Well, trump's lawyers evidently ended up getting leave from the court to refile the motion. Because it has been rejected yet again.


Trump’s lawyers first asked the federal court to intervene last week, but their paperwork was kicked back because they hadn’t gotten the required clearance from Hellerstein to file it. Hours after they submitted papers Tuesday requesting Hellerstein’s permission to proceed, he issued his ruling denying it.

Judge Will Decide Friday Whether to Postpone Trump’s Sentencing

The article basically says that Justice Merchan is in a tough position.
If he delays trump's sentencing until after the election, as requested by the defence, he will be accused of putting political considerations above the rule of the law.
If he goes ahead with the sentencing, he will be accused of meddling in the election.

Seems the right course is to ignore concerns about public attention and follow the rules and guidelines as if this was any other case. jmo

Trump’s sentencing in New York has been delayed until after the election. Sentencing, “if necessary,” now set for November 26. Justice Merchan says he will issue a decision on Trump’s motion to toss his guilty verdicts based on presidential immunity on November 12.

In a letter released Friday, Merchan cited a desire to avoid any appearance of trying to affect the approaching presidential election, but as a practical matter, it looks like the Manhattan district attorney’s office was mostly responsible for this result.

Prosecutors told Merchan several weeks ago that they did not oppose Trump’s request to delay the sentencing beyond the November election.

The result also diminishes the likelihood of a much-anticipated reckoning over whether Trump should spend some time in prison as a result of his conviction .... Indeed, if the day ever arrives when Trump is sentenced .... he has earned himself a few months behind bars.

 
Absolutely. Sentence him when he is due to be sentenced, just like everyone else.

True, he is a convicted felon running for office while awaiting sentencing.
