Judge: Graswald's statements to state police can be used in murder trial

GOSHEN - A judge set a Valentine's Day trial date for Angelika Graswald, the Poughkeepsie woman charged with murdering her fiancé, Vincent Viafore, as they kayaked on the Hudson River . . .

In a decision handed down Friday in Orange County Court, Judge Robert Freehill also issued a ruling saying, in part, that Graswald's statements to state police investigators and almost all of the 11-hour video-recorded interrogation at the state police Montgomery barracks the day of her arrest may be used as evidence at trial. . .

Freehill set Feb. 14 for the start of jury selection, and noted that a large jury pool will be called. . .

Graswald will return to Orange County Court on Jan. 23 for a pretrial conference.

Freehill won’t allow one piece of the video statement: When a Russian translator enters the interrogation room at a state police barracks and speaks to Graswald (who is a native of Latvia), because the conversation wasn’t translated.

Other statements Graswald made to police before her arrest will be admissible if she testifies.

Graswald was in court on Tuesday for all of three minutes, after the Judgel, Senior Assistant District Attorney and Graswald's lead counsel spoke for several minutes in the judge's chambers. When they returned and Graswald was brought into court, the Judge announced that they had discussed scheduling "and other matters." The judge said the case will be back on Feb. 7 for a further conference and "all purposes."

A tentative date of Feb. 14 to start picking a jury was always subject to change, as Graswald's attorney has another lengthy trial starting in another county.

A new date may be set on Feb. 7, depending on schedules.

Graswald murder case rescheduled again

Angelika Graswald's upcoming murder trial has been delayed again.

A pretrial scheduling conference that was supposed to be held Tuesday is now set for Feb. 14. . .

The latest delay appears to be due to a timing conflict for Graswald's defense attorney, Richard Portale, who is handling another case in Westchester County Court that is ongoing this week, according to a court calendar.

Since her April 30, 2015 arrest, Graswald has been awaiting trial in Orange County Jail on a $3 million bail or $9 million bond.

Jury selection for Angelika Graswald's long-awaited murder trial has been scheduled to start March 13 in Orange County Court.

. . . Freehill said he will rule on a motion filed by the defense at a March 7 pretrial conference. It's unclear what the motion is, but it appears to relate to the Orange County District Attorney's Office.

Ultimately, the case will turn on expert kayak testimony. To convict Graswald of second-degree murder, or even the lesser charge of manslaughter in the second degree, prosecutors will have to convince a jury that the drain-hole—an opening the size of a penny—caused Viafore’s boat to take on water and flip. Even though the cockpit is a far more likely source for the water.

Here are eight decisions Viafore made on his own, each of which put him at more risk than paddling without a drain plug.

Wow...so many ways defense teams try to get their clients off of murder charges. I am sure it applies to other charges too. Wait, delay, file motions, delay and it is a never ending circle! I would like Justice served in this case.
