This business of OP's mental health deteriorating.

Well, if I'd "accidentally" murdered someone I loved my depression and grief would be immediate and total.

What has happened over the last few years that made his depression worse? He didn't get away with murder (as he hoped) & has had to face the fact that pretty much everyone has seen through his lies and detests him.

Thus proving that his devastation is entirely about himself and always has been.
 
Oh...and a high-five to the person who announced in a grocery store that they didn't want to shop with a murderer :)
 
The stupidity of these proceedings is breathtaking

Scholtz says he spent 27 hours with Pistorius and it was not his impression that he was violent and aggressive.

Judge Masipa intervenes: she wants to know more about the prison psychologist report.

It says that at the beginning he struggled to adapt to prison life and was verbally violent, she says.

It doesn’t say anything about him being violent in nature.

Scholtz agrees: I am happy with my view that he is not a violent man.

So not apart from

1. His murdered girlfriend
2. The time he assaulted a woman at a party
3. The time he fired a gun in a restaurant
4. The multiple documented incidents of abusive behaviour
5. The time he got in a fight with his dodgy associates
6. The nightclub incident

Was all this evidence in court?
 
"He believes that his life is in the hands of God and that he will be used in some way to make the lives of others better. He has found some solace in the fact that the deceased is with God."

He could make lives better by being a man and serving his time in prison.

And how thoughtful that he has found solace that the girlfriend he murdered is with God. Considering he is the sole reason she is no longer with her family after dying in a hail of his bullets in the toilet, I'm surprised he has the nerve to even say such a thing. No wonder they didn't want him on the stand.

Maybe part of his deteriorating health is due to the fact he thought he could string this out indefinitely, and now he knows he's at the end of the line with no more 'get out of jail free' cards.

I guess this is why he took himself off on a holiday away from OP at Christmas and then went on a holiday to India for the entire month of April. Not to mention Aimee moving to London a month ago.

Once again, the focus is taken away from his victim and his horrific deed, and it all becomes about him, his reaction, his PTSD, the media, his future children etc.. He is the new victim of his own crime, blah blah blah. No other court would entertain this.

He's not so ill that he's needed hospitalisation or consultations with his doctor in the last 6 months. He should have been denied bail and detained for evaluation by prison medical staff. The court can't rely on the defence witness for this information - without the State also having access to him and an input in the assessment. The court should order another psychiatric evaluation of him if they are to consider sending him to secure hospital instead of prison.

And as for delivering their report at the 11th hour. It makes me really mad that they're allowed to pull off these stunts without rebuke.

..Hi again all, what's this i've been hearing on the tely there's talk of sending Pistorius to hospital instead of prison saying he's a broken man etc etc......well what i see is someone who doesn't seem to be putting up much of a fight after being called a murderer, after all if one is innocent....!.....what a farce...

Agree. But in all honesty. It doesn't matter where he goes. Jmo.

Because I'm fairly sure that Uncle Arnold has or will donate big money to any facility to make sure that Oscar has the best of the best room and food and leniency and privileges and accommodations that any facility has to offer.

Oscar will probably also have a 2000sqft furnished wing all to himself as well. Lol.

Massipa is fake. She has already heard these pleas and reasons the last time before she sentenced him to basically 1 year.

So why does she need to hear these pleas again?

This is bull crap. Why can't she just sentence him to the mininmum with some time already served and let him deal with the parole board whenever he is eligible. Jmo.

But also. Since the court said that they will appeal anything less than 8 years. This tells us that Massipa will give him 8 years with 2 already served. Meaning he has 6 years left to serve. But he will be eligible for parole in a year and a half. Jmo.

She really doesn't want to re-sentence him at all. But since she is being forced to. Then I'm sure she will give him the best sentence.

So to us. Oscar get 8 years. But in reality. He will be out this time next year. Jmo.

What a farce.
 
If Masipa factors in depression and being 'broken' as a reason not to send that killer back to prison, then all murderers must be entitled to avoid punishment just by saying they're 'broken'. Telling Nel that the "aggressive and verbal" abuse directed at staff was only at the beginning" shows the lengths she will go to in order to defend a convicted murderer. But hey. This is the same person who reduced Reeva to being "good in front of a camera" and downplayed all the abusive texts the killer sent Reeva. She has about much sympathy for the victim as OP does.

My main hope springs from the State making it quite clear that they will appeal any sentence considered lenient in relation to the crime. If MrJitty sees this, do you think that that knowledge will play into Masipa's sentencing or will she just go her own merry way? I wouldn't have thought she would want to be overruled again.

I remember before Masipa confused everyone with her original illogical verdict that one of David Dadic's tweets (or maybe James Grant, before he was involved) was that "word in the legal corridors" was that he'd get 10-12 years. So presumable DE with mitigating factors even before Maipa's hideous bias was exposed. . So maybe the prosecution are thinking 10 years minus some for time served etc.

I agree it's not enough but Nel and Johnson will know the South African system better than us and will know what is realistic.

I also agree the whole thing is farcical - Masipa's probably already made up her mind

Yep, pretty sure that is what the Asst Prosecutor said but she also said they would be going for the 15 years. Tried to quickly find a link but now that the hearing has actually started that is dominating the news. But I know i read it somewhere.

Agree with your reasoning as it does invite a sentence roughly half the minimum. But who knows, maybe that is just a bit of a bluff to ensure that there is no offensively soft sentencing. And, the defense have to provide 'compelling circumstances' to reduce the 15 year minimum and if today was any indication, they have thus far failed. I am very much interested in seeing the witnesses and arguments that the State will put forward as their aggravating circumstances. Shame that the Pistorius family attitude can't be included as an 'aggravation'. :)

That was quite the "Palace" that Uncle Arnold built for OP's last prison stint! (sarcasm) :smile:

FYI, many people here have researched or already knew the specifics of SA law. IIRC, on a conviction of Murder the convict is required to serve 75% of his/her sentence before any application(s) for parole can be filed.
