According to the article he stopped drinking at 4.a.m. Friday morning, and caused the accident later that day.

I don't think this was the issue in this case. The defendant was wasted from drinking 18 beers the night before, was seen speeding across an adjacent parking lot, and careened into the nail salon after attempting to pass another car at a high rate of speed. This wasn't an elderly person hitting the accelerator instead of the brake.

I am finding it so hard to believe he was still that drunk from the night before. That looks like "currently drunk" to me.

Whatever the case, that video is so scary. He is a danger, clearly. That's no "opps" accident.
