It could have been a 25 caliber, 32 caliber, or a 9 mm caliber anything bigger with being Shot 3 times to the Head would have meant closed coffin funeral, and the only one of the victims that had to have a closed coffin funeral was Little Hannah Gilley, which was a-shame because she was a pretty young woman, JMO

The prosecution has indicated if you enter a plea of guilty to this amended charge in exchange for other cooperation with the State, the State will make certain recommendations. There is no agreement as to the penalty but they will make recommendations as to dismissal of counts 1,2,3 and 5 and will also have an opportunity to argue at the sentencing hearing what penalty the court should impose for the 2nd Degree Misdemeanor you plead guilty to, your attorney will also have the opportunity to make argument.

Deering then made it clear that the court could impose a different sentence than what the prosecutors recommend.

Rita then plead guilty.

After that:

Bond is discussed. She will remain on bond and continue to report to her community control officer but Canepa released her from house arrest and the ankle monitor. She will go to jail if she doesn't comply with her bond requirements.

She was told not to have any contact with the victims or any of the defendants and Gerlach - her attorney - asked if that includes Fred because her charges were dropped, and Deering said yes it does include Fred. Gerlach also asks for the recordings from the GJ even though he acknowledges that he has the transcripts.

I always thought that there was a sealed envelope that contained an agreement that RN signed to testify against the W4.

There is an agreement she signed but if she refuses to cooperate then Betty is correct that the prosecutors will not try to get her charges 1,2,3 and 5 dismissed or get her a lower sentence. In essence, she will have voided her cooperation agreement. ( I amended my previous post to reflect this)

If people don't complete their end of an agreement then obviously the prosecution is probably going to charge them.

Not sure about that. As it stands now, when the 4 Wags trials begin, she will testify. If, at the end of the trials, her testimony is no good or if she holds anything back, she goes back to jail to serve her sentence.

ETA: AC's recent decision to leave at this point, handing the cases off to a team of special prosecutors indicates she's had her talks with RN and determined that her testimony has helped give them an even stronger case against the 4Wagners. JMO, she probably felt now was a good time to leave as the prosecution has organized strong cases and it's smooth sailing ahead.

Pretty sure RN had to supply the prosecution with enough good info for testimony before they agreed to a plea bargain. This was probably negotiated before RN's last court hearing.

Huh???? She bought herself some time when time was worth the most. Free as a bird, and would risk my life that her and dear old Angie have been talking galore. SMH who believed that crap. I can hardly wait till her trials heats up and blows the lid off the Dailey files. JMO

Honor system (with rules) unless you are a licensed dealer. If you sell then you need to check their drivers license and make sure they live within the state and proper age. You are not required to write the name down or their license number.

A licensed dealer (even at a gun show or flea market) has to run you thru the database before they can sell to you...ditto with internet (you pick it up at a licensed dealer).

No tracking of ammo that I know of (but might be on certain types of ammo).

That's what I think that I know.

IANAL, but yes. Seems likely there's a formal agreement that RN is giving them X information and will testify about Y & Z, etc.

Yes!

Bruce Daily will be an important witness and I don't think this can be understated. If the prosecution can prove that the Wagners were "desperate" for custody it will be the motive that the jury can relate to. I believe the jury will need to understand what the Wagner's motive was -- and child custody is a strong motive.

I believe that motive has to be proved in these Wagner 4 cases. If the jury sees no motive, then they could acquit the Wagners on some of the charges. Just opinion.

Side note -

Imagine your on the jury and the defendant is accused of 8 murders!
You would need to see a strong motive for this. I would, if I was on the jury.
Motive means everything in the Wagner Cases, more than compared to most other cases (is just my take on it).
