My question is WTH is the holdup? Who's dropping the ball here?

I won't be able to take it if he's set free for lack of prosecution. :(

Good question, suzihawk??!! :maddening: I truly believe Stephanie's father will NOT let that happen though!

I saw something about this last night on one of the "news" shows...Vinnie Politan I think. They were interviewing a reporter from Peru I believe who told them that the language barrier is still an issue, because while Joran can understand basic Spanish, he can't understand formal "legalese" when it comes to a trial. I guess they have yet to find a translator that will be able to sit in with him during a trial? She also indicated that they have case files backlogged so bad that they are literally stacked in the offices from floor to ceiling. They do everything manually and everything is handwritten. No computers are used.

I pray you're right, Niner!

Hi Kamille... well, I'm not buying the language barrier BS. I think the only time Joran doesn't understand the language is when it's convenient for him not to.

As to the backlog... that's a pathetic excuse. So I guess every criminal only has to sit back and wait out the 18 months to be set free? That's crazy. I hope people including media and Stephany's father make enough noise to see that this case doesn't fall through the cracks.

I'm still licking my wounds from the Casey Anthony case. I tell ya, if Joran walks out of that place a free man it will be more than I can bear.

(Waving to my friend, Epiphany. :seeya:)

I agree about the language issue suzihawk. As you can see on the video that FLNY just posted, he is obviously reading legal documents that were prepared in Spanish. So his lawyer complaining about the language barrier is just a ploy to make them find a translator when they know that there is no official Dutch/Spanish translator in the country.

I also had the impression from the interview that while he may be released, he could still be charged. Releasing him was only because the charges have not been filed and a trial date has not been set, kind of like being out on bail. So if that happens, is he required to stay in Peru awaiting charges? And when would the FBI be able to get their hands on him for the charges they have pending on him? Would he be able to flee to a country where the FBI couldn't extradite him?

The system is so corrupt down there that I wouldn't be surprised to find out that someone is being paid to sit on that file IMO.

And speaking of that video...he's definitely packed on quite a few pounds FLNY. I think we've heard about how they can get pretty much anything they want in prison if they've got the cash to buy it so that is not a surprise to me.

MOO

Oh man, imagine if he gets away again, can't even go there.

Do they have to just file formal charges by December or does the trial have to be over by December? I heard yesterday on one show that they had til December to file the charges. But different people say different things so who knows.

If they let him out but he has to stay in Peru, I don't think that's too good for him, he's better off in jail than waiting it out in the streets of Peru. Don't see him being too safe there on the street. I don't want him murdered, I want him to sit in prison for a long long time for both Natalee and Stephany and if he left behind anyone unknown victims.

JMHO

Pardon my French, but that is BS! He doesn't need a Dutch/Spanish translator. An English/Spanish translator I'm sure would be a lot more common and JVDS speaks and understands English just fine. Pooey! Besides which, he doesn't need to speak/understand Spanish legal-ese, that is what the lawyer is there for!

Sorry for the rant. Just had to get that out of my system!

Well, it looks like Joran has been FINALLY charged for Stephanie's murder in the following article!!

http://www.brecorder.com/world/sout...aces-30-years-in-prison-for-peru-murder-.html

:great:

From the above article...

The prosecutor Miriam Rivero filed charges Friday for the "murder and rape of young Stephany Flores," the daughter of a well-known businessman in Lima. Flores was found dead in Van der Sloot's hotel room in May 2010, hours after meeting him in a casino.

Is this the first we've heard about Stephany being raped? :waitasec:

That is an error in the translation...I read the news in Spanish and the charges are for murder and "hurto" which means theft/robbery.
No mention of rape (violación sexual). Will try find a link to substantiate my post.

crimes against life, body and health (homicide), and simple theft

from same link:
The charges also call for reparation damages in the amount of S/. 200,000 "New Soles" ($73,000) for the victim's legal heirs.

This conclusion was reached by the Criminal Prosecutor Miriam Zully Riveros Castellares, who after a thorough investigation, determined there is merit for the case to proceed to trial.

Here's another article from my Google Alert:

snipped:

Prosecutors are asking for a 30-year prison sentence and a restitution of $73,000 to the family of Stephany Flores. They also charged van der Sloot with theft.

Charged alongside van der Sloot were three Peruvian drivers who allegedly helped him flee Peru into Chile. Prosecutors want five-year prison sentences for them and fines of about $1,800.

Police say van der Sloot took money and bank cards from her wallet and fled to Chile, where he was arrested a few days later.

"We think 30 years is too much for this crime since it was an isolated incident without any further acts of violence," Luis Jimenez Navarro said. "We have had cases in Peru under similar circumstances that have gotten less than 25 years."

The next stage is a hearing in about 15 days where the defense will respond to the charges, Jimenez said.

No date has been set for trial.

F-I-N-A-L-L-Y.....we're getting somewhere!! Let's hope all's good that follows....Joran to get his due!!! :great: :woohoo: :great:

Anyone know ....what....this trial...will consist of?....a jury?...just the attorneys and a judge?....I understand their justice system is not at all like ours...

Thanks for any info...

Looks like Joran is about to make his next television appearance....

No date has been set for trial. But the Lima-based court said Thursday, in a news release, that a hearing on the case has been scheduled for the morning of September 12.

At the hearing, prosecutors will present the charges and van der Sloot's lawyers will be given the chance to respond.

The defendant has received a notice to appear for the proceeding, to which journalists and TV cameras will be allowed access, the court said.
