I don't expect Trump to testify so he will then have to take the fifth.

Based on his previous behaviours, I agree that he probably will take the fifth, and he will expect people to accept that without question.

I doubt that it will matter much because there is sufficient evidence to support a conviction.

*Bench Trial set to begin (@ 10am ET) – NY - New York vs. Donald J. Trump, Donald Trump, Jr. & Eric Trump & the Trump Organization, Inc. (Allen Weisselberg & Jeffrey McConney) is being sued by Letitia James, the New York Attorney General, who is leading a civil investigation (which cannot result in criminal charges filed on 9/21/22) & has spent years looking at whether the company committed various acts of fraud over several decades. In the civil case, Ms. James has filed a lawsuit against Trump & three of his children accusing them of "astounding" fraud & deception.
New York is seeking $250 million in financial penalties & asked the court to ban Trump, Donald Trump Jr. & Eric Trump from serving as an officer or director in any corporation registered or licensed in New York. James also requested the court ban the former president & his business from acquiring real estate in New York or from applying for loans from any New York financial institution for five years. James's civil case accuses Trump of lying from 2011 to 2021 about asset values at the Trump Organization, as well as his own net worth, in order to obtain better terms from lenders & insurers.

9/26/23 Update: Summary Judgement. New York State Court Judge Engoron has granted partial summary judgment to the New York attorney general, finding that Trump is liable on top fraud count of NYAG business fraud lawsuit. Trial is still set to go next week with a narrower scope. Judge Engoron wrote that the documents uncovered in the case “clearly contain fraudulent valuations that defendants used in business,” and none of Trump’s defenses hold up, including his claim that he could always find a “buyer from Saudi Arabia” for one property or that measuring square footage is a “subjective process.” The judge pointed to several Trump properties that were overvalued, including Mar-A-Lago, a building on Park Avenue, an estate in Westchester County & his penthouse in Trump Tower—which had an inflated square footage even after Forbes asked him about the exaggeration, Engoron notes. As a result, Judge Engoron canceled several of Trump’s business certificates & ordered the dissolution of Trump-related LLCs. The second orders that "within 10 days of the date of this order, the parties are directed to recommend the names of no more than three potential independent receivers to manage the dissolution of the canceled LLCs." Judge Engoron also sanctioned several of Trump’s attorneys $7,500 for making arguments the court had repeatedly tossed out. The trial against Trump & his business allies is set to begin on Monday, 10/2/23 & run until December, though that date remains slightly up in the air. An appeals court temporarily delayed the trial earlier this month amid a lawsuit between Trump & the judge—the appellate judges will hear arguments this week, and could let the trial proceed as scheduled. Next final pretrial conference hearing on 9/27/23 @ 10am.
9/27/23 Update: Wednesday's hearing was to discuss matters before a trial set for Oct. 2. In court, Kise, who had called Judge Arthur Engoron's decision "completely disconnected from the facts & governing law," complimented the judge as "extremely intelligent." Both sides agreed to temporarily withdraw their motions to limit certain evidence & testimony, and to consider them as the trial progresses. Judge Engoron also granted a defense request to have 30 days rather than 10 to recommend receivers. Justice Engoron at the hearing on Wednesday was asked by Trump's lawyer Christopher Kise about what he intended a day earlier by ordering the cancellation of business certificates that let some of Trump's businesses operate. Engoron's ruling could force Trump to give up control to a receiver of properties including Manhattan's Trump Tower, golf courses & his family estate in a Manhattan suburb. Trump's businesses "own physical assets like Trump Tower, like 40 Wall Street. Is the court under the impression those assets are to be sold or are they just to be managed under the monitor?" Kise asked. "I'm not prepared to issue a ruling right now," Engoron responded. A state appeals court is expected to rule this week on Trump's bid to delay the trial. Court officials are cementing plans to proceed with Monday's $250 million civil fraud trial against Trump after attorneys for Trump & the New York attorney general's office hashed out some pretrial issues at a hearing Wednesday -- although lingering questions remain regarding the impact of Judge Arthur Engoron's sweeping ruling on Tuesday. But the judge wrote that a trial was still required to decide six remaining causes of action alleged by Attorney General Letitia James, as well as the scope of the penalty, which could include barring Trump from making real estate acquisitions & applying for loans in New York. In response, Engoron asked if the attorney general would consider dismissing the remaining causes of action to streamline the trial. A lawyer for attorney general responded that the government would still like to proceed with those arguments, citing their relevance to their requested relief. Also during Wednesday's hearing, Trump's attorneys & the government appeared to agree that a previously appointed independent monitor, Barbara Jones, should be named the independent receiver to manage the dissolution of the cancelled LLCs. Engoron said he would likely issue a ruling appointing Jones as the receiver. Regarding a defense motion to limit the testimony of expert witnesses at trial, the defense said they plan to withdraw the motion without prejudice, leaving the parties to address issues with expert witnesses on a case-by-case basis. Following the hearing, attorneys for defense & the attorney general met to decide the courtroom layout for opening statements on Monday, 10/2/23. In total, the attorney general's office plans to call 28 witnesses to present their case in the upcoming trial & also listed 25 additional witnesses they could use on rebuttal, according to the filing. In their witness list, Trump & his co-defendants reserved the right to call over 130 witnesses for their case, including Trump & his adult sons.
9/27/23 Update: Former Trump attorney Michael Cohen said he may not testify against his former boss because he's scared of the blowback from the former president's loyalists. Cohen made the comments on MSNBC on Wednesday. He said Donald Trump’s rhetoric needs to be checked before he gets witnesses in his criminal cases hurt or killed.
9/28/23 Update: The NY Attorney General's $250 million civil fraud trial against Donald Trump will not be delayed, an appeals court ruled Thursday, denying Trump's lawyers' last-minute attempt to sideline the trial on six counts related to business fraud, which will start on Monday, 10/2/23.

Now, in the twilight of a distinguished two-decade career on the bench, the erudite, Ivy League-educated judge is presiding over his biggest case yet: deciding the future of former President Donald Trump’s real estate empire…

Engoron, a few years younger than Trump at 74, spent his early years in Queens, about 3.8 miles (6 kilometers) east of the former president’s childhood home.

Engoron’s family later moved to East Williston on Long Island, where he ran track and wrote for the student newspaper at The Wheatley School, a public high school in Old Westbury, New York, and graduated in 1967.

Engoron got his law degree from New York University in 1979. He’s worked as a litigator and was a law clerk for 11 years for a judge in the same court where he now sits. Engoron also taught piano and drums and played keyboard in what he describes as a “moderately successful” bar band. He’s been married three times and has four children, according to his Wheatley alumni page biography.

Engoron frequently peppers his rulings with song lyrics, movie quotes and the occasional New York City history lesson. He’s quoted Bob Dylan and Shakespeare and movies like “City Slickers” and the Marx Brothers classic “Duck Soup.” He signs them with a logo of sorts, his initials, AE, drawn together in a circle.

Engoron has been involved in Trump-related cases since 2020, when he was assigned to intervene in quarrels among Trump’s lawyers and James’ office over demands for evidence and the direction of her investigation.
