The Kalpoes have fought deposition by McGraw's attorneys for three years. They continue to come up with excuses to avoid it.

This is a turf war: The well-heeled McGraw lawyers are insisting that the Kalpoes, who work to make a living, appear for the depositions in the United States, rather than where they live. The Kalpoes made visa applications that were turned down because they hadn't been translated. When I spoke with a successful lawyer friend about these events, he said, "It's what corporate lawyers do with civil suits; they try to starve out the plaintives."
If the Kalpoes wanted to completely avoid depositions, they could just drop the suit. They could do that in an Aruba minute.
