This is a big fear of mine for my boys, especially that is 19 and is in the military.
 
Are there any states that have laws that have some kind of protection for the "offender" in situations like this? For instance, the two individuals have to be within a certain age of each other (i.e. 2yrs 4 months or something) for it not be considered a sex offense? It just seems so unfair in so many situations :(.

Most states have laws like this (either 2 or 3 years is generally the allowance, I think). The issue here is that she lied about her age (or at least, that's what Tyler is claiming). She said she was 2 years younger (which would be presumably OK), but actually, she was 5 years younger (not OK).

On the one hand, I feel so sorry for this young man. From all I've read, it appears he was utterly deceived - and he's the one in trouble for it.
On the other hand, it infuriates me that GIRLS who lie about their age NEVER receive any kind of punishment for it when they darn well deserve it.
Yet on the other hand (y'all didn't know I had 3 hands, did ya?) Crap like this would never happen if young people would actually take the TIME to get to know each other first. Meet the parents, meet the friends, and truly get to know the person before jumping in the sack. 100% avoidable.

Yeah, good luck with that. Telling a young man like that to slow down when he finds a girl who's "hot to trot" is like telling water not to be wet.

What I meant was, doesn't the felony come with Megan's Law by default? It is just odd to offer a misdemeanor or a felony, then switch which one lands him on the list.

No. It's much better to have a felony than be on the sex offender list. Being on the list will destroy a person's life well beyond a felony conviction! These cases are so difficult for me.
 
I have a 20 yr old son. He is what girls called a "pretty boy" in high school. So when he turned 17, I started the statutory rape conversation. It's very scary bc he was a November baby he was always oldest in his class. I was always scared of this. I brought that up so much that now if I say "well how old is she, don't"...he says mama come on I'm not an idiot lol As far as I know he hasn't dealt with this situation. But girls these days are far more aggressive, I'm not that old but they are much different than they were 20 yrs ago when I was in high school. They look older too. Is it just me or do they act & look older at a younger age? More sexually aggressive too?

Yes, that' also my impression. I'm in my late 20s now and I can't believe how some 13 and 14 y/o girls dress and act like today. They also look so old, seems like many of them can pass for 20 easily.
 
I think a huge part of the reason teenage girls look/act older than they are and also lie about their age has everything to do with the "psychology of likes" behind SM. The older they look, the prettier they look, the more outspoken/opinionated they are, the more likes they get and the more they get noticed. It's like an infection that just keeps spreading. Then it definitely plays out in real life as well. My youngest daughter is 13 (and doesn't even wear make up, yet, thankfully) and some of her friends look like they're 20, but they're all around the same age as her - between 12 and 14.

I've noticed (as I'm sure many others have as well) over the years the missing teen girls we see here (10-13 yr old age group) fellow WS members leaving the exact same comments: "she's HOW old??" It's not really a new thing, but it seems like it's becoming more frequent.

Great post, so true, Ontario Mom! All these young girls posing on Instagram almost look the same (Kardashian-like makeup), butt sticking out...ugh.

They really are - we see so many cases here where the girls are 12-13 and look 5 years older, at least in their selfies. The internet is really accelerating the rate at which young people gain knowledge these days, including how to manipulate their identities to get ahead. Its just an unfortunate side effect of the kind of society we are in currently, especially when their role models are so highly sexualized. We had our share of acting older and getting into trouble with older guys in the 90s, but it wasn't played out in a public arena where we could score klout and get fueled by the attention gained from such a large and mostly anonymous audience.
 
I'm a little shocked that people here are siding with/relating to/sympathizing with a convicted child rapist? it's relatively rare for a girl to go ahead and actually press charges if you look at rape statistics compared to conviction rates. How are you all so sure that this 14 year old child lied about her age and looked older than she was when the only information you're getting is from a criminal's whiny facebook posts?
 
Claiming that a girl lied about her age is the oldest trick in the book to evade child rape charges and I can't believe everyone is buying it, honestly.

Before you've been through such a situation I would ask you be a bit more empathetic to these guys as many have shown. It happens all the time. The girl doesn't have to press charges. She can say she lied, etc. The State goes after them! While the boys lives are turned upside down and their futures are basically shattered before they've even begun the girls face no consequences.

OMG this sounds just like my talks and exactly the quote ("I'm not an idiot Mom") I got as he would leave to go hang out with this girl because I was always so nervous with my sons meeting friends that they had met out and about and had established a texting friendship with. There's no age there for sure typing...and in our case the girl was very sexually charged (I printed over 1000 pages of smut she had posted) and we were gobsmacked when the bounty hunters -7 of them- showed up during the night with a felony warrant for my 17 year old son (scariest thing ever...they showed up 3 times during the night harassing ALL of us). While my son and our family went through 6 years of absolute HELL (lawyer/court costs costing enough to buy a house) he is now trying to live a happy life, but there are some challenges he will always face. The girl I might add seems to have continued on with her life landing an undesirable job no parent of a daughter would be too happy or proud of.

I think if the girls faced consequences they wouldn't be so quick to seek out these older boys and/or lie about their age. It's truly beyond tragic. There is no stat rape charge in many states...and you can't take it to trial because NO evidence is needed but the girls word. It sounds twisted and sick because it is. A spiteful girl can just say they had consensual sex....his life is destroyed!

ETA: sorry to rant off topic, but this really isn't off topic. Tyler isn't missing...he's scared.
