The thing is - None of these officials have psychic powers. If this horrible tragedy of the murder of Stephany Rameriz had never happened and Joran had played this poker tournament in Peru as he planned and lost all his money....AGAIN.... It is likely that he would have contacted them again for the balance of the $250,000. IF it had worked out that way and he would have made his way to the U.S., he would have been arrested on American soil. Instead of the criticism, the FBI and AL U.S. Atty. would have been praised from the rooftops for their skills in getting him on U.S. charges...IN THE U.S. this time. They would have been heralded for their smarts.

Sadly, it did not happen that way. I feel horrible for everyone involved. Even the FBI and AL U.S. Atty. You know what they say about hindsight..... No one had any way of knowing he would use that $15,000 to go on another murder excursion in South America.

Great post. They put together a case against him that could have put him away for a considerable amount of time, and possibly have saved someone's life. They have been building this case for awhile, and they came forward with the charges now because it added a second layer of him not being given back to Aruba. If for any reason Peru did not come for him, we were saying we have this case and we want him sent here.

Obviously it would have been nice if they had felt they were far enough in the case and his whereabouts were known to be in a location that would pick him up and send him to us for such a charge prior to this poor girl being killed but I cannot understand the criticism to the FBI at all personally.

Both are great posts. The thing is... we don't know how long they've been building the case. My initial impression was that the extortion attempt was fairly recent. Jumping to conclusions due to the reports of him being so desperate for money. It could have happened a couple of months ago. Time will tell, I hope, and I look forward to finding out.

The second layer of protection against sending him back to Aruba if, for some reason the charges in Peru don't stick, is certainly valid.

The timing of it all; filing of the complaint is just...interesting. JMO

I am having trouble wrapping my head around this....

Beth, of all people, knows Joran is a sociopath. She is a smart and strong woman, and I don't understand how she could wire him $15,000 in the hope that he would tell her the truth about the fate of Natalee, after all of his lies and various versions of Natalee's last night....

I guess it was the act of a desperate mother who is haunted by not knowing where her daughter's remains are, and who needs closure, if there is such a thing...

I think Beth will feel guilt knowing Joran used her money to finance his South American gambling jaunt and murder spree.

I do wonder how the Alabama authorities got wind of the extortion.
 
Latest news, police raided "Terror Jaap"'s house. Terror Jaap is an obnoxious (Dutch) TV personality who had contact with Joran on a regular basis. Police seized phones and computer equipment.

Joran is toast. He'll sit in prison for years before he goes to trial and IF he survives, they will throw the book at him. He so murdered the wrong girl!! If you watch that video on the toughest prisons, it is soooo scary. The prison was originally built for 3600 inmates but has 10,000 and only about 100 guards who only police the parameter. The inmates run the prison inside and if you don't fit in or cause problems, you're "outcast" and have to dig through the trash for food. Over 60% of the prison population is HIV positive and there is no health care available. They also pass out condoms...that's their HIV control. How scary is that? The only saving grace for him is they separate the 18-25 year olds because they are more vulnerable to rape.

Such sweet justice......
 
The code charged specifies "Interference with commerce by threats or violence".

1951(a) reads as follows: "Whoever in any way or degree obstructs, delays, or affects commerce or the movement of any article or commodity in commerce, by robbery or extortion or attempts or conspires so to do, or commits or threatens physical violence to any person or property in furtherance of a plan or purpose to do anything in violation of this section shall be fined under this title or imprisoned not more than twenty years, or both."

I surfed around for a few hours last night because I'm confused as to how this scenario falls into the realm of extortion. All of the cases I found related to circumstances in which the perpetrator said to the victim if you don't do X (pay me usually) then I am going to do Y to you in return (beat you, kill you, kill someone else, destroy your reputation or business etc). I didn't find a case anywhere along the lines of "If you pay me for some bit of information, I'l be happy to provide it to you" being charged as extortion.

I'm trying to figure out an angle the FBI is going to use in order to prosecute this under extortion statutes (as they are written) and I'm not being very successful. The statute language is pretty specific. Are they implying that the "property" Joran is holding for ransom legally belongs to Beth? i.e. the location of Natalee's remains? Deals are made over the location of remains all the time. Is the average plea bargain extortion as well? I'll tell you where the body is if you don't kill me? How is that different than I'll tell you where the body is if you give me $250,000?

I hope the US gets an opportunity to take the extortion charge to trial (though I doubt it) because I'd like to see exactly how they try to make it work given current statutes. Would be interesting.

The mother of Joran van der Sloot was schocked by the news that her son has been arrested for the murder of 21 year old Stephany Flores.


'Wat is dit nu weer' is globaal haar reactie", laat advocaat Bert de Rooij weten aan het AD. "Je kunt gerust stellen dat het voor veel verdriet heeft gezorgd bij de familie", aldus de Nederlandse advocaat van de familie tegen de krant. "De stemming is dat men dit er nu niet bij kan hebben met de dood van Paul van der Sloot".

Her attorney Bert de Rooij says to AD (newspaper in the Netherlands) that her main reaction was "What's going on?". 'It caused a lot of sadness with the familÿ' 'They can't deal with this now right after Paul van der Sloot died'

I don't know if I translated 'Wat is dit nu weer' right by saying 'What's going on?' You can also translate it as something like 'What the h*ll is this?'
 
Ya, but that is still threat - in that case it was the threat of revealing something compromising. In this allegation the only person who would potentially be incriminated would be Joran himself, so how could that be extortion?

I wonder if they are going with the property angle? Legally speaking, the remains of Natalee belong to the next of kin - Beth Holloway. Joran is, legally speaking, holding property that does not belong to him, and he is demanding money in exchange for returning property to Beth that is legally hers. That is extortion. He's holding for ransom property that belongs to Beth.

I'm pretty sure if I stole someone's car and then demanded money for its return I'd be guilty of extortion. That's the only angle that makes sense to me at this point.

Anita van der Sloot spoke to her son by telephone on Thursday evening, the lawyer said, but declined to go into details about the conversation.

Interpol in Santiago on early Friday said authorities decided to deport Van der Sloot to Tacna, Peru on Friday morning, where he will be taken into custody by Peruvian police.

Also on Thursday, U.S. Attorney Joyce Vance announced that Van der Sloot has been charged with extortion and wire fraud after he reportedly tried to extort $250,000 from Natalee Holloway’s mother in exchange for the location of her remains and the circumstances surrounding her death.

Earlier, the father of the Peruvian murder victim, Ricardo Flores, urged authorities to take action. “This is not his first murder. In 2005 he killed another girl,” Ricardo said, referring to Natalee Holloway. “But because the body was not found, he was released.”

The father added, “I don’t want to see more people suffering. I want to avoid that this man continues to kill.”

I was elated to hear of his capture last night..and do hope the Peruvian authorities have enough evidence on him to end his cockiness..he is so arrogant to continually torture the Holloway family with extortion to reveal where Natalee's remains are and the circumstances surrounding her death....

I doubt Natalee was the first, as we see with Stephany..Just wondering how many more woman were done in by this , arrogant, egotistical monster...:furious:

Really like Chile's way of handling the matter. Hope there are no problems today like somehow the Dutch government intercepting him.

Waiting for an international arrest warrant and the ensuing bureaucracy means it could take months before Van der Sloot faces charges, the correspondent said.

That is very interesting. Could that play into this 'extortion' attempt?
The contract was formulated very carefully, 13 pages long. Most important Joran would receive nothing if could be proven that he lied! The only way Joran could change his life and get the money was to tell the truth!

Dave, I am terribly sorry that Joran wanted to make money over your daughter. Off course that is morally horrible. However the only way to lure Joran in a trap is with money.
Before the interview Joran talked extensively about civil right. I should hold on to the money RTL and American broadcasters would pay us so civil claims from the Holloway family would lead to nothing.

After months of investigations/stalling by the Aruban authorities, after months of trying to get Joran to do the right thing, RTL aired the show sunday 28-2-2010. At the moment Gerald Dompig left from Aruba to Holland to do his interview, the Dutch leading newspaper "De Telegraaf" secretly received information about the show on monday.

And just a side note:
-The family did have the green pick-up truck which is explicitly mentioned by Joran (also! Dompig says at the time there was a tip so search for a green pick-up truck!)

I definitely remember this green truck mention years ago. Is this Bubali Lake near a golf or tennis complex?
 
Owner of the casino was friends with Stephanys family.
Stephany brother and sister law was on the early show. They want you to remember Stephany always had a smile on her face and they wanted to let people know that justice will be served in this case!
