"A filing with the Pike County Clerk of Courts reveals prosecutors have provided Wagner's attorneys with several pieces of the case: 911 calls; 1,475 photos of the crime scenes; diagrams of the scene showing ballistics and other evidence including biological; evidence logs; 111 aerial photos; autopsy reports for all eight victims including x-rays and a combined 761 autopsy photos; recorded interviews with the Wagner family including five with Jake, the first being from May 13, 2016, and last on May. 21, 2017; and also 23 photos of Ruger Rhoden at the hospital from April 22, 2016, the day of the Rhoden murders when the 6-month-old was found covered in his parents' blood."

Jake Wagner appeared in Pike County court today for pretrial hearing

"When one of the prosecuting attorneys brought up a desire to make sure it was on the record that Wagner was allowed to wear civilian clothes in court for this hearing, and the judge mentioned that it was his intent to mention that on the record, Wagner who was not being directly addressed at the time again smiled.

Another topic discussed was a desire by the defense team to restrict who was allowed to talk to Wagner in jail.

There is already a gag order in place for the family and attorneys; this would be a restriction on communications with people Wagner may be exposed to behind bars as he waits for his trial to proceed.

This is one way to limit other inmates attempting to get information through talking to Wagner in jail.

Finally, as the hearing came to an abrupt close, Wagner’s normal blank expression changed one last time.

As the judge swiftly concluded things with nothing else to discuss at this time, he adjourned the hearing and Wagner’s expression shifted to what could be described as a surprised frown."

"Since his arrest on aggravated murder charges, Wagner has been housed at the Franklin County Jail in Columbus. His court-appointed attorneys filed a motion to restrict who can and who cannot talk to Wagner about the case. They say they’re trying to protect his right to a fair trial.

Wagner's attorneys don’t want him getting into casual conversations and find that winding up as evidence in court. The motion covers prosecutors, law enforcement officers, social workers, psychiatric personnel, corrections officers and jail personnel."

7:15 - 7:53 am: Sometime after discovering the bodies, Billy Jo Manley calls her brother James Manley. He and his son go to the home of Dana Rhoden and discover she is dead. According to his wife, James doesn't go further into Dana's home, though he can see her legs and hear a baby crying.

8:07 am: Deputy Chandler arrived "at a neighboring residence where he was flagged down by a subject. Deputy Chandler advised that he needed multiple ambulances due to multiple down at multiple residences."

FCSO later retracts the statement. Rhoden family 'trying to process' arrests of suspect in killings

Scrutiny of the Wagners seemed to ebb and flow, they said, until an explosion of activity early Tuesday.


“Big vans, sheriff’s trucks all heading up there,” said one of the men, who said he want to school with Chris Rhoden Jr.

John “Ozzy” Osborn, owner of Ozzy’s Barber Shop in Waverly, said the arrests seemed to take the case full circle. The volatile relationship between the Rhodens and Wagners wasn’t exactly a secret.

“Those two families were tight — until they split,” he said.

Fredericka Wagner's attorney argues for full transcript of her grand jury testimony

Wagner, who pleaded not guilty to all charges at her arraignment in November and was placed under house arrest, appeared before Judge Randy Deering on Thursday, where Wagner’s attorney James Owen argued that his client should be provided with a full transcript of her testimony before the grand jury.

Special Prosecutor Angela Canepa said that is not typically handed over by prosecution without a court order.

“I believe the agreement today is that we will draft an order for the court which permits the state to transcribe the portion of testimony that relates to the perjury and then I believe that we will be briefing as to whether or not they are entitled to other portions of that testimony,” Canepa said.

Owen cited a rule and stated that the defendant is entitled to any written or recorded statements by the defendant including grand jury testimony by the defendant.

Owen said that the defense would like a trial date as soon as possible and asked that they be provided with all of Wagner’s testimony and not just the portion offered by the state. He also mentioned the context of the grand jury questions, stating that Wagner does not have good hearing and indicating that she may have had difficulty understanding the questions.

Canepa indicated that the state can have their brief on the matter filed by the end of the month.

The defense can then respond to the state’s brief prior to a ruling.

Next pre-trial hearing for Fredericka Wagner is scheduled for March 28.
