Accused wife-killer pleads not guilty

"Jason P. D’Avolio, who is accused of killing his wife, maintained his innocence in his first appearance in County Court this morning. A not guilty plea was entered on his behalf in the death of Kerrilee D’Avolio.

Family and friends of Kerrilee D’Avolio filled the front row in the courtroom this morning. They wore bright green T-shirts to honor Kerrilee.

D’Avolio, 47, of 820 Belmont St., was arraigned before Judge Michael L. Dwyer on one count each of second-degree murder and concealment of a human corpse.

Authorities said D’Avolio shot Kerrilee in the back of the head with a bolt action rifle at their Belmont Street home, and then he put her body in a dumpster and threw the rifle in the Barge Canal.

According to his defense attorney, D’Avolio says he had nothing to do with Kerrilee’s death....

A plea offer was extended by the District Attorney’s Office. D’Avolio is scheduled to return on Oct. 2 to accept or reject the offer.

Accused killer rejects plea offer

"Accused wife-killer Jason P. D’Avolio has rejected a reduced plea offer of 20 years to life in state prison and will take his case to trial.

D’Avolio, 47, of Rome, appeared before County Court Judge Michael L. Dwyer this morning to reject the offer from the District Attorney’s Office.

D’Avolio is charged with one count each of second-degree murder and concealment of a human corpse, and he faces a maximum of 25 years to life if convicted at trial.

D’Avolio had appeared in court on Wednesday, Oct. 2, asking for more time to consider the plea offer. At that time, he was granted a two-week adjournment by Dwyer.

No trial date has been set. D’Avolio is scheduled to return to court on Oct. 23 for motion argument....

Kerrilee’s family filled the front row of the courtroom this morning, as they have done at every court appearance so far. The family and friends dress in matching bright green T-shirts."

Jury selection begins in trial of Rome man accused of murdering wife

Jury selection began today in the murder trial of Rome man Jason P. D’Avolio, accused of shooting his wife Kerrilee in their Belmont Street home and throwing her body in a dumpster.

The trial is expected to take at least two weeks, possibly more — and is the first major jury trial in Oneida County Court under the new COVID-19 restrictions.

In order to ensure social distancing during the selection process, only 39 potential jurors were called today in order to pick 12 impartial jurors and four alternates. If a jury is not picked by the end of today, court officials said another group will be called on Tuesday until they have a full panel.

Once the trial actually begins, half the jury will be seated in the normal jury box, while the other half will be seated in the public section, partitioned off from the room. There are only about four public seats for the families of those involved. The rest of the public — including Daily Sentinel reporters — will be in an overflow room watching the trial televised.

Police were first lead to D'Avolio July 29th of last year, when D'Avolio went to see his brother, Christian, at his job. Whatever D'Avolio told his brother made him so upset, he sobbed into his boss' shoulder, and the boss called 911, bringing New Hartford Police and Oneida County Sheriff's Deputies to his automotive business, in Chadwicks. Police brought Jason D'Avolio to the Oneida County Sheriff's Office for questioning about his estranged wife, Kerrilee D'Avolio's, disappearance.

D'Avolio said the two were having marriage problems, but said, with a chilling choice of words, that he still loved her.

Although the article mentions another court date (Jan. 12) I couldn't find anything further online, so perhaps it's been postponed due to COVID, like many other cases.

Jason P. D’Avolio was found guilty this morning of killing his wife, Kerrilee, and throwing her body in a dumpster.

The jury deliberated for roughly an hour and a half total between Wednesday afternoon and this morning before reaching their unanimous verdict at about 10:30 a.m. D’Avolio, age 48, of Rome, has been convicted of second-degree murder and concealment of a human corpse. He faces a maximum sentence of 25 years to life in state prison when he returns to court on Jan. 12.

Dwyer made the decision to adjourn two sentencings scheduled this month — of Brandon Clark and Jason D'Avolio, who both either pleaded to or were convicted of murder charges — because the protocol limits the courtroom to 10 people or less. Additionally, the families of the victims would like to speak at the sentencings, he said. It is not known when the new sentencing dates will be.

"It probably depends mostly on the pandemic," Dwyer said.

Jason D'Avolio continued to maintain his innocence even as he was sentenced to 25 years to life in state prison for the second-degree murder of his wife. The 49-year-old also was sentenced to an additional one and-one-third to four years for concealment of a human corpse for hiding his wife's body in a dumpster.
