(Billy) Wagner was arrested at 1:18 p.m. in Fayette County, Kentucky, on Tuesday, he was reportedly hiding in the back of a Flying W Farms horse trailer. In a coordinated mission, teams of law enforcement fanned out to make the arrests nearly simultaneously: Angela Wagner was arrested at her Scioto County home at 1:10 p.m., George and Jake Wagner were arrested during a traffic stop in Ross County at 1:13 p.m., Newcomb was arrested at home at 1:25 p.m. and, at 2:19 p.m., authorities crashed through the padlocked metal gates at Flying W Farms and arrested Fredericka Wagner.

Rhoden family massacre: Arrests throw child custody issue back to Ohio courts

Jake Wagner did ask the court for temporary custody of Sophia six days after the homicides in order to seek medical care for her if needed, initiate the process for Ohio Medicaid and to enroll her in school, according to court documents. He was granted that custody in May and was also awarded full legal custody in June 2016.

Jake said he and Hanna started dating when she was 13 and he was 19, they planned the pregnancy of Sophia and they planned to marry on Aug. 27, 2015. Each had bands tattooed on their left ring fingers and he bought her an engagement ring.

“Then up and out of the blue she told me she was moving out and moving on with her life,’’ Wagner said in a May 31, 2016 interview. “She said she wanted a life of her own and still had a lot to accomplish."

They split up in February or March 2015, he said. He said in court records the two continued a “non-exclusive romantic relationship” until late September 2015.

He said he thought Hanna leaving was “just a phase.”

Jake Wagner also faces one count of unlawful sexual conduct with a minor when Hanna was 15 and he was 20.

Corrupt activity includes: Aggravated Murder, Aggravated Burglary, Unlawful Possession of a Dangerous Ordnance, Tampering with Evidence and Obstructing Justice, plus everything in Counts 1 thru 21. The indictment uses the qualifier and/or for these activities, meaning some could be guilty of one or all of these.
*Fredericka Carol Wagner (76) (Paternal grandmother) indicted (11/12/18), arrested (11/13/18), charged & arraigned (11/15/18) with 1 count of perjury & 1 count of obstruction of justice. Plead not guilty. $100K Surety bond.
Wagner was released from the Pike County Jail Thursday (11/15/18) night on a $100,000 surety bond. To be fingerprinted at Pike Co Sheriff's office. To have no contact with any members of victims' family. Will be under electronically monitored house arrest. Should not leave her premises except for consulting with her lawyer, medical appointments, however she must document in advance any reason to leave which must be approved. Must notify pre-trial services officer when she leaves. May leave for court hearing. Not to use alcohol or controlled substances, she may take prescriptions prescribed by licensed physician.

On Tuesday (11/27/18), Fredricka Wagner's attorney, James Owen, filed a motion to modify her bond "to allow her to leave her residence during normal work hours to travel to her place of employment."
*Rita Jo Newcomb (65) (Maternal grandmother) indicted (11/12/18), arrested (11/13/18), charged & arraigned (11/15/18) with 3 counts forgery, 1 count obstructing justice & 1 count perjury. Plead not guilty. $50K Surety bond. Arraignment hearing on 11/15. 11/20/18: Posted bond, released from jail.
DA alleges Newcomb lied to the Grand Jury & forged custody papers before the murders.
To place her under electronic monitor/house arrest. RN gives her mother's address. Court sets monetary bond at $50,000, will permit cash surety or 10% deposit. Will be under electronically monitored house arrest at her mother’s in South Webster, Ohio. To be put into PreTrial Services program. Can leave for medical emergencies, lawyer appointments, medical appointments. Must clear everything with PreTrial Services officer. Must keep PreTrial Services officer advised of her current address. With exception of medications prescribed by licensed physician for her, not to consume alcohol or controlled substances.
 
Defense attorney pushes to move Rhoden family murder trial

"Collins said investigators have labeled his client the mastermind of the murder plot but said Wagner has a seventh-grade education and no serious criminal history.

Investigators in Pike County have charged Billy Wagner, his wife Angela, and the couples two sons, George and Jake Wagner, with aggravated murder with death penalty specifications. That means each defendant must have his or her own jury when their case goes to trial. Collins said seating four fair and impartial juries in Pike County could prove impossible.

"You're hearing about people who have such a divided opinion as to what's happened, or what potentially might have happened, or the reasons, or the motives," said Collins.

Collins said in Franklin County, it's not unusual for attorneys to dismiss hundreds of potential jurors in a capital case before settling on 12 men and women.

Franklin County has a population of nearly 1.3 million people. The population of Pike County is just over 28,000 people.

Collins said it's possible to seat one fair and impartial jury, but said whittling the jury down to 48 men and women who can set aside their opinions and serve as fair and impartial jurors is extremely unlikely, but is it impossible?"
