Great evening. Can someone more knowledgable help me understand something:
If JC was brought in, wouldn't the police have to have evidence? Just wondering because she hasn't been found so we really don't know yet what happened.
I was wondering if the police could keep someone without charging them of a crime?
This is all hypothetical -- was just wondering how that would work. Please advise and much thanks!
Okay, done eating - so I will take a crack at this.
1. Do not need a body for a murder charge or even to win a trial - but it sure helps.
THAT SAID -- yes, the would need evidence of A CRIME.
2. As happens many times - People can be arrested for a related crime or unrelated crime, such as Lying to Law Enforcement (hehe- KC Anthony is example!) so, even if the RUMOR (not mine) were true, the next question would be what are the charges!!!!!!!!!!!!
As far as police 'keeping someone without charging them' - if they say they want to leave, unless under arrest I believe they are free to go.
