A protege who beheaded his tech CEO boss knew he’d get caught but still planned the “most memorable birthday” for the French exchange student who took his virginity, an expert testified at his trial Wednesday.

Dr. Barry Rosenfeld, a clinical forensic psychologist who teaches at Fordham University, testified about the romantic relationship between Tyrese Haspil, 25, and his then-girlfriend, Marine Chaveuz, who he dated for two years and was living in New York City at the time.

Rosenfeld, who interviewed Haspil three times, testified as the defense’s expert witness in their attempt to prove that Haspil hacked up 33-year-old Fahim Saleh at his Lower East Side apartment in July 2020 as a crime of passion due to “extreme emotional disturbance.”

To prove the insanity plea, Rosenfeld was brought in to detail Haspil’s tumultuous upbringing and shed light on his relationship which Chaveuz.

Haspil has pleaded not guilty to first-degree murder charges which carry a mandatory minimum sentence of 20 years to life behind bars if he is convicted.

His attorneys are hoping that a jury convicts him on manslaughter due to his “emotionally disturbed” defense, which carries a lighter sentence of five to 25 years.

According to the defense’s expert, Haspil once stole $20,000 from a restaurant he worked at to fund a semester at Hofstra University. He attended in 2017 but dropped out a year later and by that point had already begun working for Fahim.

Rosenfeld, who interviewed Haspil three times, testified as the defense’s expert witness in their attempt to prove that Haspil hacked up 33-year-old Fahim Saleh at his Lower East Side apartment in July 2020 as a crime of passion due to “extreme emotional disturbance.”

As an alternative to the heat of passion standard, some jurisdictions apply the standard of extreme emotional disturbance. The Model Penal Code (section 210.3) states that a murder is downgraded to manslaughter when it was "committed under the influence of extreme mental or emotional disturbance for which there is reasonable explanation or excuse."

In New York, the offense of murder can be downgraded to manslaughter if it was found that the defendant acted in a heat of passion, which negates the element of malice required for murder. "Heat of passion" requires an inquiry as to whether the defendant was "obscured or disturbed" by passion that would cause a reasonable person to act from passion rather than judgment. Furthermore, for a defendant to have acted in the heat of passion, he or she must have succumbed to adequate provocation.

He definitely didn't succumb to any provocation, and this is clearly shown in the video of him attacking FS.

This was definitely a premeditated murder.

Fahim was murdered on July 13, 2020 and it was definitely premeditated.

On June 8, 2020, Haspil signed for a small FedEx package containing his new Taser Pulse that was delivered to his rental apartment. The manufacturer described it as "packing the same knock-down punch trusted by law enforcement," but "built with civilian self-protection in mind."

Fahim was tasered from behind and the manufacturer said it disables an "attacker", in this case a victim, for "as much as 30 seconds." That brief half minute wasn't long enough for him to finish the job without meeting resistance. The autopsy results suggest he regained consciousness, and fought for his life.

I just can't get over the cruelty of this monster.

premeditated by a brazen and cold thief turned murderer :mad:

A thieving protege who allegedly beheaded his tech CEO boss testified Monday that his mentor questioned his appearance before the attack – but didn’t immediately realize his life was in danger.

Tyrese Haspil, 25, was wearing a dark, plastic face shield with a baseball cap and sunglasses when he took a fateful elevator ride with Fahim Saleh in his Lower East Side apartment building in July 2020, the alleged killer said on the witness stand in Manhattan Supreme Court.

“He commented on my outfit. He said something to the effect of you’re really taking this COVID [personal protection equipment] seriously,” Haspil recalled to his attorney, Diane Ackerman of the Legal Aid Society, before confessing to the murder.
