If you're talking about the BPVs, I believe the defense asked the Special Prosecutor what the "origin" of those were...i.e., where they came from. In other words, he was digging for information. JMO

Even if they lied to her about the reason for the purchase, why would she lie to the GJ about buying the BPV's and having them in the house?

We wont know for sure until trial. There is a million different possibilities.

They already have that info, IIRC. It's been turned over to them in discovery. Defense is asking to see the transcript of the GJ testimony of FW.

They argued they’d requested transcripts of Wagner’s testimony in front of a grand jury that happened before they were hired. The attorneys argue the transcripts will provide context of Wagner’s answers and the questions asked during her testimony.

FW's attorneys aren't arguing about who purchased the BPV's, they're trying to say that FW had a hearing problem and may have replied in error. Her reply is what they're questioning.

They'll need to prove that, though, but they have plenty of time ahead of them as this case proceeds.

Owen also brought to light that Wagner’s claims that she has impaired hearing and was having difficulty understanding questions at the time of her testimony that he says led to the obstruction and perjury charges.

Canepa argued Owen had not requested transcripts, but confirmation on the testimony leading to the charges against Wagner. She said she handed over a disk that contained the contents of the demand for discovery Thursday morning.


Owen requested a transcript be provided as soon as possible and the judge set a deadline of Jan. 31 barring any delays.

The judge said he may need time to review the transcripts before they are made available to the defense.

I'm beginning to get an idea of how FW's attorney, James Owen, operates. He doesn't make a request for something to the prosecution until he's in the courtroom. Then he makes a big dramatic play for the camera to make it seem like the prosecution is doing something wrong. Oy. What a pro.

Listening to a crime being planned and not reporting it to LE might be a crime. Planning to kill the Ohio AG and county sheriff would be considered a crime in most places. JMO

Have you ever heard someone say “I could just choke so n so”? It is a crime to choke someone, so are you guilty of not calling the police? Ever rode with someone who ran a red light? Did you report them? If not do you believe you committed a crime?

If you say you want to hurt me to me, then you can be guilty of terroristic threats. If you tell your friend you want to hurt me, it is speech only.

Unless the plot to harm someone contains some action, not saying harm itself, there isn’t a crime. Other then threats to harm the president, discussing revenge isn’t a crime. Bad at it may seem.

I don’t think they stated what the lie was. Just that it was regarding 2 bpv found in her sons room at her home. The defense did ask to see the receipts for them and the defense said if the prosecutor even has copies of receipts for them. Jmo

Not according to Owens he stated he had asked for stuff weeks ago. The other day I forget which hearing maybe George but I got the feeling the prosecutors are really trying to drag their feet when it comes to turning over evidence. Jmo
