set a schedule for written arguments to be filed within a month. In its two-page order Wednesday, the 2nd Circuit denied an application by Trump to stay lower-court proceedings during the appeal, but it said it was in the interest of all sides for the appeals court to resolve the issue of presidential immunity expeditiously.

He also requested that Judge Lewis Kaplan allow Tacopina's two partners, Chad Seigel & Matthew DeOreo, to withdraw their services, as well. The trial judge presiding over Trump's criminal case in Manhattan will not rule that attorney Joe Tacopina has a conflict of interest in representing him. Supreme Court Judge Juan Merchan has declined to hold a conflict hearing on Tacopina, which was requested previously in a complaint filed by the attorney for adult film star Stormy Daniels.

Carroll is seeking $10 million for harm to her reputation, as well as an unspecified amount of punitive damages.

And for E. Jean Carroll, Carroll I, filed in 2019, has become somewhat of a legal lay-up. That’s because the presiding federal judge, Lewis A. Kaplan, ruled in September that because of a jury’s verdict in Carroll’s other defamation case that was filed in 2022 (referred to as “Carroll II”), Trump cannot argue that he did not defame Carroll. In fact, the only thing left now for a jury to decide in Carroll I is how much to award Carroll for the damages she suffered as a result of Trump’s defamation of her in 2019, when he was president. In the interest of full disclosure, I am good friends with Carroll. Regardless of our friendship, my legal analysis is based on the facts and case law.

...Trump has already tried to convince Kaplan to cap Carroll’s damages to the $5 million verdict that was rendered last year in Carroll II. His argument was that the second jury this week should be bound by the first jury’s decision on the amount. But Kaplan denied that move and said that Trump was trying to “mix apples with oranges.”

To make matters worse for Trump, he appears to have failed to learn his lesson from his first courtroom battle with Carroll as he continues to defame her. Just a few days ago, he shared a barrage of 31 posts in about 30 minutes on his social media platform, Truth Social. The posts were not written by Trump, but instead were shared comments, interview clips and social media posts by others that disparaged and attacked Carroll. Not content to allow others to berate Carroll, Trump has also attacked her on television and even while on the campaign trail. Even Tuesday morning, before arriving at the federal courthouse, Trump posted on social media what appears to be yet another potentially defamatory statement about Carroll. His offensive conduct has been covered widespread by the media, which means a very high probability that prospective jurors have also heard and seen his repeated defamation of Carroll, which always presents its own challenge.

Alina Habba in her opening statement, says of Carroll: “She has gained more fame, more notoriety than she could have ever dreamed of.”"She wanted status. We will show you that she wanted the attention, and it was planned."

It goes without saying, but I will anyway…If Trump has posted 22 defamatory posts today about Carroll while he is going on trial for defamation, he clearly has no impulse control and is sure no one can stop him.
 
Donald Trump attorney Alina Habba said in her opening statement that E. Jean Carroll’s career has prospered since she went forward with her sexual assault allegations, arguing that Carroll was trying to seek “a windfall” over “mean tweets.”

"She's afraid, she's afraid that someday somebody’s going to make good on their threats,” Carroll lawyer Shawn Crowley said during opening statements on Tuesday.
Carroll’s lawyer said Trump’s statements “unleashed his followers” and caused Carroll to receive threats, saying that she should go to jail and that "she should die because she had the courage to speak out about what Donald Trump had done to her." Crowley said that Carroll will testify tomorrow.

Mary Trump suggested that her uncle’s decision to speak in court last week at the end of a separate civil fraud trial, in which Trump has also denied wrongdoing, might’ve played a role in Tacopina’s departure.

The former president recently told The New York Times that he wished to testify in the second trial and that Tacopina, who represented him in the first, had advised him not to last time.

“After Donald’s disastrous closing argument in his New York fraud trial, it’s no wonder that Tacopina wanted to distance himself from Donald’s penchant for self-destruction behavior,” she wrote.
