Why was not bond revoked on the spot? I don't understand the need for a hearing. She did or didn't accept calls. If she did, bond revoked...

Here's the reason bond was not revoked on the spot:

As is pointed out, above, there are 2 things wrong with what Rita did:

#1. She had contact with Angela.
#2. She actually discussed the case with Angela. ( I assume they discussed their court cases but won't know for sure until the hearing.)

I wonder if Rita refrains from contact with Angela between now and August 28, if she will remain on house arrest?

If she does accept any calls from Angela -- Delaware County Jail Inmate -- between now and August 28, I am %100 sure her house arrest will be revoked and she will be remanded to jail.

I totally agree! Judge Deering was way too lenient on her today. IMO, actions speak louder than words, in both hers and his. She was clearly in violation of her bond, and JD gave RN nother free month to continue talking to AW. What a shame, IMO. And great disrespect to the Proecution on the Judge's part, IMO.

The description by Canepa, of the phone conversations, sounds incriminating and very deliberately done by both---they admitted as much. Those conversations were not a simple "mom I had to hear your voice and how is grandma doing?"

And those conversations were not a "one off," not just a couple phone calls, sounds like quite a few.

For these reasons I think there is a 75% chance Rita will end up back in jail.

If she stays out of jail I'm guessing it would be because she is her mother's care giver.

We still have a Media & Timelines thread back in the Crimes In the News section where we've been storing video, news stories and copies of documents related to the a arrests and pre-trial hearings of the Wagners.

Here in the Trials section, we have the opportunity to create a new reference thread for court docs related to the Wagner family trials. We can post one thread for all the trial docs for the 5 defendants or we can see about posting separate reference threads for each defendants. What do you think? How would you like to see this information organized as we get closer to trial time? There will doubtless be many pages of evidence, filings and trial transcripts.

My suggestion:
One running media thread for all of us to post documents/links to. And a 2nd thread that summarizes information by month. Kind of a cross reference, like the one I did to connect past threads here.

"Bond for the Pike County grandmother still facing charges in connection with the brutal, execution-style murders that claimed the life of eight members of the Rhoden family in April 2016 may be revoked if the state of Ohio gets their way, our partners at FOX 19 reported.

Pike County Prosecutor Rob Junk and Special Prosecuting Attorney Angela Canepa filed a motion to revoke the bail of Rita Newcomb during what was supposed to be her final court appearance Thursday afternoon.

They say Newcomb has been talking to her daughter Angela Wagner, who is one of four members of Wagner’s family charged with murder in the slaying of the Rhoden family...

The judge acknowledged that a violation of bond is a very serious offense and reiterated to Newcomb that ‘no contact means no contact.’

He set a date of Aug. 28 at 1 p.m. to discuss that motion and the three other remaining motions.

All parties also agreed to set a date of Aug. 5 as a deadline for filing pretrial motions.

Rita Newcomb is charged with obstruction of justice, perjury, and three counts of forgery.

I would think the separate threads for each defendant would be more efficient as far as accessing information during the course of each trial since they will all be conducted at different times. One thread for all 5 would leave us searching through previous trials to find the one that is going on at that particular time.

Piketon police chief Jim Nelson was voted in as the interim sheriff by the Pike County Democratic Party committee at a special meeting at Piketon High School Thursday night.

The move comes after Charles Reader was suspended from the office earlier this month after a grand jury returned a 16-count indictment against him. Reader is accused of theft in office and tampering with evidence, among other crimes.

Because Reader ran and was elected as a Democrat, the party had to decide who would serve as the interim sheriff.

Nelson will start as sheriff immediately. It is unclear how long he will serve as sheriff.

Reader’s next court date is scheduled for Aug. 12.

So Rita who claims she is too broke to pay for anything was accepting expensive collect calls from an inmate in the county jail? Which by the way she had to agree to accept. So by my reckoning it went something like this, Computer generated voice: "This is a collect call from an inmate in a *advertiser censored* county jail will you accept the charges?"Rita: "Yes". So according to her she didn't have caller ID so if she didn't know it was Angie calling her, then who did she think it was? Just how many people does she know who is an inmate in *advertiser censored* county jail? JMO

True - when my relative was jailed, every call was very expensive - shockingly expensive, and collect, which I had to agree to, to accept the charges. It wasn't the phone company either, nor the government, but the prison contractor charging the calls - which were recorded - which was mentioned each time, when the spiel asked if I would accept the call.
I just say this because that's why I don't believe RN didn't know the call was from AW. The thing is, the judge, prosecutors and defense attorneys all know this, as well.

Wasn't the sheriff before Reader suspended too? Henderson or something wasn't it? I forgot what he was suspended for. Isn't that why Reader was sheriff when the murders occurred? Strange two sheriff's one right after the other suspended. Then bringing in another LEO from the area to replace them. Maybe Pike county should go out of the area for their next sheriff?

The murders took place in Pike County and Scioto County (DR's house was across the Scioto County line). So, yeah, the prosecutors undoubtedly took all that into consideration when the drew up the indictments.

As for Fred Wagner, she has properties all over the place, in different counties. Who knows where she actually lives on any given day. Actually, as long as she doesn't try to skip town, who cares?

The state has strong evidence against RN. It's nearly an open and shut case, JMO. She forged those documents. Her attorney doesn't have much more to work with, but he has to do his job and ask for dismissal on whatever grounds he can come up with. It's what he's being paid to do.

JMO, but it shouldn’t matter that the documents state in Pike Co. Actually it even supports AC’s case. If she can prove HR was in Pike Co at the time the docs were forged in Scioto Co OR she can prove AW did the forging of all 3 docs while in Pike Co but RN claims she witnessed and was in Scioto Co then that supports the case.
 
What's strange to me is the "Preapproved" list. Is that per the prison or inmate. Certainly doesn't seem to be by Court Order (Gag Order).

The pre-approved list is for the people the inmate wants to talk to on the phone or the people the inmate wants to have visit. You have to be pre-approved to communicate in any way with an inmate:

Phone, skype, e-mail, letters, in-person visits.

Who CANNOT visit:

-former inmate of any correctional system
-anyone who is currently under probation or parole supervision
-any current inmate in pre-release or SIP status
-any current or former COUNTY employee
-any current, active volunteer of the COUNTY
-any current or former contract employee
-any victim of the inmate
-any visitor who has had his/her visiting privileges suspended
-any visitor that has an active PFA against them

For an inmate to be visited by anyone who is not permitted, the inmate must initiate the request to have a prohibited visitor added to his/her visiting list, and a recommendation must come from the inmate’s unit team. The facility manager or designee may permit such a visitor depending upon the approved COUNTY process.

Individuals whose visiting privileges have been suspended may write to the appropriate facility manager seeking reinstatement of their visiting privileges. Reinstatement is not guaranteed.

I think one thread per trial and we can reference common things back to another trial. I think keeping the 5 together would be confusing and extremely cumbersome. JMOO.
