My point is how quickly Nurmi seized on JM saying it, and how quickly he turned it into the DT's "position."

Why would he seize on JM saying he wanted the testimony stricken? Nurmi was otherwise in the middle of saying no decision had been made nor would be made anytime soon about her resuming the stand.

I probably don't have it right, but when I read the transcript, I took it to mean that since Juan wants her testimony stricken then he cannot cross examine her that somehow him stating that makes him lose his right to cross or something.

Back to the transcripts before trial start - I find it fascinating how JA can sit there and calmly speak of the things she speaks off. You know, without showing the "right" emotions. I would be a trembling crying mess. I bet she said she felt bad for the Alexanders with the same expression on her face as when she said "Oh I went to Costa Rica for three weeks." It's incredible.

Hi Nali, while I think you are spot on given her history, I am patiently waiting for the video of this secret testimony to be released. The words when put in the context of her body language will answer a lot of questions I have after reading the testimony.

If Jodi doesn't get back on the stand and her testimony is stricken, does the jury get any sort of explanation? If I were a jury member, simply being told to disregard her testimony would definitely impact my decision as I would assume everything she said was a lie.

Morning all! I had to skip a bunch of the last thread to get here. DH printed out the transcripts for me. I used my yellow marker and made comments. Haven't gotten to part 2 yet. I simply can't tolerate reading long documents on the screen.

I'm looking forward to Pseudo John's testimony today. What did he manage to dig up? What didn't he manage to dig up.

Most of all, I'm waiting for the Judge's overly-delayed decision.

It seemed to me that whenever JW asked her how she "felt" she went off on a tangent because she doesn't really know what "feelings" are. The defense, IMO, has really bungled that because it seems so apparent to me.

Perhaps he believes it's more ammunition supporting striking the DP due to inability to "make a case for life."

I.e., JA's supposedly too scared to testify publicly, so she will only testify (or be cross-examined) in secret.

If you take away the secrecy, she can't (read won't) testify, thereby precluding her ability to "fully actualize" her mitigation.

LKN/JW/JA and their experts are masters at circular argumentation.
