During penalty phase #1 Nurmi complained about witnesses getting death threats and told the Judge that he would not be calling any witnesses. The Judge said 'fine' and moved on to Arias' allocution. I don't understand why the Judge is catering to Arias' every whim and fancy this time around. It's strange. The Judge seems convinced that the defendant has the right to a secret trial.

I fully expect more drama and delays next week. :gaah:

Good morning, Rose. I'm not so sure about your statement I bolded. I want to think that the judge is purposely letting the DT use all their dubious tactics until they are completely played out. The SC ruling has already boxed in JA. She's painted herself into a corner about whether or not to testify in open court, and her visible anger/tears in reaction to that ruling means that she wants to do neither (heh heh heh). What's left for the DT to do? Nurmi can file as many appeals as he likes, I suppose, but the more he does the more foolish he will look.

Anyway, the above is what I want to believe, but I confess I do have my doubts. I keep reassuring myself that we don't know everything and that things will be clearer once this trial is done. For now, I'm still giving her the benefit of the doubt. I'm also hoping that her rulings on Monday will give us a better sense of her intentions.

I refuse to believe JA's original conviction will ever be overturned, though it's possible she thinks so. But the longer the time between the jury seeing the pics of Travis butchered and crammed into his tiny shower stall, the less likely this jury will unanimously vote for the death penalty as memories fade. JM finished his case presentation in 4-5 days in Oct., so imo both Nurmi and JSS are equally responsible for the huge and growing gap between JM's case and the end of JA's. It didn't have to be this way. Bad choices were made which have impeded the administration of justice imo.
 
So what's with all the suntan lotion when she was cheaping out and borrowing gas cans? What possible reason would she have to buy two bottles of travel size suntan lotion while in the store to buy an extra gas can to go slaughter someone? She didn't rent a convertible. ;)

I have always thought the suntan lotion purchase was either an impulse buy, maybe it was on sale, it was summer, blah blah blah, or, that she bought it because she knew she was going to be spending time in the hot desert sun out in the middle of no man's land, burying/burning weapons, clothes, etc, and cleaning her disgusting self up after committing the premeditated, evil, sociopathic murder. IDK, JMO. With this piece of work, anything is possible.

I agree, I think they may have just been add-ins so the gas can purchase didn't stick out like a sore thumb (guilty reasoning), and the sunblock may come in handy since she was probably expecting to be driving up to Utah in the daytime (with a side-stop in the desert). The cleaning wipes, well, bonus to have those if she got herself a little messy during the actual intent of her trip and she likely didn't plan to stop anywhere to clean up before seeing Ryan.

I personally don't think for a minute that she thought 'Well, if he won't take me to Cancun then I'll just kill him', she stole the gun a week before her trip and took a knife besides, that doesn't say to me that she ever expected to go to Cancun or leave him in Mesa alive.
 
He's had plenty of time. When was the trial date set? That's how long he's had. Even if you start counting from when he said they wouldn't show up voluntarily, he's had weeks and weeks.

From a legal maneuvering standpoint - (1) he has these video/audio statements and won't admit it (doesn't want to use it that way, using their refusal to bolster his secret testimony plans) (2) OR...they're not useful witnesses, in fact might piss off the jury, and he's never had any intention of using them to actually testify. With JM calling his bluff to submit video/audio even though JM can't cross examine, won't he look foolish now (again) for not presenting 14 video mitigation witnesses? How can he take that to appeals court, when State said "bring it on".

I think she went there with every intention of killing him (personally I believe because I think she was sure he would warn all those other PPL/Mormon boy meal tickets about her). But I think she maybe, MAYBE would have spared his life (at least at that time) if he had said "surprise! I'm taking you to Cancun."
 
I think JA arrived fully prepared to kill Travis, but also to offer him one last chance to live by bringing up the Cancun trip and seeing if, after sex, he'd change his mind and realize he wanted her along. His using and rejecting her once again, his willingly committing a mortal sin with her while blogging he was in full worthy wife seeking mode, sealed his fate imo, as JA felt his death was as much or more his doing than hers. She actually imo couldn't bear the idea of TA moving toward a happy future with someone else. It was a "it's me or him" situation in her evil mind.

Maybe, esp. if he added in 'and we'll marry soon afterwards!'. lol I also think she killed him much earlier in the day than the nudes and shower pics would have us believe, we now know she had access to a Sony camera (belonging to his roommate, and was mysteriously found in the BMW), no idea if it was missing a memory card but I'm willing to bet it was. I don't think he ignored everyone who called or texted him after noon because she was so captivating, I just think he was no longer able to communicate with anyone.
 
AZL..if you're still here. Was the State obligated to turn over the 2008 mirror image or did the DT have to request it?

The State was obligated to disclose the existence of the hard drive and make an image upon request. Which they did. Nurmi is saying, I think, that the State did not disclose the fact that the State's 2008 image was slightly different from the defense team's 2009 image due to the fact that the laptop had been turned on without a write-blocker at the defense team's request. Seems to me the defense and the State had all the same information about that situation, so I don't get the problem.
 
I absolutely believe that she is medicated everyday--the result of her "meltdown" on verdict day. And if they are in fact giving her supplemental medication PRN to "calm down", then JSS's decision to ignore the Constitution for JA is even more egregious. I cannot imagine the Judge allowing all this for a convicted murderer who has PRN medication to treat episodes of panic or "nerves".

What happened on verdict day? I don't remember a meltdown... TIA
 
BBM ~ It is weird to me that the transcripts could not be released by end of Friday. How long does it take to get this together? We should of have this by end of Friday, unless of course we are on Nurmi time.

Secondly, why is every motion under advisement? Does JSS not get a briefing about what she is about to hear? (pros. misconduct/*advertiser censored*).

I also get a vibe that I don't think the jurors were expecting to still be there almost 1 month after they were originally told this would be over. We are not even done with Geffner!

According to Numi, there are no more witnesses to testify unless she allows them to do so in "secrecy". Sure, Juan says get subpoenas, video etc.... but guess what? Nurmi will say they could not properly testify because they were forced. It also seems Juan is not too concerned if he cannot cross them.

These may not be facts, just my gut. Someone please enlighten me. :coffeews:

IIRC, JA's face was calm, then crestfallen as "guilty" sank in, then teary but not sobbing as jurors were polled, no hands over face or crying out, etc.

The State was obligated to disclose the existence of the hard drive and make an image upon request. Which they did. Nurmi is saying, I think, that the State did not disclose the fact that the State's 2008 image was slightly different from the defense team's 2009 image due to the fact that the laptop had been turned on without a write-blocker at the defense team's request. Seems to me the defense and the State had all the same information about that situation, so I don't get the problem.

I think Nurmi is saying that the State was obligated to turn over the 2008 mirror image whether or not the DT requested it. The DT never requested it. The original DT instead asked for access to the HD itself, in 2009, which of course altered what was on the HD because it wasn't protected.

During the evidentiary hearings we learned that the DT never requested or accessed the 2008 mirror image. Nurmi cites AZ criminal procedure to say the State was obligated to have turned over that original 2008 mirror image without the DT requesting it.

Whether or not having the 2008 image would have changed anything the DT did is a separate question. First is the question, is Nurmi correct in his interpretation of what was required?
 
If Nurmi had his way, all the affidavits would be anonymous and they wouldn't have any names on them, even Juan wouldn't know who they are from. JA better get busy with those affidavits because noboby wants to lie for her and go to jail. Ssshh..it's all a secret. :shush: :rolleyes:

I seem to remember something about when Jodi was her own counsel that there was a list of witnesses prepared, and that she refused to turn the list over to Juan, and threw a hissy fit about it. I wonder what promises and threats were made to anyone willing to be on that list. And I do mean threats by Jodi herself.
