I wonder, was the lawyer correct or the judge? Judges do make mistakes. That is one reason the right to appeal exists. Philosophically, I believe that the true wrongful death trial doesn't happen here on earth. The justice we may or may not witness here and now just doesn't hold a candle (IMHO.). Still, I would sure like to see it.

Civil case against Mark Redwine tossed out; ex-wife says criminal case will move forward

POSTED 2:09 PM, FEBRUARY 16, 2016, BY KEVIN TORRES

"“We are very disappointed with the judge’s ruling as we could not confirm the remains were Dylan’s until they were positively identified as Dylan’s later,” Elaine Redwine told FOX31 Denver in an exclusive interview.

“We will continue on with the criminal case.”

Although the civil lawsuit has been tossed out, the criminal case is moving forward, she said."

"In November, Mark Redwine's attorneys
filed a motion to dismiss the case, claiming the statute of limitations expired six days before his ex-wife filed the lawsuit on June 29, 2015."

Snip

"The lawsuit was officially dismissed on Dec. 28, 2015. However, La Plata County officials tell KOB they are still investigating Dylan's death and say Mark Redwine remains a person of interest in the case."

Wow, did Mark Redwine luck out on the dismissal... Four days, geeez. Poor Elaine. This must be soooo hard on her. So close, yet so far. We need justice for Dylan and family. Breaks my heart that Dylan would have been 17 years old.

I wonder how many days after 'finding' his remains, the remains were determined to be Dylan and does that even matter ? I guess not. But iirc, everyone assumed it was Dylan, but it did take some time to make a positive identification. Either way, I agree it would have been hard on Elaine but I feel like she wants to see SOMETHING and at the rate the criminal case is going, this was her only chance to have a legal ruling somewhere on this earth that MR was responsible. Let's face it, it was not for the money .

Just curious. Can this judges ruling be appealed? It seems as if Elaine is accepting this ruling as final.

We all know life isn't fair. But this, this is beyond heartbreaking.

ETA: just read the article Margarita posted above. Elaine said she couldn't file earlier because they had to wait for the remains to be positively identified as Dylan's. Why should Elaine be penalized when it was out of her control as to how soon the remains were identified? Shouldn't this have been taken into consideration?

Why wouldn't the statute of limitations begin at the moment they were ID'd as Dylan's and NOT the day they were found? That makes no sense ! I'd be appealing it for sure.

I'm totally with you and EmmaRose. It makes no sense.

Right. And with a civil suit, MR would be deposed.

Infuriating!!!

But there's more than one way to flog a dead horse('s *advertiser censored*)!

Two years statute of limitations for a wrongful death civil suit??????

I don't know if that is common amongst the states but that seems awfully short, IMO.

Still praying for justice for Dylan.

To my knowledge, two years is the limit on any CIVIL suit. It doesn't matter what type.

''State lawmakers on Monday advanced a measure that would make tampering with a body a felony – an effort strongly supported and advocated for by the mother of Dylan Redwine.
The bipartisan bill is being pushed by prosecutors and the families of murder victims, who say tampering with a body should carry a stricter penalty than tampering with evidence.''

God bless you , Elaine !

She says ' new information, new evidence'........

ETA Big thanks to Dr Phil for his interest in Dylan's case. He does update it pretty regularly and it's appreciated.

Oh, I can't watch the video right now do didn't see that. What could it be?!? What could she reveal on tv that wouldn't already be released in the press? Maybe there is something new so she can allude to it but not give out the details. Hmmm...

"It's a sign."

Dylan Redwine's mother, Elaine Hall, was at the Governor's office today. As she left, looking up at the ceiling in the chamber hallway, she saw this single blue balloon floating above her. Blue was Dylan's favorite color. "It's a sign," she said.
