Is the Judge really likely to discontinue the use of video during Baez' visits to Casey? He has already been reprimanded by staff twice for being too familiar with her.... ie 'hugging' even after being told it was taboo.

There really is no confusion UNLESS you listened to a certain WFTV reporter's report. This is because she originally says that the judge denied the Motion Regarding Family/Friend visits (which he did), but then at the end, she said we are still waiting for the judge to rule on whether the Anthonys can visit their daughter unrecorded (which is wrong).

What we are stil waiting on is the Judge to rule on whether (1) Baez can conduct his attorney-client interviews unrecorded and (2) whether the Death Penalty can be sought.

RH - how many times can DC wiggle out of this deposition (in whatever legal permutation or label)? What consequences can the court impose for his continued stalling and lack of cooperation?

would love Mr hornsby's thoughts on this.. it seems DC has wiggled out of all depositions somehow.

Wasn't it court ordered and madatory for him to comply to this deposition?

As many times as they let him; but considering it was the State that canceled the deposition - I am not sure he wiggled out of anything.

Mr. Hornsby,

I know it has been said that all Baez really has to do is "ask" for a room without recording equipment in it for his visits with KC. However, with an inmate like KC, isn't it possible the jail realizes that with someone of her "character" or lack thereof, I should say and all the lying she does, they believe it is best to have her every move recorded? I mean, I don't believe it is just for safety purposes. It could be avoiding the possibility of something (anything) happening, in which KC could accuse someone of something and the jail protecting itself by having the video to show exactly what happened or didn't happen.
I hope this makes sense. I guess in shorter form, isn't the video also for purposes of having a record of what goes on in case of any accusations by an inmate? So, it would be protecting all parties, not just safety. Video much better than just having a witness (guard) on the other side of some glass and risking the he said/she said scenario later.

Also, one more question.

Why or why not just consolidate the check charges along with the murder charges in one trial? I mean, most likely KC will be convicted on the economic charges and some of that info can and will be used in the murder trial.So, why not just consolidate the two? That would disallow the state from calling her a "convicted felon", right?

Judge Strickland denied the defense motion regarding videotaping attorney visits, but said he will review all tapes prior to their release, and withold them under certain circumstances.

My question is, could Baez now accompany George or Cindy on their visits to Casey and then claim those tapes needed to be reviewed by Strickland prior to release, and come up with a reason why each of those visit tapes should not be released?

Footnote #1 "The Court will then set a hearing at the request of any party in interest" - I am curious if this refers to the media being able to ask the court to review the tape and report on what happens in the tape as you referenced before? if the judge has already ruled it as 'prejudicial' (obviously to the defense) what would be the point of a hearing?

No. Lawyer visits occur in the jail. Family and friend visits occur at a video conference builidng.

He answered this back in the thread. He *thinks* JB may have added DC to his witness list. The prosecution will issue the investigative subpoena and the depo will happen only at a later date. I think I got it right, read back in this thread.

Manny, this was initially about the video of Casey when she heard they found Caylee's body, and her reaction to it. The media wanted that video released and JS sealed it because it was comprising. So this motion is an extension of anything that isn't family/friend/Casey visits, including lawyer/client visits. JS released a decision that the family visit videos can be released.

Unfortunately with this motion and decision,at least for Baez et al, I don't think the media knew they could ask for the release of the lawyer/client videos until now. Now they know, they can ask, but JS has to view them privately first to approve the release.

I have often wondered, with everything we have seen in the case due to the Sunshine Law, how do you feel about it?

Do you think after this case is over, the laws will be changed? I might be reaching but sometimes I wonder if JB's claim to fame that he is looking to gain recognition as the attorney who battled to have it changed and won. Big stretch huh? But I have to wonder if these laws won't change after this case.
